RESC~UTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAHONGA, CALIFORNIA, ORDERING THE PREPARATION OF A
REAPPORTIONMENT REPORT AND AMENDED ASSESSHENT AND DIAGRAM
IN ASSESSMENT DISI~tICT AND ESTABLISHING REAPPORTIONMENT
FEES FOR PARCEL MAP 9670 WITHIN THE SIXTH STREET INDUSTRIAL
PARK ASSESSHENT DISTRICT
WHEREAS, the CITY COUNCI~ of the CITY OF RANCHO CUCAMONGA CALIFORNIA.
has previously confirmed assessments in a special assessment district, pursuant
to the terms and provisions of the '~lunicipal Improvement Act of 1913", bein$
Division 12 of the Streets and High-says Code of the State of California, and
bonds were issued to represent the costs for unpaid assessments pursuant to the
terms and provisions of the '~lmprovement Bond Act of 1915", bein$ Division I0
of said Code, said special assessment district known and desisnated as
ASSESSNENT DISTRICT 82-1R
(hereinafter referred to as the "Assessment District") and
WHEREAS, subsequent thereto, certain lots and/or parcels of land upon
which there are unpaid assessments have been apportioned or divided; and
WHEREAS, at this time this le$islative body is desirous to order the
reapportionment of said unpaid assessments pursuant to the provisions of Part
10 of the "Improvement Bond Act of 1915".
NO~, THEREFORE, IT 1S HEREBY RES(I. VED AS FOLLOWS:
SECTION 1. That the above recitals are all true and correct.
SECTION 2. That the Superintendent of Streets is hereby ordered to
file with the City Clerk a report entitled "Reapportiorn-ent Report" and an
amended assessment and diagram of the original parcel or parcels of land
affected by such division or transfer of ownership, segregating and
apportioning the unpaid installments of the original assessment in accordance
with the benefits to the several parts of the original lot or parcel, plus
costs and fees of making the apportio,~,nent.
SECTION 3. That this legislative body hereby determines and
establishes a fee in the amount of $900.00 to cover the costs of the
reapportionment.
SECTION i. That the Superintendent of Streets shall, prior to making
a division end making the amended assessment, notify the owner of the original
parcel or parcels assessed, as the name of the owner or owners appear on the
last equalized assessment roll for taxes, or as said owner or owners are known
to the Superintendent of Streets, of the order of this legislative body fixing
the costs and fees of the apportionment, and directing that the payment of such
costs and fees be made to the Superintendent of Streets within fifteen (15)
days of such notification. In the event that the reapportionment fee is not
paid within fifteen (15) days of such notification, the Superintendent of
Streets shall proceed to prepare the amended assessment and shall show
separately thereon, but as a part of the total, the reapportionment fee
chargeable to each divided parcel.
