June 15, 2001.
Approval of a Professional Services Agreement with RJM Design
Group, Inc. (CO 01-024) for preparation of plans and specifications for
the Rancho Cucamonga Senior Center Landscape and Irrigation
Renovation Project, in the amount of $14,800 (plus 15% contingency) to
be funded from Account No. 1120-305-5300.
Approval to accept bids received, except those submitted by L.A.
Signal, Inc. and Dynalectric as non-responsive to the needs of the City,
and award and authorize the execution of the contract in the amount of
$92,114.00 ($83,740.00 plus 10% contingency) to the apparent low
bidder, DBX, Inc., (CO 01-025) for the construction of the traffic signal

INVITING BIDS" FOR THE RED HILL STORAGE BUILDING AND
STORAGE SHED AND THE HERITAGE PARK STORAGE SHED
RECOMMENDATION:
Staff recommends that the City Council authorize the City Clerk to advertise the "Notice Inviting
Bids" for the Red Hill Storage Building and Storage Shed and the Heritage Park Storage Shed.
BACKGROUND/ANALYSIS:
In light of growing participation in the City's Community Services Programs, widespread usage
of the two community parks and a continuing shortage of storage facilities at Red Hill Park and
Heritage Park have realized the need for the construction of an additional storage building at
Red Hill Park and facilities storage sheds at both locations. Staff is in the process of preparing
plans, specifications and estimates for the construction of the aforementioned structures.
The storage building will provide approximately 900 square feet of enclosed storage for use by
the Community Services Department. There will be an additional 665 square feet of covered
storage for Facilities Maintenance use at Red Hill Park and an additional 550 square feet of
covered storage for Facilities Maintenance use at Heritage Park. It is estimated that
construction will be completed September 2001.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA FOR THE RED HILL STORAGE
BUILDING AND STORAGE SHED AND THE HERITAGE PARK
STORAGE SHED AND AUTHORIZING AND DIRECTING THE
CITY CLERK TO ADVERTISE TO RECEIVE BIDS
WHEREAS, is the intention of the city of Rancho Cucamonga to construct
certain improvements in the City of Rancho Cucamonga.
WHEREAS, the City of Rancho Cucamonga is preparing plans and
specifications for the construction of certain improvements.
NOW, THEREFORE, BE IT RESOLVED that the City Clerk is hereby
authorized and directed to advertise as required by law for the receipt of sealed bids or
proposals for doing the work specified in the aforesaid plans and specifications, which
a said advertisement shall be substantially in the following words and figures, to wit:
"NOTICE INVITING SEALED BIDS OR PROPOSALS"
Pursuant to a Resolution of the City Council of the City of Rancho Cucamonga, San
Bemardino County, California, directing this notice, NOTICE IS HEREBY GIVEN
that said City of Rancho Cucamonga will receive at the Office of the City Clerk in the
offices of the City of Rancho Cucamonga, on or before the hour of 2:00 p.m. on
Tuesday, May 15, 2001, sealed bids or proposals for the "RED HILL STORAGE
BUILDING AND STORAGE SHED AND THE HERITAGE PARK STORAGE
SHED" in said City.
Bids will be publicly opened and read in the office of the City Clerk, 10500 Civic
Center Drive, Rancho Cucamonga, Califomia 91730.
Bids must be made on a form provided for the purpose, addressed to the City of Rancho
Cucamonga, California, marked, "Bid for Construction of RED HILL STORAGE
BUILDING AND STORAGE SHED AND THE HERITAGE PARK STORAGE
SHED".
pREVAILING WAGE: Notice is hereby given that in accordance with the provisions
of California Labor Code, Division 2, Part 7, Chapter 1, Articles 1 and 2, the Contractor
is required to pay not less than the general prevailing rate of per diem wages for work
of a similar character in the locality in which the public work is performed, and not less
than the general prevailing rate of per diem wages for holiday and overtime work. In
that regard, the Director of the Department of Industrial Relations of the State of
California is required to and has determined such general prevailing rates of per diem
wages. Copies of such prevailing rates of per diem wages are on file in the office of the
City Clerk of the City of Rancho Cucamonga, 10500 Civic Center Drive, Rancho

