item listed or not listed on the agenda. State law prohibits us from addressing any issue not on the
Agenda. Testimony may be received and referred to staff or scheduled for a future meeting.
Comments are to be limited to three (3) minutes per individual. All communications are to be addressed
directly to the Fire Board, Agencies, Successor Agency, Authority Board, or City Council not to the members
of the audience. This is a professional business meeting and courtesy and decorum are expected. Please
refrain from any debate between audience and speaker, disorderly or boisterous conduct that disturbs,
disrupts, or otherwise impedes the orderly conduct of the meeting. For more information, refer to the City
Council Rules of Decorum and Order (Resolution No. 2023-086) located in the back of the Council
Chambers.
The public communications period will not exceed one hour prior to the commencement of the
business portion of the agenda. During this one hour period, all those who wish to speak on a topic
contained in the business portion of the agenda will be given priority, and no further speaker cards for these
business items (with the exception of public hearing items) will be accepted once the business portion of the
agenda commences. Any other public communications which have not concluded during this one hour period

CALL TO ORDER – COUNCIL CHAMBERS
The Regular meetings of the Rancho Cucamonga Fire Protection District, Housing Successor Agency,
Successor Agency, Public Finance Authority, and the City of Rancho Cucamonga City Council were held
on March 20, 2024, in the Council Chambers at City Hall, located at 10500 Civic Center Drive, Rancho
Cucamonga, California. Mayor Michael called the meeting to order at 7:00 PM.
Present were Council Members: Ryan Hutchison, Kristine Scott, Ashley Stickler, Mayor Pro Tem Lynne
Kennedy and Mayor L. Dennis Michael.
Also present were: John Gillison, City Manager; Nicholas Ghirelli, City Attorney; and Linda A. Troyan,
MMC, City Clerk Services Director.
Council Member Hutchison led the Pledge of Allegiance.

C.PUBLIC COMMUNICATIONS
Aaron Keedy, spoke about the Cucamonga Creek Trail and Pacific Electric Trail access points and
proposed that the City consider adding a trailhead/access point on Turquoise Avenue and Jennet Street.
Lorena Corona, spoke about Esperanza Scholarship Foundation ’s Dollars for Scholars, shared her story
as an alumni recipient and encouraged the community to contribute to assist underrepresented, low -
income, high-performing families that have a dream of attending college by donating to the Esperanza
Scholarship Foundation.
Noor Tabba, spoke about antisemitism and requested the City divest from companies who profit from
Israel’s military attacks.
Youssef Abdelmonem, spoke in support of a Ceasefire Resolution and requested the City divest from
companies who profit from Israel’s military attacks in Gaza.
Husam Suleiman, spoke about genocide, apartheid and ethnic cleansing in Israel, requested the City divest
from companies who profit from Israel’s military attacks and provided documents with proposed verbiage
to include in the City’s investment policy.

Submittal of a Claim to the San Bernardino County Transportation Authority (SBCTA) for

Maintenance Project and Day Creek Channel Bike Trail Improvement Project.

MOTION: Moved by Council Member Stickler, seconded by Council Member Hutchison, to approve Consent
Calendar Items D1 through D13, excluding item D8, and with Council Member Scott abstaining on item D3,
due to her employment with Southern California Gas Company. Motion carried, 5-0.
D8. Consideration to Approve a Master Services Agreement with Bluefin Payment Systems LLC for
Gateway Encryption Services in the Amount of $9,100 Plus a 10% Contingency for the Lewis
Family Playhouse and Randall Lewis Second Story and Beyond® Services. (CITY)
City Manager Gillison introduced Wess Garcia, Library Director, who provided a verbal report for item D8
and provided a revised recommendation. A revised staff report was provided to the City Council and made
available to the public.
MOTION: Moved by Council Member Scott, seconded by Mayor Pro Tem Kennedy, to approve item D8,
approving a Master Services Agreement with Bluefin Payment Systems LLC as amended to reflect City

Annexation No. 1 of Community Facilities District No. 2018-01 consented to holding the Special Election
on March 20, 2024.

