Historic Preservation Commission and Planning Commission Agenda May 24, 2023 DRAFT MINUTES Rancho Cucamonga, CA 91730 7:00 p.m. The regular meeting of the Historic Presentation Commission and Planning Commission was held on May 24, 2023. The meeting was called to order by Chair Dopp at 7:00 p.m. A. Roll Call Planning Commission present: Chair Dopp, Vice Chair Morales, Commissioner Williams, Commissioner Boling, and Commissioner Daniels. Staff Present: Serita Young, Assistant City Attorney; Jennifer Nakamura, Deputy Director of Planning; Frank Lopez, Principal Civil Engineer; Romeo David, Associate Engineer; Elizabeth Thornhill, Executive Assistant. B. Public Communications Vice Chair Dopp opened the public communications and seeing no one, closed public communications. C. Consent Calendar C1. Consideration to adopt Regular Meeting Minutes of April 26th and May 10th, 2023. Motion to adopt Meeting Minutes as presented by Commissioner Boling; second by Commissioner Williams; unanimous 5-0 vote. D. Public Hearing - None E. General Business E1. Presentation Regarding Almond Trail Drainage Improvements. Frank Lopez, Principal Civil Engineer, provided Commissioners with a PowerPoint presentation. Vice Chair Morales asked if there was a way to make sure debris does not plug up the pipes crossing under the cemented area so not to cause problems. Mr. Lopez responded they are working with Public Works on the final design to ensure easy maintenance, and they plan to go up to the trail after storm events to make sure there are no blocked pipes or inlets. Commissioner Boling inquired if the type of finish on the concrete will be rough brush to prevent slips and falls. Mr. Lopez stated it will be a heavy broom finish that leaves a rough surface making it slip resistant. Commissioners expressed their appreciation for the information. Pursuant to Development Code Section 17.14.060 and 17.20.060.D, the City Council is the final approving authority for this application and will hold a separate noticed hearing at a later date. This item is exempt from the requirements of the California Environmental Quality Act (CEAQ) under CEQA Section 15332—In-Fill Development Projects. (Design Review DRC2022-00156 and Conditional Use Permit DRC2023-00142.) Staff recommends that the Planning Commission continue this item to a date certain of June 28, 2023, due to an issue relating to public noticing. In addition to the Design Review application required for the proposed project noted above, a Conditional Use Permit is also required as the project proposes an industrial building larger than 75,000 square feet. Development Code Section 17.20.060.D establishes that the City Council is the approving authority for such Conditional Use Permit applications. Further, Development Code Section 17.14.060 establishes that when a proposed project requires more than one permit with more than one approving authority, all project permits shall be processed concurrently, and final action shall be taken by the highest-level designated approving authority for all such requested permits. Thus, in this case, the Planning Commission would be the recommending body to the City Council for both the Design Review and Conditional Use Permit. Out of an abundance of caution, staff will re-notice the project in preparation of the June 28, 2023, Planning Commission meeting.
