HomeMy WebLinkAbout02-014 - Resolutions RESOLUTION NO. 02-014 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, COUNTY OF SAN BERNARDINO, STATE OF CALIFORNIA, FINDING THAT CERTAIN REAL PROPERTY, MORE PARTICULARLY DESCRIBED HEREIN, TO BE SURPLUS AND A BURDEN ON THE CITY OF RANCHO CUCAMONGA AND AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE CERTAIN DEED, A COPY OF WHICH IS ATTACHED HERETO AS EXHIBIT"A"AND TO CAUSE THE SAME TO BE DELIVERED TO THE PERSONS NAMED HEREIN A. RECITALS. (i) The City of Rancho Cucamonga has a fee interest in that certain parcel of real property generally located at the easterly end of Santa Clara Court in the City of Rancho Cucamonga, County of San Bernardino, California, and hereinafter referred to in this Resolution as "said property." A full, true and complete description of said property is set forth in that copy of deed attached hereto as Exhibit "A" and by this reference set forth herein. (ii) California Government Code Section 37350 provides as follows: "A City may purchase, lease, receive, hold, and enjoy real and personal property, and control and dispose of it for the common benefit." (iii) California Government Code Section 37351 provides in pertinent part, as follows: "The legislative body (City Council) may... dispose of, and convey such property for the benefit of the City....." (iv) The Planning Commission of the City of Rancho Cucamonga heretofore made the findings on October 24, 2001, that disposing of said property, as herein contemplated,would be in conformitywith the General Plan of the City of Rancho Cucamonga. (v) Said property was acquired by the City of Rancho Cucamonga in fee, for future land use the need forwhich has been superseded bythe development of Tract No. 16181. (A) Said property constitutes a burden on the City of Rancho Cucamonga and is no longer necessary or convenient for the purposes for which it was acquired. (vii) Conveyance of said propertywill further the use of said propertyand benefit the City of Rancho Cucamonga by deletion of a necessity to maintain said property. (viii) All legal prerequisites to the adoption of this Resolution have occurred. Resolution No. 02-014 Page 2 of 6 B. RESOLUTION. NOW,THEREFORE,it is herebyfound,determined,and resolved by the City Council of the City of Rancho Cucamonga as follows: 1. All facts stated the Recitals, Part A., of this Resolution hereby are found to be true and correct. 2. This Council hereby finds that the quitclaiming of said property to the persons described in said deed will benefit the City of Rancho Cucamonga. 3. The Mayor and City Clerk hereby are authorized and directed to execute the deed, a full,true and correct copy of which is attached hereto as Exhibit"A",and cause the same to be recorded forthwith upon adoption of this Resolution. 4. The City Clerk shall certify to the adoption of this Resolution. PASSED, APPROVED, AND ADOPTED this 2nd day of January 2002.