Cucamonga, California, and are available to any interested party on request. The
Contracting Agency also shall cause a copy of such determinations to be posted at the
job site.
Pursuant to provisions of Labor Code Section 1775, the Contractor shall forfeit, as
penalty to the City of Rancho Cucamonga, not more than fifty dollars ($50.00) for each
laborer, workman, or mechanic employed for each calendar day or portion thereof, if
such laborer, workman or mechanic is paid less than the general prevailing rate of
wages herein before stipulated for any work done under the attached contract, by him
or by any subcontractor under him, in violation of the provisions of said Labor Code.
Attention is directed to the provisions in Sections 1777.5 and 1777.6 of the Labor Code
concerning the employment of apprentices by the Contractor or any subcontractor
under him.
Section 1777.5, as amended, requires the Contractor or subcontractor employing
tradesmen in any apprenticable occupation to apply to the joint apprenticeship
committee nearest the site of the public work's project and which administers the
apprenticeship program in that trade for a certificate of approval. The certificate will
also fix the ratio of apprentices to journeymen that will be used in the performance of
the contract. The ratio of apprentices to journeymen in such cases shall not be less than
one to five except:
A. When unemployment in the area of coverage by the joint apprenticeship
committee has exceeded an average of 15 percent in the 90 days prior to
the request of certificate, or
When the number of apprentices in training in the area exceedg a ratio of
one to five, or
When the trade can show that it is replacing at least 1/30 of its
membership through apprenticeship training on an annual basis
statewide or locally, or
When the Contractor provides evidence that he employs registered
apprentices on all of his contracts on an annual average of not less than
one apprentice to eight journeymen.
The Contractor is required to make contributions to funds established for the
administration of apprenticeship programs if he employs registered apprentices or
journeymen in any apprenticable trade on such contracts and if other Contractors on the
public works site are making such contributions.
The Contractor and subcontractor under him shall comply with the requirements of
Sections 1777.5 and 1777.6 in the employment of apprentices.

Information relative to apprenticeship standards, wage schedules, and other
requirements may be obtained from the Director of Industrial Relations, ex-officio the
Administrator of Apprenticeship, San Francisco, California, or from the Division of
Apprenticeship Standards and its branch offices.
Eight (8) hours of labor shall constitute a legal day's work for all workmen employed in
the execution of this contract and the Contractor and any subcontractor under him shall
comply with and be governed by the laws of the State of California having to do with
working hours as set forth in Division 2, Part 7, Chapter 1, Article 3 of the Labor Code
of the State of California as amended.
The Contractor shall forfeit, as a penalty to the City of Rancho Cucamonga, twenty-five
dollars ($25.00) for each laborer, workman, or mechanic employed in the execution of
the contract, by him or any subcontractor under him, upon any of the work herein
before mentioned, for each calendar day during which said laborer, workman, or
mechanic is required or permitted to labor more than eight (8) hours in violation of said
Labor Code.
Contractor agrees to pay travel and subsistence pay to each workman needed to execute
the work required by this contract as such travel and subsistence payments are defined
in the applicable collective bargaining agreement filed in accordance with Labor Code
Section 17773.8.
The bidder must submit with his proposal, cash, cashier's check, certified check, or
bidder's bond, payable to the City of Rancho Cucamonga for an amount equal to at
least 10% of the amount of said bid as a guarantee that the bidder will enter into the
proposed contract if the same is awarded to him, and in event of failure to enter into
such contract said cash, cashiers' check, certified check, or bond shall become the
property of the City of Rancho Cucamonga.
If the City of Rancho Cucamonga awards the contract to the next lowest bidder, the
amount of the lowest bidder's security shall be applied by the City of
Rancho Cucamonga to the difference between the low bid and the second lowest bid,
and the surplus, if any shall be returned to the lowest bidder.
The amount of the bond to be given to secure a faithful performance of the contract for
said work shall be 100% of the contract price thereof, and an additional bond in an
amount equal to 100% of the contract price for said work shall be given to secure the
payment of claims for any materials or supplies furnished for the performance of the
work contracted to be done by the Contractor, or any work or labor of any kind done
thereon, and the Contractor will also be required to fumish a certificate that he carries
compensation insurance covering his employees upon work to be done under contract
which may be entered into between him and the said City of Rancho Cucamonga for
the construction of said work.

