A RESOLUTION OF THE CITY COUNCi~L ~F THE CITY OF RANCHO
CUCA~ONGA, CALIFORNIA, ORDERING THE WORK IN OONNECTION
WITH ANNEXATION NO. 15 TO LANDSCAPE MAINTENANCE DISTRICT
NO. AND ACCEPTING THE FINAL ENGINEER' S REPORT FOR DR
87 -2
WHER AS, the City Council of the City of Rancho Cucamonga did on the
17th day of February, 1988, adopt its Resolution of Intention No. 88-085 to
order the therein described work in connection with Annexation No. 15 to
Landscape Mai~tenance District No. 3, which Resolution of Intention No. 88-085
was duly and Legally published in the time, form and manner as required by law,
shown by the %ffidavit of Publication of said Resolution of Intention on file
in the office of the City Clerk; and
WHEK~AS, after the adoption thereof, notice of the passage of said
Resolution ol Intention, headed "Notice of Improvement", was duly and legally
posted in the time, form, manner, location, and number as required by law, as
appears from ~ he Affidavit of Posting said notices, on file in the office of
the City Cle~[; and
WHER]~.AS, after the adoption thereof, notices of the adoption of the
Resolution o~ Intention were duly mailed to all persons owning real property
proposed to be assessed for the improvements described in said Resolution of
Intention No. 88-085, according to the names and addresses of such owners as
the same appe~rs on the last mailing or as known to the City Clerk of the City
of Rancho Cuc~,monga, which said copies were duly mailed in the time, form, and
manner as reqllired by law, as appears from the Affidavit of Mailing on file in
the office of the City Clerk; and
WHE~:AS, said City Council having duly received considered evidence,
oral and documentary, concerning the Jurisdiction facts in this proceeding and
concerning th~ necessity for the contemplated work and the benefits to be
derived thereJ rom and said City Council having now acquired jurisdiction to
order the pro],osed work.
SECT]iON 1: It is hereby resolved by the City Council of the City of
Rancho Cucam(,nga that the public interest and convenience requires the
annexation to the District and the ordering of the work, and said City Council
· hereby orders that the work, as set forth and described in said Resolution of
Intention No. 88-085, be done and made; and
SECT]ON 2: Be it further resolved that the report filed by the
Engineer is hE~reby finally approved; and

SECTION 3: Be it further resolved that the assessments and method of
assessment in the Engineer's Report are hereby approved.
SECTION 4: Be it finally resolved that said assessments shall not
begin until after 60 percent of said tracts have been occupied.

Engineer's Report for
Landscape Maintenance District No. 3
Annexation No. 15 for
DR 87-24
SECTION 1. ~thority for Report
Th~ report is in compliance with the requirements of Article 4,
Chapter 1, D! vision 15 of the Streets and Highways Code, State of California
(Landscaping and Lighting Act of 1972).
SECTION 2. ~eneral Description
Thi City Council has elected to annex all new developments into
Landscape Maintenance District No. 3. The City Council has determined the
areas to be maintained will have an effect upon all the developments as
mentioned atove. Ail landscaped areas to be maintained in the annexed
developments are shown on the recorded Map as roadway right-of-way or easements
to be grante~ to the City of Rancho Cucamonga.
SECTION 3. ~lans and Specifications
The plans and landscaping are as stipulated in the conditions of
approval foe the development and as approved by the City Engineering Division.
Reference is hereby made to the subject development plan and the assessment
diagram for the exact location of the landscaped areas. The plans and
specification for landscaped improvement on the individual development is
hereby made a part of this report to the same extent as if said plans and
specifications were attached hereto.
SECTION 4. Estimated Costs
No costs will be incurred by the District for parkway and median
improvement c~nstruction. Ail improvements will be constructed by developers
and or/by the City. Based on historical data, contract analysis and developed
work standard~, it is estimated that maintenance costs for assessment purposes
will equal thirty ($.30) cents per square foot per year. These costs are
estimated only, actual assessment will be based on actual cost data.
Land~cape Maintenance District No. 3 has been demarcated into two
zones. Zone 1 is comprised of Parcel Map 7349, comprised of 8 parcels,
totaling 6,0.57 square feet. The district was formed in October 5, 1983, for
the maintenan :e of landscaping a detention basin and storm drain within the
project. Thi~ zone will be assessed on per lot basis for the maintenance costs
within the pr.)j ect boundary only as stipulated in the Engineer's Report for the
formation of :he District.

Zone 2 is comprised of all other projects that are being annexed or
will be annexed to this District. Ail lots or parcels within Zone 2 will be
assessed on net acre basis for the maintenance of landscaped median islands on
Haven Avenue from 4th Street to Deer Creek Channel, Foothill Boulevard and 4th
Street from we~t to east City limit, Milliken Avenue and Rochester Avenue,
from 4th Street to Foothill Boulevard, 6th Street from Haven Avenue to
Rochester Avenue and median islands on other major divided highways and some
parkways within the Industrial specific Plan Area and Foothill Boulevard
overlay area.
The estimated cost for Landscape Maintenance District No. 3 including
Annexation No. 15 is as follows.

Assessment shall apply to each lot as enumerated in Section 6 and the
attached assessment diagram.
SECTION 5. Assessment Diagram
A copy of the proposed assessment diagram is attached to this report
and labeled "Exhibit A", by this reference the diagram is hereby incorporated
within the text of this report.

SECTION 6. Assessment
Improvements for the District are found to be of general benefit to
all lots within the District and that assessment shall be equal for each parcel
for Zone 1 and shall be equal to the next acreage for each lot or parcel in
Zone 2.
The City Council will hold a public hearing in June, to determine the
actual assessnents based upon the actual costs incurred by the City during the
previous fiscal year which are to be recovered through assessments as required
by the Landscape and Lighting Act of 1972.
SECTION 7. Order of Events
1. City Council adopts Resolution of Preliminary Approval of City Engineer's
Report.
2. City Council adopts Resolution of Intention to Annex to District and sets
public he~ring date.
3. City Coun:il conducts public hearing, considers all testimony and
determine to Annex to the District or abandon the proceedings.
4. Every yea in May, the City Engineer files a report with the City Council.
5. Every yea in June, the City Council conducts a public hearing and
approves, or modifies and approves the individual assessments.
