Hutchison motioned for approval and Mayor Pro Tem Kennedy seconded approval of previous meeting minutes. C2. Consideration of an On-Street Accessible Parking Zone Program. Jason Welday introduced the proposed program that provides on-street accessible parking for individuals with disabilities or special needs. Frank Lopez then provided the presentation. He explained that accessible parking is another term for disabled parking, recognized by blue striping or curb, and the International Symbol of Accessibility (ISA). While requirements for on-site private parking lots are typically addressed through building codes, on-street accessible parking guidelines are provided through the California Vehicle Code, which authorizes cities to establish such parking zones and gives authority to the city via its municipal code. In turn, authority is granted to the City Engineer or City Traffic Engineer to regulate these parking zones. Due to past and recent requests from the community, City staff has developed a program, which is being brought forth for the City Council’s recommendation. The guidelines include: • Evidence that applicant is a full-time resident of the residential property in front of where the parking zone is requested • Evidence of CA DMV authorization to use disabled parking placard or license plate • Evidence showing a need for accessible parking at the requested location, which means that they do not have the ability to have on-site parking • Certification by the applicant that no existing on/off-street parking space meets their needs Mr. Lopez stated that the documents package includes the application’s drafted guidelines and eligibility requirements. Applicants need to certify that they are providing accurate information, and authorize staff to conduct a site inspection to ensure that the parking zone is warranted. A. ITEM(S) FOR DISCUSSION September 21, 2022 CITY OF RANCHO CUCAMONGA | PUBLIC WORKS SUBCOMMITTEE MEETING MINUTES September 21, 2022 | Public Works Subcommittee City of Rancho Cucamonga | Page 2 of 2 Applicants also need to sign a waiver releasing the City from any liability and acknowledging that the street may not be currently compliant with ADA requirements. At minimum, the curb will be painted blue and the ISA sign will be posted. An additional [no parking] sign is also required by the municipal code, which subjects unathorized parked vehicles to getting towed. Mr. Lopez reiterated that the City is not required by statute to establish these parking zones, as the City’s main purpose for implementation is to serve the residents that need them. Mr. Welday clarified that these parking zones would not be exclusive parking spaces, as anybody with a valid parking placard would be able to legally park there. The application would be valid for a two-year period and could be re-evaluated after two years. By doing so, the City can regularly assess and remove, if necessary, parking zones with no current applications. Mr. Lopez affirmed that if at any point, a parking zone becomes hazardous for the community, the City Engineer has the authority to remove it with notice to the applicant. Councilmember Ryan Hutchison expressed his support for on-street accessible parking zones that do not exist in perpertuity. He inquired if these parking zones would only be placed in locations directly adjacent to the applicant’s residence. Mr. Welday responded that while this would be ideal, it may not always be the case, especially if the location is deemed unsafe or could create other issues. Nonetheless, the City’s goal is to have these designated parking zones within a reasonable distance from the applicant’s home. While the program allows for parking zones to go in front of somebody else’s house, he encouraged applicants to coordinate with the property owner directly to avoid any unnecessary conflict. Mr. Welday reiterated that ultimately, the City will maintain discretion over determining the most appropriate locations for these parking zones. As long as this is the case, Councilmember Hutchison is satisfied with the proposed guidelines. Mayor Pro Tem Lynne Kennedy noted the potential issues with the provision for apartments, condominiums, or townhomes, particularly if someone requested additional parking on the street. She asked if the process would go through HOA or the property owner first. While there is a provision for this, Mr. Welday explained that building and accessibility code requirements regulate the number of required parking spaces on site, which are generally not fully occupied. He also stated that for sites with accessible parking spaces located on the other side of the complex and not directly out front, the City would work with HOA to determine the best possible solution. Mr. Welday confirmed that this item needs a full Council approval, because the municipal code would need to be