Council Member Scott congratulated Teaspoon, a new shop at the Resort, on their grand opening and new
location in Rancho Cucamonga.
Council Member Hutchison announced a small delegation of the City Council and City Staff visited
Sacramento and met with three State Legislators in the State Assembly and Senate and advocated for
funds/grants and local control.
Mayor Pro Tem Kennedy asked City Manager Gillison to share the good news on an approved grant during
their visit to Sacramento.
City Manager Gillison announced funding was approved by the State for the purchase of open space at
Cucamonga Canyon.

RECOMMENDATION:
Staff recommends the City Council schedule a public hearing for the placement of special
assessments/liens for delinquent solid waste accounts to take place on May 15, 2024, during the
regularly scheduled council meeting.
BACKGROUND:
Per Section 8.17.170 of the Rancho Cucamonga Municipal Code, the requirements are
established for mandatory payment for residential, commercial, and industrial solid waste
collection service. As a result, the municipal code requires all occupied properties within the City
to maintain weekly solid waste collection service provided by the existing franchise waste hauler,
or comply with the requirements of the self-haul permit program administered by City staff. This
section of the code allows fees that are delinquent for more than 60 days to become special
assessments against the respective parcels of land, resulting in liens on the property for the
amount of the delinquent fee, plus administrative charges.
ANALYSIS:
Upon approval to schedule the public hearing, the public hearing notices will be mailed out to
property owners with delinquent solid waste accounts that accrued from January 1, 2023 to
December 31, 2023. Notices will be sent via first class mail no less than 10 days prior to the public
hearing.
FISCAL IMPACT:
The City will receive revenue in the form of a franchise fee when the delinquent accounts are paid
through the County of San Bernardino property tax collection process.

RECOMMENDATION:
It is recommended the City Council declare the listed computer equipment and peripherals,
laptops, printer, camera control, USB converter, recorder, tower, tablet, Chromebook, All In One
PC and media player items that have been deemed no longer needed, obsolete or unusable as
surplus.
BACKGROUND:
The Procurement Manager shall have the authority, granted by the City Council, to request to
dispose of City items that have been deemed as obsolete and unsuitable for City use. Methods
for disposing of surplus are to exchange for or trade in on new supplies, transfer to another
department, or offer for sale on a competitive bid basis. After a reasonable effort, and if no bids
have been received, Procurement may dispose of surplus for the highest scrap value. The City
may sell surplus property to any other governmental agency at a fair market value without any
other bids or donate surplus property to any agency or entity which is exempt from federal income
tax, with the approval of City Council.
ANALYSIS:
Items to be considered for surplus were submitted by the Department of Innovation and
Technology. Staff has reviewed all items listed for surplus, determined listed items as no longer
needed, obsolete or unusable. Staff recommends City Council approve the disposal of these
items through auction or best method as determined by the Procurement Manager.
FISCAL IMPACT:
To date, in FY 2023/24, surplus has accumulated $25,665.49 in sales through the Public Surplus
auction site.

SUBJECT:Consideration of a Professional Services Agreement with 360 Deep
Cleaning Services, LLC for Janitorial and Disinfecting Services in the
Amount Not to Exceed $150,000 Annually. (FIRE)
RECOMMENDATION:
Staff recommends the Fire Board award a Professional Services Agreement, Contract Number
FD 2024-001, with 360 Deep Cleaning Services, LLC, for janitorial and disinfection services in
the amount not exceeding $150,000 annually for two years with an option to renew in two-year
increments for a total of seven years.
BACKGROUND:
In 2020, the Fire District identified the need for enhanced cleaning, sterilization, and
decontamination services to mitigate the spread of COVID-19 in fire stations and other facilities
where first responders are housed or congregate in their duties. Enhanced measures include
aerosolized fogging decontamination of large surface areas and cleaning likely surface exposure
areas frequented by Fire District personnel and visitors.
Given the urgency and unpredictability of the COVID-19 State of Emergency, a competitive bid
process for janitorial and disinfecting services was not feasible at the time. On July 1, 2020, the
Fire District and 360 Deep Cleaning Services entered into a Professional Services Agreement
(PSA), FD 2020-005, for janitorial and enhanced disinfecting and surface sterilization services.
On October 20, 2021, with the continued transmission of COVID-19 variants and breakthrough
infections, 360 Deep Cleaning was awarded as a single-source vendor for janitorial and
disinfecting services through June 30, 2023.
The Fire District has continued the contract with 360 Deep Cleaning on a month-to-month basis
to maintain continuity for the interim period while concurrently preparing the necessary
documentation and requirements for the competitive bid process to ensure the best value for the
Fire District.
ANALYSIS:
Fire District staff provided detailed specifications for janitorial and disinfecting services to the
Procurement Division. Formal Request for Proposal (RFP) #22/23-011 was prepared and posted

