A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMON~A. CALIFORNIA, OF PRw~-IMINAR¥ APPROVAL OF CITY
ENGINEER' S REPORT FOR ANNEXATION NO. 5 TO LANDSCAPE
HAINT~ANC~ DISTRICT NO. 4
WHEREAS, on Narch 18. 1987 the City Council of the City of Rancho
Cuca~onga directed the Cit7 Engineer to make and file with the City Clerk of
said City a report in writin$ as required by the Landscaping and Lighting Act
of 1972: and
WHEREAS. the City Engineer has made and filed with the City Clerk of
slid Cie7 I report in writin$ as called for pursulnt to said Act. which report
has bean presented to this Council for consideration= and
~"~EREAS, slid Cie7 Council has duly considered said report and each
and ever7 part thereof, and finds that each and every part of said report is
sufficient, and that said report, nor any part thereof, requires or should be
modified in any respect.
N~, THEREFORE BE IT RESOLVED by the City Council of the City of
Rancho Cuca~on~a as follovs:
SECTION 1: That the Engineer's F~timate of the itemized costs and
expenses of said work and of the incidental expenses in connection therewith.
contained in said report bm, and each of them ara hereby, preliminarily
approved and confimed.
SECTION 2: That the diasram sho~in~ the A~eesmant District referred
to and described in said report, the boundaries of the subdivisions of land
within said A~sesment District are hereby preliminarily approved and
confimed.
SECTION 3: That the proposed assessment upon the subdivisions of
land in said A~ses~emt District in proportion to the estimated benefit to be
received by said subdivision, respectively, from said work and of the
incidental expenses thereof, aa contained in said report is hereby
preliminarily approved and confimed.
$1CTION i: That said report shell stand as the City Engineer's
Report for the purposes of all subsequent proceedings, and pursuant to the
proposed district.

Landscape Maintenance District No. 4
ANNEXATION NO. 5 For
Tracts 1319Z (Terra Vista Planned Community)
S£CTION I. Authority for Report
This report is in compliance with the reClUiraments of Article 4, Chapter
1, Division 15 of the Streets 4nd Highways Code, State of California
(Landscaping and Lighting Act of lg72).
SECTION 2. General Oescription
This City Council has elected to annex all new su~ivisions into Landscape
Maintenance Oistrtct No. 4. The City Council has determined that the areas to
he maintained will have an effect upon all lots within Tract t31g2 as well as
on the lots directly abutting the landscaped areas. All landscaped areas to
be maintained in the annexed tracts are shown on the recorded Map as roadway
right-of-way or easements to be granted to the City of Rancho Cucamonga.
SECTION 3. Plans and Specifications
The plans ~nd landscaping are as stipulated in the conditions of approval
for the development and as approved by the City Engineering Division.
Reference is hereby made to the subject tract map or development plan and the
assessment diagram for the exact location of the landscaped areas. The plans
and specifications for landscaped tnq)rovement on the individual development is
hereby made a part of this report to the sm extent as if said plans and
specifications were attached hereto.
SECTION 4. Estimated Costs
No costs ~ll be incurred for parkw~ tnM~'ov~ment construction. All
improvenents will be constructed by developers. Based on historical data,
contract anal)lis and developed work standards, it is estimated that
maintenance costs for assessment purposes wt11 equal thirty (S.30) cents per
square foot per year. These costs are estimated only, actual assessment will
be based on actual cost data.
The estimated total cost for Landscape Maintenance District No. 4 is as

Assessment shall apply to each lot as enumerated in Section 6 and the
attached assessment diagram. Where the development covered by this annexation
involves frontage along arterial or collector streets, which are designated
for inclusion in the maintenance district but will be maintained by an active
homeowners association, these assessments shall be reduced.
SECTION 5. Assessment Diagram
A copy of the proposed assessment diagram is attached to this report and
labeled "Exhibit A', by this reference the diagram is hereby incorporated
within the text of this report.

SECTION 6. Assessment
Improvements for the District are found to be of general benefit to all
lots within the District and that assessment shall be equal for each unit.

The City Council will hold a public hearing in June, to determine the
actual assessments based upon the actual costs incurred by the City during the
previous fiscal year which are to be recovered through assessments as required
by the Landsca~ and Lighting Act of 1972.
SECTION 7. Order of Events
1. City Council adopts Resolution of Preliminary Approval of City Engineer's
Report.
2. City Council adopts Resolution of Intention to Annex to District and sets
public hearing date. ~.~
3. City Council conducts public hearing, considers all testimony and
determines to Annex to the Oistrict or abandon the proceedings.
4. Every year in May, the City Engineer files a report with the City Council.
5. Every year in June, the City Council conducts a public hearing and
approves, or modifies and approves_the individual assessments.