modified to implement the program. Councilmember Hutchison made the recommendation to move forward the On-Street Accessible Parking Zone Program for the full City Council’s consideration. Mayor Pro Tem Kennedy seconded the motion. D1. ADJOURNMENT 4/3/2023 Page 1 of 4 STAFF REPORT RECOMMENDATION: Review and provide feedback on the solid waste rate adjustment request from Burrtec Waste Industries, Inc. BACKGROUND: The City of Rancho Cucamonga’s (City) franchise waste hauler, Burrtec Waste Industries, Inc. (Burrtec), submitted a written request for a biennial adjustment to the residential and commercial solid waste collection rates to the City on February 24, 2023, and a revised packet on March 27, 2023. This packet includes certain criteria required by the Franchise Agreement and the Amendment dated and signed on August 17, 2022. The amendment revised the rate methodology to include a pass through of disposal and processing fees; a five percent cap on service fee; an increase to the household hazardous waste fee; and a new Senate Bill 1383 (SB 1383) Compliance Fee. The amendment also includes a mid-cycle increase that would be effective in July 2024. Additionally, the City and Burrtec agreed to implement residential food waste collection required by SB 1383 in September 2022 and instead of implementing the increase in 2022 as initially proposed, the cost was agreed to be distributed over a five-year period ending in 2027. SB 1383 was signed into law in September 2016 to help reduce short-lived climate pollutants to address climate change. To meet the statewide goal of reducing 75% of organic waste disposal by 2025, the State developed regulations that required local jurisdictions to adopt and enforce organic waste recycling beginning January 1, 2022. The City Council adopted Ordinance 989, adding Chapter 8.15 (Mandatory Organics Waste Disposal Reduction) to Title 8 Health and Safety of the Rancho Cucamonga Municipal Code, incorporating the requirements of SB 1383. In addition to the ordinance, the City Council approved an Amendment to the Franchise Agreement as described above. The rate adjustment packet also includes a new collection program for multi-family complexes and commercial customers with bin service for the collection of bulky items. City staff and commercial property owners and managers met several years ago to discuss impacts on businesses from illegally dumped bulky items and construction waste. City staff worked to create some measures to prevent the illegal dumping from occurring, including the development and implementation of the Construction and Demolition (C&D) self-haul permit program. Welday, Director of Engineering Services/City Engineer Fred Lyn, Deputy Director of Engineering Services INITIATED BY: Linda Ceballos, Environmental Programs Manager SUBJECT: Review and Provide Feedback on the Solid Waste Rate Adjustment Request Proposed by the City’s Franchise Waste Hauler. Page 2 of 4 the C&D self-haul permit program is to ensure tenant improvements and small construction projects that do not have to pay a C&D diversion deposit were properly disposing of the waste being generated. Staff reviewed multi-family bulky item collection programs in neighboring communities and requested Burrtec complete a 12-month bulky item pick up pilot program. The target area for the pilot program included 19 multi-family complexes located in close proximity to businesses that had complained of the frequent illegal dumping of bulky household items, such as sofas and mattresses, and/or construction waste. Burrtec worked closely with property management for each site to determine appropriate location for bulky items and provided signage and outreach. Residents could simply place bulky items in a specific location and Burrtec would pick up the items weekly as scheduled. Prior to the pilot program, some property managers were instructing multi-family residents to call Burrtec and arrange for a pick-up, while others were arranging for collection of bulky items for the entire complex. Commercial customers impacted by illegal dumping were also having to arrange for pick up by Burrtec. Because the bulky item pick-up fee was not bundled with trash and recycling, the residents, property management or the businesses would be charged the per bulky item pick up fee of $34.00 and a fee of $12.47 per item for each collection. The City partnered with Burrtec to create a uniform bulky item collection program for multi-family complexes and businesses that is modeled after successful programs in neighboring cities. The rate adjustment submittal has been reviewed by staff and is currently under review by a consultant to ensure it is in accordance with the terms of the agreed upon methodology outlined in the agreement with Burrtec. ANALYSIS: In the Amendment to the Agreement approved by the City Council on August 17, 