on April 20, 2023, to PlanetBids, the City's automated procurement system. Subsequently, one
hundred sixty-three (163) vendors were notified, seventy-two (72) prospective bidders
downloaded or reviewed the RFP document, and eleven (11) responses were received with three
(3) of these deemed non-responsive.
An evaluation panel comprised of the Fire Business Manager, Fire Management Analyst II, and
Public Works Management Analyst III evaluated each proposal based on the following criteria:
•15% - Vendor expertise
•15% - Quality of proposed services or goods
•20% - Extent to which the services or good meet the Fire District’s needs
•30% - Demonstration of ability
•20% - Cost
Following this evaluation, the six (6) top ranked vendors were invited to interview in order to further
expand upon their RFP responses. Interviews took place on December 12, 2023, at which time
it was determined that 360 Deep Cleaning best met the criteria outlined in the RFP and should be
awarded the janitorial and disinfecting contract. Their proposal includes the required janitorial
services, as well as enhanced disinfecting and surface sterilization services, while maintaining
cost competitiveness. Key findings included:
1.Quality of Service – 360 Deep Cleaning has demonstrated a commitment to providing
exceptional cleaning and disinfecting services, utilizing industry best practices and
approved Fire District electrostatic sprayers and disinfectants to ensure the safety of our
staff and visitors. Their performance during this emergency period has been
commendable.
2.Experience and Expertise – With their familiarity with our facilities and operations, 360
Deep Cleaning possesses valuable experience and expertise in janitorial cleaning
services and disinfecting protocols, which address the Fire District's needs.
3.Cost Competitiveness—Despite the additional requirements for enhanced disinfecting
services, 360 Deep Cleaning's proposed pricing structure remained competitive and
aligned with our budgetary constraints.
4.Flexibility and Responsiveness – 360 Deep Cleaning has exhibited flexibility and
responsiveness (within-the-hour emergency disinfecting) while contracted with the Fire

RECOMMENDATION:
Staff recommends the City Council adopt a resolution authorizing application for, and receipt of
Prohousing Incentive Program (PIP) funds and authorize the City Manager to execute any
documents necessary or appropriate to secure the grant.
BACKGROUND:
On January 23, 2024, the California Department of Housing and Community Development (HCD)
released a Notice of Funding Availability for approximately $9.4 million for the current round of
PIP funds for planning and implementation activities related to housing and community
development. The City is eligible for up to $1.15 million in funding, based on eligibility criteria.
Final award amount will be dependent on the overall pool of qualified applications received.
ANALYSIS:
PIP is funded through SB2 (Atkins) which established the Building Homes and Jobs Trust Fund.
Eligible uses for these funds include the following:
1. The predevelopment, development, acquisition, rehabilitation, and preservation of
multifamily, residential live-work, or rental housing that is affordable to extremely low-, very
low-, low-, and moderate-income households, including necessary operating subsidies.
2. Affordable rental and ownership housing that meets the needs of a growing workforce
earning up to 120 percent of area median income, or 150 percent of area median income
in high-cost areas.
3. Matching portions of funds placed into local or regional housing trust funds.
4. Matching portions of funds available through the Low- and Moderate-Income Housing
Asset Fund pursuant to subdivision (d) of Section 34176 of the Health and Safety Code.
5. Capitalized reserves for services connected to the creation of new permanent supportive
housing, including, but not limited to, developments funded through the Veterans Housing
and Homelessness Prevention Bond Act of 2014.
6. Assisting persons who are experiencing or at risk of homelessness, including providing
rapid rehousing, rental assistance, navigation centers, emergency shelters, and the new
construction, rehabilitation, and preservation of permanent and transitional housing.
7. Accessibility modifications.

