Recitals. (i) Lewis Development COmpany b~-~ filed an application for Tentative Parcel Map 13987 as described in the title of this Resolution. ~mreinafter in tb~ "Application." (ii) On Deoember 17, 1991, the Planning O~ission oonducted a duly Application. Said public hearing was continued to Ja~m~y 8, 1992. (iii) On January 8, 1992, the Planning ~ion received additional public testimony on said Application and continued said Application for an indefinite time period. (iv) On April 8, 1992, the Planning Ccmm~ission of the City of Rancho Cucamo~ga conducted a duly noticed public hearing on the Application and, following the conclusion of said public hearing, adopted Resolution No. 92-62 t_hmreby conditionally approving said Application. (v) The decision ~ by said Planning Commission Resolution was timely appealed to this Council. (vi) Said appeal is a request to modify the following conditions: a. Acquire necessary right-of-way and oDnstruct Rochester Avenue full width from Base Line Road to Church Street. Off-site sidewalk and street trees may be deferred until the develolm~nt of the adjacent properties. The developer may request a ~ a~reement to recover the oost of constructing off-site street improvements from f/xtttre develo~ as it occurs; and b. Construct the portion of the Terra Vista C~,~unity Master Planned Storm Drain System #6 (lines 6 and 6-1) from this site to Day Creek Channel. If the project is to be constructed prior to the completion of the Day Creek Channel, provide a retention facility to the satisfaction of tb~ City ~ineer. Resolution No. 92-165 Page2 (vii) The modification being proposed is as follows: a. COnstruct Rochester Avenue full width from Base T.~ne Road to Ironwood, plus a transition south of Ironwood. b. Delete the requirement to oo~struc~ the portion of the from this site to Day Creek Channel. (viii) On May 20, 1992, the city (kamcil of the City of Rancho Cuc~m~ oonducted a duly noticed public hearing on the Application and appeal and concluded said hearing on that date. (ix) All legal prerequi~i~ prior to the adoption of this B. Resolution. NOW, ~, the City Council of the City of Rancho Cucamor~3a does hereby find, determine, and resolve as follows: 1. ~ Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced May 20, 1992 hearing, including written staff reports, contents of Planning C~m~dssion ~%esolution No. 92-62, this Oouncil hereby specifically finds as follows: (a) The Application applies to property located at the south- west corner of Base Line Road and ~0chester Avenue with a street frontage of 250 feet along Base T.~ne Road and 174 feet along Rochester Avenue. ~e parcel (b) ~he px~ to the nc~th and east are zoned for and being developed with single-family residenoes.