2022, the City and Burrtec agreed to implement residential food waste collection in September 2022 and instead of implementing a rate increase in 2022, as initially proposed, the cost was distributed over a five- year period ending in 2027. The amendment included the following elements that impact rates: • Rate Methodology The revised methodology for calculating rates includes the pass through of landfill, disposal costs, franchise fee and Household Hazardous Waste (HHW) fee. The rate adjustment methodology now includes the lookback provision on the disposal and processing costs as well as the SB 1383 fee, at the start of each rate review period (to start in 2025 for 2024 increase). The proposed rate packet includes actual increases for 2023 and estimates for 2024 for the Proposition 218 public hearing process. • SB 1383 Compliance Fee The SB 1383 fee covers the costs of the SB 1383 requirements that are not service related, such as outreach, record keeping, enforcement, edible food recovery program, and the procurement of recovered organic products. The SB 1383 fee does not include costs for hauling, disposal, and processing of organic products, which are included in the solid waste service component and disposal and processing cost components of the rate. The SB 1383 fee in the proposed 2023-24 rate adjustment packet includes outreach, record keeping, and enforcement. Funding for food waste pails, procurement of recovered organic products and edible food rescue, are currently being funded by a 2 year grant. The grant period is from May 2022 through May 2024. The SB 1383 fee is to be reviewed each rate adjustment period by the City and waste hauler to determine if changes are necessary, should costs change or grant funds be unavailable. Page 3 of 4 • HHW Fee The proposed rates include an increase to the HHW Disposal Fee, from 0.75% to 1.75%. The 1% increase would offset the costs associated with the growing cost of household hazardous waste disposal. This program has been successfully utilized by hundreds of residents each week for many years and works to eliminate illegal dumping and improper disposal of hazardous waste products from homes in the City, resulting in safer and healthier living for City residents. New Program – Multi-family and Commercial Bulky Item Pick-up As previously described, the City partnered with Burrtec to create a uniform bulky item collection program for multi-family complexes and businesses that is modeled after successful programs in neighboring cities. Currently, there is an additional charge for multi-family and commercial bulky item pick-up requests, as well as per item charge. The City has found that illegal dumping is problematic in both multi-family complexes (during move out), and commercial complexes (contractor waste and household bulky items), with the burden of cost falling upon the property owner. City staff and Burrtec staff worked with complexes to gather some baseline data to assist in determining a bundled rate for the 2023-24 rate adjustment period. The proposed multi-family and commercial bulky item pick-up bundled rate, if approved, would add a new component of $0.38 per yard to the rate. If the bundled rate is approved, a designated bulky item spot would be identified and labeled, and regular weekly pick up of bulky items in multi-family complexes would be scheduled. Businesses complexes would not be on a set schedule since they are not regularly generating bulky items. If the new rate/program is approved, a business experiencing illegal dumping would contact Burrtec customer service to schedule pick up of the bulky item(s) at no additional cost to the property owner. The rate adjustment submittal is currently under review by a consultant to ensure it is in accordance with the terms of the agreed upon methodology in the franchise agreement. The rate review is expected to be complete prior to distribution of the public hearing notices scheduled to be mailed out May 5, 2023. The table below shows rates that are currently on the rate schedule, and the proposed rate adjustment included in the packet from Burrtec. Next Steps The City will provide the required forty-five (45) day notification to the public in accordance with Proposition 218 by publishing notice of this hearing on May 2, 2023 in the Inland Valley Daily Page 4 of 4 Bulletin, a local newspaper of general circulation, as well as a separate mailing to each residential and commercial address on May 5, 2023. The proposed revised rates will also be available for public review in the City Clerk's Office. The Public Hearing is scheduled for June 21, 2023. FISCAL IMPACT: The City receives a franchise fee from Burrtec, paid quarterly, which equals fifteen percent (15%) of the gross receipts received by Burrtec. The franchise fee amount is expected to change as the proposed adjusted rate is revised.