No proposal will be considered from a Contractor to whom a proposal form has not
been issued by the City of Rancho Cucamonga.
On the date and at the time of the submittal of the Bidder's Proposal the Prime
Contractor shall possess any and all contractor licenses, in form and class as required
by any and all applicable laws with respect to any and all of the work to be performed
under this contract; Including but not limited to a Class "A" License (General
Engineering Contractor) or a combination of Specialty Class "C" licenses sufficient to
cover all the work to be performed by the Prime Contractor in accordance with the

The Contractor, pursuant to the "California Business and Professions Code," Section
7028.15, shall indicate his or her State License Number on the bid, together with the
expiration date, and be signed by the Contractor declaring, under penalty of perjury,
that the information being provided is true and correct.
The work is to be done in accordance with the profiles, plans, and specifications of the
City of Rancho Cucamonga on file in the Office of the City Clerk at 10500 Civic
Center Drive, Rancho Cucamonga, Califomia. Copies of the plans and specifications,
available at the office of the City Engineer, will be fumished upon application to the
City ofRancho Cucumonga, and payment of $35.00 (THIRTY-FIVE DOLLARS), said
$35.00 (THIRTY-FIVE DOLLARS) is non refundable. Upon written request by the
bidder, copies of the plans and specifications will be mailed when said request is
accompanied by payment stipulated above, together with an additional non
reimbursable payment of $15.00 (FIFTEEN DOLLARS) to cover the cost of mailing
charges and overhead.
The successful bidder will be required to enter into a contract satisfactory to the City of
Rancho Cucamonga.
In accordance with the requirements of Section 9-3.2 of the General Provisions, as set
forth in the Plans and Specifications regarding the work contracted to be done by the
Contractor, the Contractor may, upon the Contractor's request and at the Contractor's
sole cost and expense, substitute authorized securities in lieu of monies withheld
(performance retention).
The City of Rancho Cucamonga reserves the right to reject any or all bids.

RECOMMENDATION
That the City Council approval be given to surplus the City-owned equipment and vehicles per the
attached listing which are either no longer needed, obsolete or unusable.
BACKGROUND
The City's purchasing manual identifies two major categories of surplus property: material and
supplies, and capital equipment. It has been the policy of the City to request that the City Council
provide authorization to the Purchasing Manager to dispose of City property by declaring such items
surplus. Methods of surplus are as follows: transfer to another department, trade-in, sale by bid or
auction, sale as scrap, donation, or simply disposing of the equipment.
The majority of items to be surplused are vehicles and miscellaneous equipment. If Council is in
agreement, these items will be sent to auction or donated.

held at Red Hill Community Park on Friday, June 15, 2001.
BACKGROUND
The City has received a request from the Rancho Cucamonga VFW and Boy Scout Troop 641 for a
waiver of rental and sound monitoring fees for a flag retiring ceremony to be held at Red Hill
Community Park on Friday, June 15, 2001.
The Boy Scouts are an authorized unit to properly and respectfully retire the American Flag when they
are in poor condition. At this ceremony, flags given to the VFW from local schools and local industries
will be retired. The ceremony will include participation by our local Police Department's color guard
and motorcycle patrol units, as well as the Fire District. Other local scout troops will also be invited to
participate in the program. It is anticipated that the event should last between 2-3 hours including the
time for set-up and clean up.
FISCAL IMPACT
The fiscal impact to the City for the waiver of fees associated with the flag retiring ceremony would
total $60.00.

RECOMMENDATION:
It is recommended that the City Council approve a Professional Services Agreement with RJM Design
Group, Inc., for the preparation of plans and specifications for the Rancho Cucamonga Senior Center
Landscape and Irrigation Renovation Project in the amount of $14,800, to be funded from Account No.
1120-305-5300.
BACKGROUND/ANALYSIS:
Proposals were solicited from three Landscape Architectural firms for the subject project. This project
will include removal and replacement of the aged landscape on the north, west, and south sides of the
center, as necessary, or in some cases, reintroduction of landscape material in bare areas, as well as
removal of existing, non-operational irrigation equipment, and replacement with a ~mctional, more
efficient system. Minor landscape and irrigation modifications may also be necessary on the east side
of the building, in areas that were not addressed in the recent parking lot expansion project. Staff has
reviewed all proposals received and recommends the approval of a Professional Services Agreement
with RJM Design Group, Inc., to complete the work.

