A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, RATIFYING THE
DIRECTOR OF EMERGENCY SERVICES' PROCLAMATION OF
A LOCAL EMERGENCY DUE TO THE EXTREME WIND EVENT
UNDER GOVERNMENT CODE SECTION 8630 AND RANCHO
CUCAMONGA MUNICIPAL CODE SECTION 2.36
WHEREAS, Government Code Section 8630 and Section 2.36.060 of the City of
Rancho Cucamonga Municipal Code authorize the City Manager, acting as the Director of
Emergency Services, to proclaim the existence of a local emergency, as defined in Section
8558(c) of the Government Code, when the City Council is not in session; and
WHEREAS, pursuant to Government Code Section 8630, a local emergency
proclaimed by the Director of Emergency Services shall only remain in effect for seven days
unless ratified by the City Council; and
WHEREAS, Government Code Section 8558(c) defines a 'local emergency" to
include "conditions of disaster of extreme peril to the safety of persons and property within the
territorial limits of a City which are beyond the control of the services, personnel, equipment and
facilities of the City;" and,
WHEREAS, an extreme windstorm event initially occurred on Tuesday, January
7, 2025 causing the Director of Emergency Services of the City of Rancho Cucamonga, California
to declare conditions to extreme peril to safety and property, and,
WHEREAS, the windstorm event impacted the entire city. The windstorm resulted
in the loss of various species of trees and resulted in extensive damage to public roadways and
sidewalks, irrigation systems, traffic signals, fencing, block walls and private property throughout
the City; and,
WHEREAS, the windstorm event resulted in the loss of power in portions of the
City for over 24 hours and resulted in the execution of over 400 calls for service. The windstorm
event required the activation of the Emergency Operations Center (EOC) and the Public Works
Department Operations Center; and will require an extensive period of clean up before areas can
be returned to normal functions. The conditions described above are beyond the normal
capabilities and control of the services, personnel, equipment and facilities of the City of Rancho
Cucamonga,
WHEREAS, several large wildfires have started in the Southern California region
affecting available resources throughout the area; and,
WHEREAS, due to the foregoing events, on January 8, 2025, the Director of
Emergency Services proclaimed a state of emergency to exist within the City of Rancho
Cucamonga at a time when the City Council was not in session; and,
WHEREAS, the City Council desires to ratify the state of emergency due to the
severe wind event in order to provide expanded authority to address the ongoing conditions
relating to the emergency.

NOW,THEREFORE, BE IT RESOLVED by the City Council of the City of Rancho
Cucamonga, County of San Bernardino, State of California, in a City Council Meeting assembled
on January 15, 2025, that this Council hereby ratifies the state of local emergency in the City of
Rancho Cucamonga proclaimed by the Director of Emergency Services on January 8, 2025. This
local emergency declaration shall remain in effect until terminated by the City Council, provided
that the City Council shall review the need for this emergency within the next 60 days.
BE IT FURTHER RESOLVED that the City Clerk shall forward a copy of this
resolution to the Governor, to the State Office of Emergency Services, to the San Bernardino
County Emergency Services Division, and to all other appropriate state and federal agencies with
an interest therein.
BE IT FURTHER RESOLVED AND ORDERED that all City officials and
employees cooperate and coordinate efforts with officials and employees of other political
subdivisions and officials and employees of the state and federal government in bringing the
present condition of local emergency and disaster under control.
BE IT FURTHER RESOLVED AND ORDERED that the City Manager is in charge
of directing City efforts during this emergency and that all City officials and employees cooperate
with this person in bringing this emergency and disaster under control.
BE IT FURTHER RESOLVED AND ORDERED that the City Manager is hereby
designated as the authorized representative of the City of Rancho Cucamonga for the purpose of
receipt, processing and coordination of all inquiries and requirements necessary to obtain
available state and federal assistance.

