A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, ORDERING THE SUMMARY VACATION
OF NON-VEHICULAR ACCESS RIGHTS FOR LOT C OF TRACT 6939,
LOCATED AT THE NORTH END OF RUBY AVENUE
WHEREAS, the City Council of the City of Rancho Cucamonga, Calrfomia, pursuant to Division 9, Part 3,
Chapter4,of the Streets and highways Code,may summarily vacate an easement under certain conditions specified
therein; and
WHEREAS, certain non-vehicular access restrictions governing Lot C at the north end of Ruby Avenue in
the City of Rancho Cucamonga were dedicated as shown on the map of Tract 6939,filed in Book 91,pages 49 to 52
inclusive of Maps in the Office of the County Recorder of San Bernardino County; and
WHEREAS, these restrictions transferred to the City of Rancho Cucamonga pursuant to Streets and
Highways Code Section 8333(c)upon incorporation of the City; and
WHEREAS, Section 8333(c)of the California Streets and Highways Code authorizes the City to summarily
vacate(by Resolution with no public hearing) a public service easement that has been superseded by relocation or
determined to be excess and there are no other public utilities located within the easement; and
NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, HEREBY
RESOLVES, as follows:
SECTION 1: That the City Council of the City of Rancho Cucamonga hereby summarily vacates non-
vehicular access restrictions applicable to Lot C within said Tract 6939 located at the north end of Ruby
Avenue.
SECTION 2: That from and after the date the resolution is recorded, said non-vehicular access
restriction as described and depicted more particularly on EXHIBIT"A" and shown on EXHIBIT"B" no longer
constitutes a public easement.
SECTION 3: That the City Clerk shall cause a certified copy of this resolution to be recorded in the
office of the County Recorder of San Bernardino County, California.
SECTION 4: That the City Clerk shall certify to the passage and adoption of this resolution, and it
shall thereupon take effect and be in force.