APPLICATION FOR, AND RECEIPT OF, PROHOUSING
INCENTIVE PROGRAM FUNDS
WHEREAS, pursuant to Health and Safety Code 50470 et. Seq, the California Department
of Housing and Community Development (Department) is authorized to issue Guidelines as part
of an incentive program (hereinafter referred to by the Department as the Prohousing Incentive
Program or “PIP”); and
WHEREAS, the City Council of the City of Rancho Cucamonga desires to submit a PIP
grant application package (“Application”), on the forms provided by the Department, for approval
of grant funding for eligible activities toward planning and implementation activities related to
housing and community development as a result of meeting eligibility criteria including but not
limited to Prohousing Designation; and
WHEREAS, the Department has issued Guidelines and Application on January 23, 2024
in the amount of $9,483,402.17 for PIP;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA
(“APPLICANT”), RESOLVES AS FOLLOWS:
SECTION 1. The City Manager and/or designee is hereby authorized and directed to submit
an Application to the Department in response to the NOFA, and to apply for the PIP grant
funds in a total amount not to exceed $1,150,000;
SECTION 2. In connection with the PIP grant, if the Application is approved by the
Department, the City Manager of the City of Rancho Cucamonga is authorized and directed
to enter into, execute, and deliver on behalf of the Applicant, a State of California Agreement
(Standard Agreement) for the amount of $1,150,000, and any and all other documents
required or deemed necessary or appropriate to evidence and secure the PIP grant, the
Applicant’s obligations related thereto, and all amendments thereto; and
SECTION 3. The Applicant shall be subject to the terms and conditions as specified in the
Guidelines, and the Standard Agreement provided by the Department after approval. The
Application and any and all accompanying documents are incorporated in full as part of the
Standard Agreement. Any and all activities funded, information provided, and timelines
represented in the Application will be enforceable through the fully executed Standard
Agreement. Pursuant to the Guidelines and in conjunction with the terms of the Standard
Agreement, the Applicant hereby agrees to use the funds for eligible uses and allowable

6155 Klusman Avenue. A condition of approval for the permit is that the property is annexed into
the appropriate Landscape Maintenance Districts and Community Facilities Districts.
ANALYSIS:
The owner, Mathew, A. Flexen & Erica, D. Flexen, have submitted the required Consent and
Waiver to Annexation form to be annexed into Landscape Maintenance District No. 1. A copy of
the form is on file with the City Clerk’s office. Adoption of the attached resolution is required to
complete the annexation process. Annexation into the associated Community Facilities Districts
is handled through a separate process.
FISCAL IMPACT:
The proposed annexations would supply additional annual revenue into Landscape Maintenance
District No. 1 in the amount of $92.21. Further, the development will install no new street trees