vacation of excess portions of Center Avenue and 25th Street.
BACKGROUND/ANALYSIS:
Development Review 00-53, located within Noahtown on Center Avenue, 24th Street and
25th Street, east of Hermosa Avenue in the Low Residential District, was approved by the
Planning Commission on November 21, 2000, with the adoption of Resolution No. 00-
131 for the construction of single-family residences on eleven in-fill lots.
One of the conditions of the development review is to vacate 10-foot wide areas across
eleven of the in-fill lots. The original subdivision map (1887) created 80-foot wide street
rights-of-way. Present standards only require 60-foot wide streets. In this area the public
improvements exist within a 60-foot street area, thus the extra 1 O-feet on both sides of the
street are excess and should be vacated and added to the front yards.

RECOMMENDATION:
It is recommended that the City Council approve specifications for the construction of Local Street
Pavement Rehabilitation - Slurry Seal of Various Streets and approve the attached resolution
authorizing the City Clerk to advertise the "Notice Inviting Bids".
BACKGROUND I ANALYSIS:
The scope of work for Local Street Pavement Rehabilitation- Slurry Seal for various local streets
consists of, but not limited to weed killing and weed removal, crack sealing, slurry sealing and
striping. The project will be funded from Measure "1" funds, Account No. 11763035650~1022176-0.
Staff has determined that the project is categorically exempt per Article 19, Section 15301 (c) of the
CEQA guidelines.
The Engineer's estimate for Local Street Pavement Rehabilitation- Slurry Seal is $400,000. Legal
advertising is scheduled for April 10, 2001 and April 24, 2001, with bid opening at 2:00 p.m. on
Tuesday, May 1, 2001.

concerning the employment of apprentices by the Contractor or any subcontractor
under him.
Section 1777.5, as amended, requires the Contractor or subcontractor employing
tradesmen in any apprenticable occupation to apply to the joint apprenticeship
committee nearest the site of the public work's project and which administers the
apprenticeship program in that trade for a certificate of approval. The certificate will
also fix the ratio of apprentices to journeymen that will be used in the performance of
the contract. The ratio of apprentices to journeymen in such cases shall not be less
than one to five except:
When unemployment in the area of coverage by the joint apprenticeship
committee has exceeded an average of 15 percent in the 90 days prior to the
request of certificate, or
When the number of apprentices in training in the area exceeds a ratio of one

C. When the trade can show that it is replacing at least 1/30 of its membership
through apprenticeship training on an annual basis statewide or locally, or
When the Contractor provides evidence that he employs registered
apprentices on all of his contracts on an annual average of not less than one
apprentice to eight journeymen.
The Contractor is required to make contributions to funds established for the
administration of apprenticeship programs if he employs registered apprentices or

public works site are making such contributions.
The Contractor and subcontractor under him shall comply with the requirements of

requirements may be obtained from the Director of Industrial Relations, exoofficio the
Administrator of Apprenticeship, San Francisco, California, or from the Division of

Eight (8) hours of labor shall constitute a legal day's work for all workmen employed in
the execution of this contract and the Contractor and any subcontractor under him shall
comply with and be governed by the laws of the State of California having to do with
working hours as set forth in Division 2, Part 7, Chapter 1, Article 3 of the Labor Code of
the State of California as amended.
The Contractor shall forfeit, as a penalty to the City of Rancho Cucamonga, twenty-five
dollars ($25.00) for each laborer, workman, or mechanic employed in the execution of
the contract, by him or any subcontractor under him, upon any of the work herein before
mentioned, for each calendar day during which said laborer, workman, or mechanic is
required or permitted to labor more than eight (8) hours in violation of said Labor Code.
Contractor agrees to pay travel and subsistence pay to each workman needed to
execute the work required by this contract as such travel and subsistence payments are
defined in the applicable collective bargaining agreement filed in accordance with Labor
Code Section 17773.8.
The bidder must submit with his proposal, cash, cashier's check, certified check, or
bidder's bond, payable to the City of Rancho Cucamonga for an amount equal to at
least 10% of the amount of said bid as a guarantee that the bidder will enter into the
proposed contract if the same is awarded to him, and in event of failure to enter into
such contract said cash, cashiers' check, certified check, or bond shall become the
property of the City of Rancho Cucamonga.
If the City of Rancho Cucamonga awards the contract to the next lowest bidder, the
amount of the lowest bidder's security shall be applied by the City of
Rancho Cucamonga to the difference between the low bid and the second lowest bid,
and the surplus, if any shall be returned to the lowest bidder.
The amount of the bond to be given to secure a faithful performance of the contract for
said work shall be 100% of the contract price thereof, and an additional bond in an
amount equal to 100% of the contract price for said work shall be given to secure the
payment of claims for any materials or supplies furnished for the performance of the
work contracted to be done by the Contractor, or any work or labor of any kind done
thereon, and the Contractor will also be required to furnish a certificate that he carries
compensation insurance covering his employees upon work to be done under contract