STATE OF CALIFORNIA
EMERGENCY PROCLAMATION BY THE DIRECTOR OF EMERGENCY SERVICES
OF THE CITY OF RANCHO CUCAMONGA PROCLAIMING THE EXISTENCE OF A
LOCAL EMERGENCY RELATING TO SEVERE WIND EVENTS BEGINNING
JANUARY 7, 2025
WHEREAS, the California Emergency Services Act (California Government Code
sections 8639, 8550, et. seq.) defines a local emergency as the existence of conditions
of disaster or of extreme peril to the safety of persons and property within the territorial
limits of a city, caused by conditions such as air pollution, fire, flood, storm, drought,
sudden and severe energy shortage, deenergization event, or other related conditions,
which are or are likely to be beyond the control of the services, personnel, equipment,
and facilities of a city, and require the combined forces of other political subdivisions to
combat; and
WHEREAS, Section 8630 of the Government Code and Section 2.36.060 of the
City of Rancho Cucamonga Municipal Code authorize the City Manager, acting as the
Director of Emergency Services, to proclaim the existence of a local emergency, as
defined in Section 8558(c) of the Government Code, when the City Council is not in
session; and
WHEREAS, such proclamation of a local emergency must be ratified by the City
Council within seven (7) days or such proclamation shall have no further force and effect;
and
WHEREAS, Section 8634 of the Government Code provides that during a
proclaimed local emergency, the City Manager, acting as Director, of Emergency
Services, may promulgate orders and regulations necessary to provide for the protection
of life and property; and
WHEREAS, Section 2.36.060 of the Rancho Cucamonga Municipal Code
authorizes the City Manager, acting as Director of Emergency Services, to make and
issue rules and regulations on matters reasonably related to the protection of life and
property as affected by a state of emergency; and
WHEREAS, commencing on January 7, 2025, the City experienced heavy winds
causing power outages, downed trees and equipment, and related damage to public
infrastructure and private property throughout the City (the "2025 Severe Wind Event');
and

WHEREAS, local impacts of the 2025 Severe Wind Event continue to cause
widespread and sustained power outages, and other damage to buildings and other
public infrastructure such as roads within the City; and
WHEREAS, as one example, the roof of the historic China House, located at 9591
San Bernardino Road, sustained significant damage during the 2025 Severe Wind Event,
including the collapse of its roof, leading to the potential collapse of the overall structure;
and
WHEREAS, if some or all of the China House structure's walls were to collapse,
they are expected to fall into the sidewalk and street, threatening persons and vehicles
travelling on San Bernardino Road; and
WHEREAS, in addition, the risk of wildfires within the City are significant and real
given and could occur at any time during the 2025 Severe Wind Event, as evidenced by
ongoing fires in other areas of Southern California; and
WHEREAS, current estimates of the damage caused by the 2025 Severe Wind
Event have not been determined as the event is ongoing; and
WHEREAS, at the time of this Proclamation, the City Council is not in session.
NOW, THEREFORE, IT IS HEREBY PROCLAIMED by the City Manager of the City of
Rancho Cucamonga, acting as the Director of Emergency Services, as follows:
1. Conditions caused by the 2025 Severe Wind Event in the City of Rancho
Cucamonga, including but not limited to ongoing power outages, downed trees and other
public and private facilities and infrastructure, and the significant threat of fire, as well as
other currently undiscovered damage related to the 2025 Severe Wind Event, constitute
conditions of disaster and extreme peril to the safety of persons, their property and public
services; and
2. A local emergency now exists throughout the City of Rancho Cucamonga; and
3. During the existence of said local emergency the powers, functions, and duties of
the City Manager or designee shall be those prescribed by State law and the ordinances,
resolutions, codes and approved plans of the City of Rancho Cucamonga in order to
mitigate the effects of the local emergency; and
4. Pursuant to Section 2.36.060 of the Rancho Cucamonga Municipal Code, all
expenditures made in connection with this local emergency, including mutual aid
activities, shall be deemed to be for the direct protection and benefit of life and property
within the City of Rancho Cucamonga.
5. The City Manager, or his designee, is hereby designated as the authorized agent
for the City of Rancho Cucamonga for the purposes of receipt, processing, and
coordination of all inquiries and requirements necessary to obtain available County, State,
and federal assistance.

6. Pursuant to Government Code section 8630, the local emergency shall be deemed
to continue to exist for a period of up to seven (7) days, and thereafter if ratified by the
City Council.