WHEREAS, the City Council of the City of Rancho Cucamonga, California, has
previously formed a special maintenance district pursuant to the terms of the “Landscape and
Lighting Act of 1972”, being Division 15, Part 2 of the Streets and Highways Code of the State of
California (the “Act”, said special maintenance district known and designated as Landscape
Maintenance District No. 1 (General City) (the “District”); and
WHEREAS, the provisions of Article 2 of Chapter 2 of the Act authorize the annexation
of additional territory to the District; and
WHEREAS, such provisions also provide that the requirement for the preparation of
resolutions, and assessment engineer’s report, notices of public hearing and the right of majority
protest may be waived in writing with the written consent of all of the owners of property within
the territory to be annexed; and
WHEREAS, notwithstanding that such provisions of the Act related to the annexation of
territory to the District, Article XIII D of the Constitution of the State of California (“Article XIII D”)
establishes certain procedural requirements for the authorization to levy assessments which
apply to the levy of annual assessments for the District on the territory proposed to be annexed
to such District; and
WHEREAS, the owners of certain property described in Exhibit A attached hereto, and
incorporated herein by this reference, have requested that such property (collectively, the
“Territory”) be annexed to the District in order to provide for the levy of annual assessments to
finance the maintenance of certain improvements described in Exhibit B hereto (the
“Improvements”); and
WHEREAS, all of the owners of the Territory have filed with the City Clerk duly executed
forms entitled “Consent And Waiver To Annexation Of Certain Real Property To A Maintenance
District And Approval Of The Levy Of Assessments On Such Real Property” (the “Consent and
Waiver”); and
WHEREAS, by such Consent and Waiver, all of the owners of the Territory have
expressly waived any and all of the procedural requirements as prescribed in the Act to the
annexation of the Territory to the District and have expressly consented to the annexation of the
Territory to the District; and

The Project was conditioned to annex into Street Light Maintenance District No. 7; a staff oversight
caused the Project to be incorrectly annexed into Street Light Maintenance District No. 2 with
annexation documents along with improvement agreement and securities approved at the
February 15, 2023 meeting of the City Council.
ANALYSIS:
The owners, Erika L. Booth and Russell R. Booth Jr., have submitted the correct annexation form
for Street Light Maintenance District No. 7. Ordering of this item by the City Council would adopt
the attached resolution rescinding Resolution 2023-011 adopted on February 15, 2023 and
ordering the correct annexation to Street Light Maintenance District No. 7. Copies of the
annexation forms are on file in the City Clerk’s Office.

COMMUNITY FACILITIES DISTRICT NO. 2018-01 OF THE CITY OF
RANCHO CUCAMONGA, COUNTY OF SAN BERNARDINO, STATE
OF CALIFORNIA
RECOMMENDATION:
It is recommended the City Council conduct a second reading by title only and adopt Ordinance
No. 1024, which authorizes the levy of the special tax starting in Fiscal Year 2024-25 for the
annexation territory identified as Annexation No. 1 (the “Annexation”) into the Resort of Empire
Lakes Community Facilities District No. 2018-01 (the “District”).
BACKGROUND:
On March 20, 2024, the City Council opened the public hearing on the Annexation, where any
comments from the public were to be solicited and heard by the Council. There was no public
testimony, and after the public hearing was closed, the City Council adopted Resolution No.
2024-013 calling for a special election. An election of qualified voters for the Annexation was
conducted, and the City Council adopted Resolution No. 2024-014, declaring the results of the
election, which was a unanimous vote in favor of the levy of special taxes. Lastly, the City Council
conducted a first reading of Ordinance No. 1024 to authorize the levy of a special tax commencing
Fiscal Year 2024-25, and each fiscal year thereafter. On April 3, 2024, the City Council will
consider the second reading of Ordinance No. 1024 to conclude the authorization to levy special
taxes for the Annexation.
ANALYSIS:
As required by the Mello-Roos Act, the notice of special tax lien was recorded at the San
Bernardino County Recorder’s office on March 21, 2024, with a recorded document number of
2024-0064920. The recording of the notice of special tax lien will put all interested parties,
including title companies, lenders, and future home purchasers, on notice that the property is
located within the District and is subject to a special tax.

The final adoption of Ordinance No. 1024 is proposed to take place at the City Council meeting
on April 3, 2024. On that date, the City Council will consider the adoption of Ordinance No. 1024.
If approved, the City Clerk will publish Ordinance No. 1024 within 15 days in a newspaper of
general circulation published and circulated in the area of the District.
FISCAL IMPACT:
There are no impacts to the City as a result of this item, as the District was formed to be financially
self-sufficient. Special tax revenues from the District would be utilized for the maintenance and
services provided by the District. In addition, the developer funds the costs of the annexation per
the City’s CFD Goals and Policies.