which may be entered into between him and the said City of Rancho Cucamonga for the
construction of said work.
No proposal will be considered from a Contractor to whom a proposal form has not
been issued by the City of Rancho Cucamonga.
Contractor shall possess any and all contractor licenses, in form and class as required
by any and all applicable laws with respect to any and all of the work to be performed
under this contract; Including but not limited to a Class "A" License (General
Engineering Contractor) in accordance with the provisions of the Contractor's License
Law (California Business and Professions Code, Section 7000 et. seq.) and rules and
regulation adopted pursuant thereto.
The Contractor, pursuant to the "California Business and Professions Code," Section
7028.15, shall indicate his or her State License Number on the bid, together with the
expiration date, and be signed by the Contractor declaring, under penalty of perjury, that
the information being provided is true and correct.
The work is to be done in accordance with the specifications of the City of Rancho
Cucamonga on file in the Office of the City Clerk at 10500 Civic Center Drive, Rancho
Cucamonga, California. Copies of the plans and specifications, available at the office of
the City Engineer, will be furnished upon application to the City of Rancho Cucamonga,
and payment of $35.00 (THIRTY-FIVE DOLLARS), said $35.00 (THIRTY-FIVE
DOLLARS) is non-refundable. Upon written request by the bidder, copies of the plans
and specifications will be mailed when said request is accompanied by payment
stipulated above, together with an additional non-reimbursable payment of $15.00
(FIFTEEN DOLLARS) to cover the cost of mailing charges and overhead.
The successful bidder will be required to enter into a contract satisfactory to the City of
Rancho Cucamonga.
In accordance with the requirements of Section 9-3.2 of the General Provisions, as set
forth in the Specifications regarding the work contracted to be done by the Contractor,
the Contractor may, upon the Contractor's request and at the Contractor's sole cost and
expense, substitute authorized securities in lieu of monies withheld (performance

RECOMMENDATION
That City Council approve the appropriation of funds within 1700201-5302 in the amount of
$137,500.00 ($125,000.00 plus 10% contingency). It is further recommended that the City
Council approve plans and specifications for the renovation of the Epicenter Stadium Field and
authorize the City Clerk to advertise the "Notice Inviting Bids".
BACKGROUND/ANALYSIS
City staff has met a number of times with representatives from the Cucamonga Colts regarding
their intent to host their Fall 2001 football league at the Rancho Cucamonga Epicenter. An
initial non-refundable deposit was received from the Colts in August 2000. A portion of this
payment provided funds for a sod planting and growing deposit (due to the intense nature of
football play on the field, renovation of the Stadium field will be necessary at the conclusion of
the Colts' season) and for a damage/security and performance deposit. In addition, this payment
allowed for dates for the league to be held by the City for the Colts' activity and allowed the
league to begin advertising.
Since August 2000, the City has been working to ~nalize conditions of use for the Epicenter and
to complete contract negotiations with the Colts. A number of critical points still need to be
addressed with the Colts. However, in order to proceed with this renovation project in a timely
manner, the City staff needs to proceed with plans for the renovation of the Epicenter Stadium
field at the conclusion of the Colts' season. One of the requirements in the contract with the

Colts will be for the team to pay the entire cost of renovating the stadium field, in addition to
rental costs. The Colts will be required to pay the total cost of the renovation project to the City
by June 15, 2001. This cost must be advanced to the City before a bid is awarded and a contract
executed for this project. In the event the Colts do not deposit the required amount to cover the
project costs, bids will be rejected and the project will be discontinued. The Colts would then
not obtain a contract to use the stadium for their football season.
Therefore, staff recommends that the City Council approve the appropriation of funds in the
amount of $137,500.00 ($125,000.00 plus 10% contingency) and approve the authorization to
advertise the Notice Inviting Bids for the renovation of the Epicenter Stadium Field.

