HomeMy WebLinkAbout2025-042 - Resolution RESOLUTION NO. 2025-042 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, REJECTING ALL BIDS, DECLARING THAT THE VG6 AND VG7 TRAIL LIGHTING PROJECT CAN BE PERFORMED MORE ECONOMICALLY BY CITY EMPLOYEES, AND APPROVING A CEQA EXEMPTION DETERMINATION WHEREAS, on or about May 27, 2025, the City issued its notice inviting bids for the VG6 and VG7 Trail Lighting Project("Project"). WHEREAS, on or before June 10,2025, bids were received to construct the Project. The amount bid by the apparent low bidder was $ 399,676.00, and $ 802,663.50 if the bid alternate additive option is added; and WHEREAS, Public Contract Code Sec. 22038(a) provides that, following notice to the apparent low bidder on a public works project of the agency's intent to reject their bid, and reevaluation of the project's cost estimates, the public agency may reject all bids and, by adoption of a resolution by four-fifths vote, declare that the project can be more economically performed by employees of the agency; and WHEREAS,the City Council has(i)provided the required notice to the apparent low bidder for the Project; (ii)reevaluated the cost estimates for the Project; and (Hi)otherwise complied with the requirements of Public Contract Code Sec. 22038(a). NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA HEREBY FINDS AND RESOLVES AS FOLLOWS: Section 1. The facts set forth in the Recitals above are true and correct and are made a part of this Resolution. Section 2. All bids received to construct the Project are hereby rejected. Based on the facts set forth in the Recitals, including the documents referenced therein, the City Council hereby declares that the Project can be more economically performed by City employees without further compliance with Public Contract Code Sections 22000 through 22045. Section 3. The City Public Works Director is hereby directed to take any and all actions necessary, consistent with local, State, and federal law, to cause the Project, including the bid alternate additive option, to be constructed and completed using City employees, at a cost not to exceed $ $387,060. No revision of the Project's plans and specifications shall be made, unless made in compliance with Public Contract Code Section 20102. Section 4. This Resolution has been reviewed in accordance with the California Environmental Quality Act (Public Resources Code Section 21000, et seq.) ("CEQA"). The City Council hereby finds that it can be seen with certainty that completion of the Project, as previously approved, has no likelihood of causing a significant negative effect on the environment. Based on the foregoing, the City Council determines that this Resolution is exempt from the application of CEQA pursuant to Section 15061(b)(3) of the CEQA Guidelines. Section 5.
