Conditional Use Permit DRC2023-00142
• Pursuant to Development Code Section 17.20.030.D, a Conditional
Use Permit approval by the City Council is required for all industrial
buildings larger than 75,000 square feet in gross floor area.
• The proposed project is approximately 86,194 square feet; therefore,
City Council shall review the proposed development base on its size.
Public Correspondence
• This item was advertised as a public hearing with a regular legal
advertisement in the Inland Valley Daily Bulletin newspaper, the
property was posted, and notices were mailed to all property owners
within a 1 ,500-foot radius of the project site on June 14, 2023. To date,
no comments have been received regarding the project notifications.
• The following public meeting was held:

Environmental Review
• This item is exempt from the requirements of the California
Environmental Quality Act (CEQA) and the City's CEQA guidelines
under CEQA Section:
• The project qualifies as a Class 32 exemption under State CEQA
Guidelines Section 15332 - In-Fill Development Projects
• Although, the subject site is approximately 5.2 acres, a portion of the
site (48, 188 square feet) will not be utilized or developed due to a flood
control channel easement and a Southern California Edison easement.

Public Art
• The project is subject to the City's public art ordinance and will be
required to provide public art on the project site with a minimum value
of $86,194 or pay an in-lieu fee to the City's public art fund, equal to the
minimum value of art that would otherwise be included in the
development project. A condition has been included pursuant to the
Development Code that requires the public art requirement to be met
prior to occupancy.
Recommendation
• Staff recommends that the Planning Commission adopt the attached
resolutions, recommending that the City Council approve the project.
