AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, ESTABLISHING GENERAL PENALTY
PROVISIONS FOR VIOLATIONS OF ORDINANCES OF THE CITY OF
RANCHO CUCAMONGA AND OTHER CODES ADOPTED BY REFERENCE.
The City Council of the City of Rancho Cucamonga, California,
does ordain as follows:
SECTION 1: (a) Any person violating any of the provisions
or failing to comply with any of the mandatory requirements of the
Ordinances of the City, or any code adopted by reference by Ordinance of
the City, shall be guilty of a misdemeanor, unless the violation is made
an infraction by Ordinance.
(b) Except in cases where a different punish—
ment is prescribed by any Ordinance of the City, any person convicted of
a misdemeanor for violation of an Ordinance of the City, or any code
adopted by reference by Ordinance of the City, is punishable by a fine
of not more than Five Hundred Dollars ($500.00), or by imprisonment not
to exceed six (6) months, or by both such fine and imprisonment.
(c) Any person convicted of an infraction for
violation of an Ordinance of the City, or any code adopted by reference
by Ordinance of the City, is punishable by:
(1) A fine not exceeding Fifty Dollars
($50.00) for a first violation;
(2) A fine not exceeding One Hundred
Dollars ($100.00) for a second violation of the same Ordinance or code
within one (1) year; and,
(3) A fine not exceeding Two Hundred
Fifty Dollars ($250.00) for each additional violation of the same Ordinance
or code within one (1) year.
(d) Each such person shall be guilty of a
separate offense for each and every day during any portion of which any
violation of any provision of the Ordinances of the City, or any code
adopted by reference by Ordinance of the City, is committed, continued
or permitted by any such person, and he shall be punishable accordingly.
(e) In addition to the penalties provided for
by this Ordinance, or elsewhere by Ordinance or by any code adopted by
reference by Ordinance of the City, any condition caused or permitted to
exist in violation of any of the provisions of the Ordinances of the
City, or any code adopted by reference by Ordinance of the City, shall
be deemed a public nuisance and may be abated by the City, and each day
such condition continues shall be regarded as anew and separate offense.
(f) In any civil action commenced by the City
to abate a public nuisance, to enjoin a violation of any provision of
any Ordinance of the City, or any code adopted by reference by Ordinance
of the City, the City shall be entitled to recov, from the defendant(s)
in any such action reasonable attorneys' fees and costs of suit.
SECTION 2: The Mayor shall sign this Ordinance and the
City Clerk shall cause the same to be published within fifteen (15) days
after its passage at least once in The Daily Report, a newspaper of
general circulation published in the City of Ontario, California, and
circulated in the City of Rancho Cucamonga, California.