FACILITIES DISTRICT, INCLUDING CERTAIN
ANNEXATION TERRITORY IDENTIFIED AS ANNEXATION
NO. 1, INTO THE RESORT OF EMPIRE LAKES
COMMUNITY FACILITIES DISTRICT NO. 2018-01 OF THE
CITY OF RANCHO CUCAMONGA, COUNTY OF SAN
BERNARDINO, STATE OF CALIFORNIA
A. Recital
WHEREAS, the City Council (the “City Council”) of the City of Rancho Cucamonga
(the “City”) has established The Resort at Empire Lakes Community Facilities District No.
2018-01 of the City of Rancho Cucamonga, County of San Bernardino, State of California
(the “District”) for the purpose of levying special taxes on parcels of taxable property
therein for the purpose of providing certain services, which are necessary to meet
increased demands placed upon the City as a result of the development of said real
property; and
WHEREAS, the rate and method of apportionment of special tax for the District is
set forth in Exhibit “C” to the City Council Resolution No. 2024-003, which was adopted
on February 6, 2024 (the “Resolution”); and
WHEREAS, the City has conducted proceedings to annex territory into the District
and, with respect to the proceedings, following an election of the qualified electors in the
territory proposed for annexation (the “Annexation Territory”), the City Council, on March
20, 2024, adopted a Resolution which declared the results of the special election and
determined that the territory proposed to be annexed is added to and part of the District.
B. Ordinance
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Rancho
Cucamonga, California, acting in its capacity as the legislative body of the City of The
Resort at Empire Lakes Community Facilities District No. 2018-01 of the City of Rancho
Cucamonga, County of San Bernardino, State of California, does hereby:
SECTION 1. The foregoing recitals are true and correct.
SECTION 2. By the passage of this Ordinance, the City Council hereby authorizes
and levies the special tax within the District, including the Annexation Territory, pursuant
to Article 3.5 (commencing with Section 53339) of Chapter 2.5 of Part 1 of Division 2 of
Title 5 of the California Government Code, commonly known as the “Mello-Roos
Community Facilities Act of 1982,” (the “Act”), at the rate and in accordance with the rate
and method of apportionment of special tax set forth in the Resolution, which rate and

method is by this reference incorporated herein. The special tax has previously been
levied in the original territory of the District beginning in Fiscal Year 2019-20 pursuant to
Ordinance No. 493 passed and adopted by the City Council on January 16, 2019, and
the special tax is hereby levied commencing in Fiscal Year 2024-25 in the District,
including the Annexation Territory identified as Annexation No. 1, and in each fiscal year
thereafter to pay for the services for the District and the costs of administering the District.
SECTION 3. The City Manager of the City or designee or employee or consultant
of the City is hereby authorized and directed each fiscal year to determine the specific
special tax to be levied for the next ensuing fiscal year for each parcel of real property
within the District, including the Annexation Territory, in the manner and as provided in
the Resolution.
SECTION 4. Exemptions from the levy of the special tax shall be as provided in
the Resolution and the applicable provisions of the Act. In no event shall the special tax
be levied on any parcel within the District in excess of the maximum special tax specified
in the Resolution.
SECTION 5. All of the collections of the special tax shall be used as provided in
the Act and in the Resolution, including, but not limited to, the payment of the costs of the
services, the payment of the costs of the City in administering the District, and the costs
of collecting and administering the special tax.
SECTION 6. The special tax shall be collected in the same manner and at the
same time as ordinary ad valorem taxes are collected and shall have the same lien
priority, and be subject to the same penalties and the same procedure and sale in cases
of delinquency as provided for ad valorem taxes; provided, however, that the District may
collect Special Taxes at a different time or in a different manner if necessary to meet its
financial obligations. The City Manager of the City, or his or her designee, is hereby
authorized and directed to provide all necessary information to the auditor/tax collector of
the County of San Bernardino in order to effect proper billing and collection of the special
tax, so that the special tax shall be included on the secured property tax roll of the County
of San Bernardino for Fiscal Year 2024-25 and for each fiscal year thereafter until no
longer required to pay for the services or until otherwise terminated by the City.
SECTION 7. If for any reason any portion of this Ordinance is found to be invalid,
or if the special tax is found inapplicable to any particular parcel within the District,
including the Annexation Territory, by a court of competent jurisdiction, the balance of this
Ordinance and the application of the special tax to the remaining parcels within the
District, including the Annexation Territory, shall not be affected.
SECTION 8. This Ordinance shall be effective thirty (30) days after its adoption.
Within fifteen (15) days after its adoption, the City Clerk shall cause this Ordinance, or a
summary of it, to be published in a newspaper of general circulation in the City.

