ORDERING THg WORK IN CONNECTION WITH ANNEXATION NO. 4 TO STREET LIGHTING ~LqlNTENANCE DISTHICT NO. 4 AND ACC~PTIN~ THE FINAL ~I~INEER'S REPORT FOR TRACT NO. 13191 ~HEREAS, the City Council of t~e City of Rancho Cocaaon~a did on the 18th day of Hebruary. 1987, adopt its Resolution of Intention No. 87-079 to order the therein described work in connection with Annexation No. 4 to Street Lightin$ Nainta~ance District No. 4. which ~solution of Intention No. 87-079 wa~ duly and legally published in the tiaa. £om and harmer aa required by law, sheen by the A~fidavit of Publication of said Resolution of Intention on file in the office of the City clarkl and ~HER~AS, a~ter the adoption thereot, notice of the passage of said Resolution of Intention, headed ~Notice of I~prove~ent=, was duly and lesally posted in the ti~e, fo~. ~anner. location, end nuaber as required by law, as appears from the AXfidavit of Poetin$ said notices, on file in the office of the City Clerk; and ~HERFAS, after the adoption thereof, notices of the adoption of the Resolution of Intention were duly uailed to all persons owuins real property proposed to be assessed for the improvements described in said Resolution of Intention No. 87-079, accordiu8 to the nauee and eddrensen of such owners as the same appears on the last uailin$ or as known to the City Clerk of the City of Rancho Cocsmonsa, which said copies were duly nailed in the time. rom. and nanner as required by lsm. a~ appears from the Affidavit of Mailina on file in the office of the City Clsrkl and WHIPSAW. said City Council having duly received considered evidence. oral and documentn~y.~ concerninS the jurisdiction facts in this proceeding and concarnin$ the necessity for the contemplated work and the benefits to be derived therefrom end said City Council having now acquired jurisdiction to order the proposed work. SECTION 1: It is hereby resolved by the City Council of the City of Rancho Cucomonsa that the public interest and convenience requires the annexation to the District and the ordering of the work. and said City Council hereby orders that the work. as set forth and described in said Resolution of Intention No. 87-079. be dons and medal and SECTION 2: The Report filed by the En$ineer is hereby finally approved; and SECTION 3: The assessments and method of assesenent in the Engineer's Report are hereby approved. Authorit~ for Report This report is in compliance with the requirements of Article 4, Chapter 1, Division 15 of the Streets and Highways Code, State of California {Landscaping and Lighting Act of 1972). SECTION 2. General Description This City Council has elected to annex the tracts enumerated in Exhibit "A" into Street Lighting Maintenance District No. 4. The City Council has determined that the street lights to be maintained will have an effect upon all lots within said tracts as well as on the lots directly abutting the street lights. Work to be provided for with the assessments established by the district are: The furnishing o? services ~nd materials for the ordinary and usual maintenance, operating and servicing of street light improvements on arterial and certain collector streets. I~)rovement maintenance is considered of general benefit to all areas in the District and cost shall be divided on a per lot basis. In the case of condominiums with airspace ownership only, and apartments, a dwelling unit shall be considered to benefit the same as a lot. SECTION 3. Plans and Specifications The plans and specifications for street lighting have been prepared by the developers. The plans and street lights are as stipulated in the conditions of approval for the development and as approved by the City Engineering Division. Reference is hereby made to the subject tract map or development plan and the assessment diagram for the exact location of the street lighting areas. The plans and specifications for street lighting improvement on the individual development is hereby made a part of this report to the same extent as i? said plans and specifics were attached hereto. Detailed maintenance activities on the street lighting district include: the repair, removal or replacement of all or any part of any improvement, providing for the illumination of the subject area. SECTION 4. Estimated Costs No costs will be incurred for street lighting improvement construction. All improvements will be constructed by developers. Based on available data, it is estimated that maintenance costs ?or assessment purposes will be as indicated below. These costs are estimated only, actual assessments will be based on actual cost data. The estimated total cost for Street Lighting Maintenance District No. 4 (including Annexation No. ¢ comprised of 926 units and 114 5800L lights), is shown below: 1. S.C.E. SECTION 5. Assessment Dta~ram Copies of the proposed Assessment Diagrams are attached to this report and labeled "Street Lighting Maintenance Otstrtct No. 4', Annexation No. 4. These diagrams are hereby incorporated within the text of this report. SECTION 6. Assessment Inq)rovements for the Otstrict are found to be of general benefit to all dwelling units within the District and that assessment shall be equal for each unit. Where there is more than one dwelling unit per lot or parcel of assessable land, the assessment for each lot or parcel shall be proporttonal to the nu~her of dwelling units p~r lot or parcel. It is proposed that all future development shall be annexed to the District. SECTION 7. Order of Events 1. City Council adopts Resolution of Preliminary Approval of City Engineer's Report. 2. City Council adopts Resolution of Intention to annex a District and sets public hearing date. 3. City Council conducts public hearing, considers all testimony and determines to form a District or abandon the proceedings. 4. Every year in May, the City Engineer files a report with the City Council. 5. Every year in June, the City Council conducts a public hearing and approves, or modifies and approves the individual assessments.