two soccer fields at Red Hill Community ~ark and authorize the City Clerk to advertise the

BACKGROUND/ANALYSIS
When Red Hill Community Park was opened in 1987, the soil composition of the soccer fields
was such that there was a constant problem with standing water. In 1989, staff used several
renovation measures to mitigate the situation, such as exporting the to eight inches of soil,
installin sub-surface drainage trenches, importing eight inches of a I~SGA sand, and re-
establishing the turf. These corrections provided the solution to the drainage problem. The
fields are now in their twelfth season of play, and build-up of organic matter n the top layer of
the fields has prompted a renovation project to re-establish the improved drainage.
The fields are ready to be shut down for a short period surveyed, ted, regraded and resodded
by way of a Council authorized Capital Improvement Project. The renovat on eriod has been
coordinated with the Community Services Staff. Eng neering Staff has deve~ ed plans and
specifications for the project and is now ready to advertise the "Notice Inviting Bi~[~''.

stipulated for any work done under the attached contract, by-him or by any subcontractor under
him, in violation of the provision of said Labor Code.
Attention is directed to the provisions in Sections 1777.5 and 1777.6 of the Labor Code
concerning the employment of apprentices by the Contractor or any subcontractor under him.
Section 1777.5, as amended, requires the Contractor or subcontractor employing tradesmen in
any apprenticable occupation to apply to the joint apprenticeship committee nearest the site of
the public works project and which administers the appremiceship program in that trade for a
certificate of approval. The certificate will also fix the ratio of apprentices to journeymen that
will be used in the performance of the contract. The ratio of apprentices to journeymen in such
cases shall not be less than one to five except:
When unemployment in the area of coverage by the joint apprenticeship committee has
exceeded an average of 15 percent in the 90 days prior to the request of certificate, or
2. When the number of apprentices in training in the area exceeds a ratio of one to five, or
When the trade can show that it is replacing at least 1/30 of its membership through
apprenticeship training on an annual basis statewide or locally, or
When the Contractor provides evidence that he employs registered apprentices on all of
his contracts on an annual average of not less than one apprentice to eight journeymen.
The Contractor is required to make contributions to funds established for the
administration of apprenticeship programs if he employs registered apprentices or
journeymen in any apprenticable trade on such contracts and if other Contractors on the
public works site are making such contributions.
The Contractor and subcontractor under him shall comply with the requirements of
Sections 1777.5 and 1777.6 in the employment of apprentices.

Information relative to apprenticeship standards, wage schedules, and other requirements may be
obtained from the Director of Industrial Relations, ex-officio the Administrator of
Apprenticeship, San Francisco, California, or from the Division of Apprenticeship Standards and
its branch offices.
Eight (8) hours of labor shall constitute a legal day's work for all workmen employed in the
execution of this contract and the Contractor and any subcontractor under him shall comply with
and be govemed by the laws of the State of California having to do with working hours as set
forth in Division 2, Part 7, Chapter 1, Article 3 of the Labor Code of the State of California as
amended.
The Contractor shall forfeit, as a penalty to the City of Rancho Cucamonga, twenty-five dollars
($25.00) for each laborer, workman, or mechanic employed in the execution of the contract, by
him or any subcontractor under him, upon any of the work hereinbefore mentioned, for each
calendar,day during which said laborer, workman, or,mechanic is required or permitted to labor
more than eight (8) hours in violation of said Labor Code.
Contractor agrees to pay travel and subsistence pay to each workman needed to execute the work
required by this contract as such travel and subsistence payments are defined in the applicable
collective bargaining agreement filed in accordance with Labor Code Section 17773.8.
The bidder must submit with his proposal, cash, cashier's check, certified check, or bidder's
bond, payable to the City of Rancho Cucamonga for an amount equal to at least ten percent
(10%) of the amount of said bid as a guarantee that the bidder will enter into the proposed
contract if the same is awarded to him, and in event of failure to enter into such contract said
cash, cashier's check, certified check, or bond shall become the property of the City of Rancho
Cucamonga.
If the City of Rancho Cucamonga City Council awards the contract to the next lowest bidder, the
amount of the lowest bidder's security shall be applied by the City of Rancho Cucamonga to the
difference between the low bid and the second lowest bid, and the surplus, if any shall be
returned to the lowest bidder.
The amount of the bond to be given to secure a faithful performance of the contract for said work
shall be one hundred percent (100%) of the contract price thereof, and an additional bond in an
amount equal to one hundred percent (100%) of the contract price for said work shall be given to
secure the payment of claims for any materials or supplies furnished for the performance of the
work contracted to be done by the Contractor, or any work or labor of any kind done thereon,
and the Contractor will also be required to furnish a certificate that he carries compensation
insurance covering his employees upon work to be done under contract which may be entered
into between him and the said City of Rancho Cucamonga for the construction of said work.
No proposal will be considered from a Contractor to whom a proposal form has not been issued
by the City of Rancho Cucamonga.
Contractor shall possess any and all contractors licenses, in form and class as required by any
and all applicable laws with respect to any and all of the work to be performed under this