AN ORDINANCE OF THE CITY OF RANCHO CUCAMONGA,
CALIFORNIA, AMENDING CHAPTER 3.08 (PURCHASING
SYSTEM) OF THE RANCHO CUCAMONGA MUNICIPAL CODE
REGARDING DESIGN APPROVAL AUTHORITY FOR PUBLIC
IMPROVEMENT PROJECTS, AND MAKING A DETERMINATION
THAT THE ORDINANCE IS EXEMPT FROM THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT
I. Recitals.
A. Government Code Section 830.6 provides that neither a public entity nor a public
employee is liable for an injury caused by the plan or design of a construction of, or an
improvement to, public property where such plan or design has been approved in advance of the
construction or improvement by the legislative body of a public entity or by some other body or
employee exercising discretionary authority to give such approval or where such plan or design
is prepared in conformity with standards previously so approved.
B. In furtherance of the public interest and convenience and the retention of the
design immunity protection under Government Code Section 830.6, the City Council of the City
of Rancho Cucamonga desires to delegate by ordinance to the City Manager, Public Works
Director, City Engineer, or their designees the authority to approve plans and designs for City
public improvement projects.
C. Such delegation of design approval authority does not change the City Council’s
discretion and authority to approve projects and appropriate project funding pursuant to other
applicable City policies, procedures, and codes, or circumvent other established project design
review and approval processes.
II. Findings.
A. The City Council hereby finds that this ordinance is not subject to the provisions of
the California Environmental Quality Act (“CEQA”) because the activity is not a project as defined
by Section 15378 of the CEQA Guidelines. The ordinance has no potential for resulting in physical
change to the environment either directly or indirectly.
III. Ordinance.
The City Council of the City of Rancho Cucamonga does ordain as follows:
SECTION 1. The above recitals and findings are all true and correct and incorporated
into this Ordinance by reference.
SECTION 2. Section 3.08.110 (Bidding for Public Projects) of Chapter 3.08 (Purchasing
System) of Title 3 (Revenue and Finance), is hereby amended to add a new subsection G
“Delegation of Design Approval Authority” to read as set forth below:

G. Delegation of Design Approval Authority. The City Manager, Public
Works Director, City Engineer, or their designees are authorized to approve plans or designs for
public projects for purposes of design immunity pursuant to Government Code Section 830.6.
Nothing in this section is intended to, nor will it, preclude the City Council from separately or
additionally approving plans or designs for purposes of design immunity pursuant to Government
Code Section 830.6.
SECTION 3. Severability. The City Council declares that, should any section,
subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance for any reason be
held invalid or unconstitutional by the decision of any court of competent jurisdiction, such
decision shall not affect the validity of the remaining portions of this Ordinance. The City Council
hereby declares that it would have adopted this Ordinance and each section, subsection,
subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or
more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be
declared invalid or unconstitutional.
SECTION 4. Publication. The City Clerk shall certify to the adoption of this Ordinance
and shall cause it to be published in the manner required by law.

BACKGROUND:
Each year the City Council engages in team building workshops to review and develop goals and
to discuss related legislative matters. The first of these workshops for 2024 took place on March
4, 2024, where the City Council discussed its mission, vision, values, and goals. The Council
reaffirmed their alignment with the existing mission, vision and values and made
recommendations for adopting 2024 goals.
