A RESOLUTION OF THE CITY COUNCIL OF ~E CITY OF RANCHo
CUCAMONGA, CALIFORNIA, REFERENCING. PREVAILING ~WA~E SCALE
... AND .DIRECTING CALL FOR CONSTRUCTION BIDS
WHERE., the City Council of the City of Rancho Cucamonga. California.
has heretofore instituted -proceedings, for changes andmodifications to the
works of improvement under the provisions of. the "Municipal Improvement Act of
1913". being Division 12 of the Streets and Highways _Code pf J..the . State of
Caliform~ia. for the construction of cp~tain publlc works of improvement in a
special assessment district known and designated, as ASSESSMF~NT . DISTRICT .NO.
84-2 (ALTA .LOMA STORM DRAIN) (hereinafter referred .to ~ as. the "A~sessment
District"); and . _.
WHEREAS. at this time there have been submitted for final review the
plans and specifications for the changes and modifications, to ~ the_ works of
~provement for the Assessment District; and, ...... .~_
WHEREAS,. it is the intention of the legislative b~dy to als~ call. ~or
sealed proposals or bids for .the doing of said changes and mod~ifications to the
work and improvements .in said ~sessment District~ and,
WHEREAS, it is necessary to determine the prevailin§ rate of wages for
the various classifications of workmen required in the performance of~ said
work.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO UJCAF~NGA DOES
EEREB~ RESOLVE AS FOLLOWS:
SECTION 1. That the above recitals are all true and correct.
SECTION 2. That the plans and specifications for the changes and
modifications to the works of improvement in the Assessment District are hereby
approved and authorized for biddinE.
SECTION 3. ~"nat it is hereby determined and ascertained that the
Eeneral prevailing rate of per diem wages in the locality in which said work
described is to be performed~ in the matter of the construction of certain
public works of improvement, toEether with appurtenances, in the Assessment
District under the provisions of the "Municipal Improvement Act of 1913", being
Division 12 of the Streets and Highways Code of the State of California, for
each craft or type of workman or mechanic needed to execute the contract, and
also the general pravailinE rate for legal holiday and overtime work of each
craft or type of workman or mechanic, is in accordance with the schedule
obtained from the Director of Industrial Relations, pursuant to the provisions
of Section 1773 of the Labor Code of the State of California,:_and reference is

hereby made to copies thereof on file with the transcript of these proceedings,
which said copies are available to any interested party upon request. Further
a copy shall be posted at each job site during the course of construction.
SECTION 4. That the proposals or bids shall be opened and m~-m{ned at
a public meetin8 so calledl and said results of the bidding shall be. reported
at the next regular meeting of this legislative body after the opening of the
bids.
SECTION 5. That the terms and conditions for Bidding on the works of
improvement for this Assessment District are as set forth in full in the Bid
Documents in the specifications as previously approved. Reference ls hereby
made to said Bid Documents heretofore approved and .identified as "NOT, GE
INVITING SEALED PROPOSALS, ASSESSMENT DISTRICT NO. 84-2 (ALTA LOMA STORM DRA!N)
- BID NO. 2". For all particulars as to bidding, the Notice Inviting Sealed
Proposals above referenced and all incorporated documents and laws, including
but not llma ted to the "Municipal Improvement Act of 1913", shall control.
SECTION 6.- That it is hereby determined that in the event the
contractor, contractln8 owners included, does not complete the work Within the
time limit specified in the contract or within the time limit as shall be
authorized, -the contractor or contracting owners, as the case may be, shall pay
as liquidated- damages the amount or amounts as set.forth in the specifica}ions
for the project, said amounts herein referenced and so incorporated. That it
is impractical to determine the actual damage which will be sustained by reason
of such delay, but that the stated sum is a reasonable amount for said
liquidated damages and is not being imposed as a penalty,
PASSED, APPROVED, and ADOPTED this 16th day of November, 1988.