contract; including but not limited to a "Class "A" or "C-27" license", in accordance with the
provisions of the Contractor's License Law (California Business and Professions Code, Section
7000 et. seq.) And rules and regulation adopted pursuant thereto.
The Contractor, pursuant to the A Califomia Business and Professions Code, Section 7028.15,
shall indicate his or her State License Number on the bid, together with the expiration date, and
be signed by the Contractor declaring, under penalty of perjury, that the information being
provided is true and correct.
The work is to be done in accordance with the profiles, plans, and specifications of the City of
Rancho Cucamonga City Council on file in the Office of the City Clerk at 10500 Civic Center
Drive, Rancho Cucamonga, Califomia. Copies of the plans and specifications, available at the
office of the City Engineer, will be furnished upon application to the City of Rancho Cucamonga
and payment of $35.00 (THIRTY-FIVE DOLLARS), said $35.00 (THIRTY-FIVE DOLLARS)
is non-refundable.
.Upon written request by the bidder, copies of the plans and specifications will be mailed when
said request is accompanied by payment stipulated above, together with an additional non-

or equitable interest in real property for the development of such property as provided in this

(iii) California Government Code Section 65865.2 provides, in part, as follows:
"A Development Agreement shall specify the duration of the Agreement, the
permitted uses of the property, the density of intensity of use, the maximum height and size of
proposed buildings, and provisions for reservation or dedication of land for public purposes. The
Development Agreement may include conditions, terms, restrictions, and requirements for
subsequent discretionary actions, provided that such conditions, terms, restrictions, and
requirements for discretionary actions shall not prevent development of the land for the uses and to
the density of intensity of development set forth in the Agreement..."

(iv) "Attached to this Ordinance, marked as Exhibit "A" and incorporated herein by this

Base Line Road to the north, Etiwanda Avenue to the east, Foothill Boulevard to the south, and Day
Creek Channel to the west, and as legally described in the attached Development Agreement.
Hereinafier in this Ordinance, the Development Agreement attached hereto as Exhibit "A" is referred
to as the "Development Agreement."
(v) On February 28 and March 7, 2001, the Planning Commission of the City of Rancho
Cucamonga held duly noticed hearings concerning the Development Agreement 00-04,
Development Review 01-04 for Victoria Arbors Master Plan, Tentative Tract Map 15974 and

recommended approval of Development Agreement 00-04 and approved Development Review
01-04, Tentative Tract Map 15974 and Tentative Parcel Map 15641 through adoption of its

(vi) On March 21 2001, the City Council of the City of Rancho Cucamonga held a duly
noticed hearing concerning the Development Agreement 00-04.
(vii) All legal prerequisites pdor to the adoption of this Ordinance have occurred.
B. O~inance.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby find,
determine, and ordain as follows:
SECTION 1: This Council hereby specifically finds that all of the facts set forth in the Recitals,
Part A, of this Ordinance are true and correct.
SECTION 2: Prior to the adoption of this Ordinance, this Council has reviewed the Addendum
to the EIR prepared for the Development Agreement, and determined that the Addendum to the EIR
is in compliance with the California Environmental Quality Act of 1970, as amended, and the
Guidelines promulgated thereunder.
SECTION 3: Based upon substantial evidence presented during the above-reference public
hearings on March 21,2001, including written and oral staff reports, together with public testimony,
this Council hereby specifically finds as follows:
a) The location, design, and proposes uses set forth in this Development Agreement are
compatible with the character of existing development in the vicinity.
b) The Development Agreement conforms to the General Plan of the City of Rancho
Cucamonga.
SECTION 4: It is expressly found that the public necessity, general welfare, and good zoning
practice require the approval of the Development Agreement.
SECTION 5: This Council hereby approves Development Agreement00-04, attached hereto

