A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA CERTIFYING A NEGATIVE
DECLARATION FOR AMENDMENT NO. 3 TO THE
REDEVELOPMENT PLAN FOR THE RANCHO
REDEVELOPMENT PROJECT
WHEREAS, the Rancho Cucamonga Redevelopment Agency (the "Agency") has
initiated Amendment No. 3 to the Redevelopment Plan for the Rancho Redevelopment Project
(the "Amendment'), and has filed with the City Council of the City of Rancho Cucamonga its
Report to City Council for the Amendment No. 3 to the Redevelopment Plan for the Rancho
Redevelopment Project (the "Report to City Council") which includes the Amendment; and
WHEREAS, the Planning Commission of the City of Rancho Cucamonga has
approved and forwarded to the Agency its report that the proposed Amendment is in conformity
with the General Plan of the City of Rancho Cucamonga and has recommended approval of
said Amendment; and
WHEREAS, all actions required to be taken by applicable law related to the
preparation, circulation, and review of the Draft Negative Declaration have been taken; and
WHEREAS, the City Council has reviewed and considered the Final Negative
Declaration with respect to the adoption of the Amendment; and
WHEREAS, pursuant to public notice duly given, the City Council and the
Agency held a full and fair joint public hearing on the proposed Amendment and Negative
Declaration on December 5, 2001; and
WHEREAS, all legal prerequisites to the adoption of this Resolution have
occurred.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga hereby
resolves as follows:
SECTION 1: The City Council hereby certifies that the Negative Declaration for
the adoption of the Amendment, as determined herein, has been
completed in compliance with the California Environmental Quality
Act of 1970, as amended, and the Guidelines promulgated there
under, that the City Council has reviewed and considered the
information contained in said Negative Declaration, and that said
Negative Declaration reflects the independent judgment of the
City.
SECTION 2: The City Council hereby specifically finds and determines, having
considered the record as a whole, there is no evidence before this
City Council that the project proposed herein will have the
potential of adverse effect on wildlife resources or the habitat
upon which wildlife depends. Based upon substantial evidence,
this City Council hereby rebuts the presumption of adverse effects
contained in 753.5(d) of Title 14, of the California Code of
Regulations, notwithstanding any other provision of this resolution.

SECTION 3: The City Clerk, in cooperation with the Executive Director of the
Agency, is hereby authorized and directed to file with the County
Clerk of the County of San Bernardino a Notice of Determination,
pursuant to Title 14 California Code of Regulations Section
15075, sub. (a); Pub. Resources Code, Section (21152) along
with de minims findings pursuant to Title 14 California Code of
Regulations Section 753.5.