BACKGROUND/ANALYSIS:
Tract 15911 was recorded on September 27, 2000. The owner, Ryland Homes,
then sold the tract to APHRC 78, LLC. A modification to related Development
Review 99-72 was processed by Concordia Homes for conversion of the 55-1ot
single-family subdivision to a private gated community. The Planning Commission
approved said modification on February 14, 2001.

Ryland Homes had previously executed an improvement agreement with the City
and provided security to guarantee the completion of the required improvements,
which are currently under construction.
Interior streets, sidewalk and landscape easements and a storm drain easement
were dedicated to the City on the recorded map, Tract 15911. These have been
replaced by private streets, storm drain and landscape easements on the amended
map. The City will retain a sidewalk easement along East Avenue, but all other
public easements will be vacated concurrent with recordation of the amended map.
A fee lot for community trail and pedestrian access thereto was granted to the City.
This lot will be quitclaimed. On the amended map, a new lot A for community trail
purposes will be dedicated to the City, while the pedestrian access portion will
become a private lot reserved for the homeowners association.

findings on February 14, 2001, that disposing of said property, as herein contemplated,
would be in conformity with the General Plan of the City of Rancho Cucamonga.
(v) Said property was acquired by the City ofRancho Cucamonga in fee, for community
trail and pedestrian access purposes, the need for which has been superseded by the
development of Amended Tract No. 15911 as a private gated community.
(vi) Said property constitutes a burden on the City of Rancho Cucamonga and is no
longer necessary or convenient for the purposes for which it was acquired.
(vii) Conveyance of said property will further the use of said property and benefit the City
of Rancho Cucamonga by deletion of a necessity to maintain said property.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, ORDERING THE
DEANNEXATION OF CERTAIN TERRITORY FROM THE
WORK PROGRAM FOR LANDSCAPE MAINTENANCE
DISTRICT NO. 9 AND STREET LIGHTING MAINTENANCE
DISTRICT NOS. 1 AND g FOR AMENDED TRACT MAP
NUMBER 15911
WHEREAS, the City Council of the City ofRancho Cucamonga, California, has previously
formed a special maintenance district pursuant to the terms of the "Landscaping and Lighting Act of
1972", being Division 15, Part 2 of the Streets and Highways Code of the State of California, said
special maintenance district known and designated as Landscape Maintenance District No. 9, Street
Lighting Maintenance District No. 1 and Street Lighting Maintenance District No. 8 (referred to
collectively as the "Maintenance Districts"); and
WHEREAS, the provisions of Article 2 of Chapter 2 of the "Landscaping and Lighting Act
of 1972" authorize the annexation of additional territory to the Maintenance Districts; and
WHEREAS, the properties described on Exhibit "A" attached hereto and incorporated herein
by this reference have previously been annexed to the Maintenance District; and
WHEREAS, notwithstanding that such provisions of the 1972 Act related to the annexation
of territory to the Maintenance District, Article XIIID of the Constitution of the State of California
("Article XIIID") establishes certain procedural requirements for the authorization to levy
assessments which apply to the levy of annual assessments for the Maintenance Districts on the
territory proposed to be annexed to such districts; and
WHEREAS, the owner's decision to amend Tract 15911 as a private gated community has
resulted in a reduction of the public work program areas required.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA
HEREBY RESOLVES AS FOLLOWS:
SECTION 1: That the above recitals are all true and correct.
SECTION 2:
That this legislative body hereby orders the deannexation of work program
areas from the Maintenance District, resulting in a Revised Work Program as
described in Exhibit "A" attached hereto.
SECTION 3:
That all future proceedings of the Maintenance District, including the levy of
all assessments, shall continue to be applicable to the territory annexed on
September 20, 2000.
