RESOLUTION NO. 97-014 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, PASSING ON THE "REPORT" OF THE ENGINEER, GIVING PRELIMINARY APPROVAL AND SETTING A TIME AND PLACE FOR PUBLIC HEARINGS WHEREAS, the City Council of the City of Rancho Cucamonga, California, has instituted proceedings for the acquisition of certain public works of improvement and appurtenances under provisions of the "Municipal Improvement Act of 1913," being Division 12 of the Streets and Highways Code of the State of California, in a special assessment district known and designated as ASSESSMENT DISTRICT NO. 93-1 (MASI PLAZA) hereinafter referred to as the "Assessment District;" and, WHEREAS, there has been prepared and filed with the legislative body a "Report" provided for in Sections 10203 and 10204 of the Streets and Highways Code of the State of California, and this "Report" has been presented for consideration; and, WHEREAS, a Resolution of Intention for the acquisition of the subject improvements was previously adopted by the legislative body; and the "Report" as now presented shall stand as the "Report" for the purpose of subsequent proceedings hereunder. NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: SECTION 1: That the above recitals are all true and correct. SECTION 2: That the "Report" of the Engineer referred to hereinabove is adopted, passed upon, and preliminarily approved, as follows: A. That the plans and specifications for the improvements proposed to be acquired, contained in said "Report" be, and they are hereby preliminarily approved and adopted; B. That the Engineer's estimate of the itemized and total costs and expenses of the acquisition of the improvements and the incidental expenses in connection therewith contained in said "Report," be, and each of them are hereby preliminarily approved and adopted; C. That the diagram showing the Assessment District referred to and described in said Resolution of Intention, and also the boundaries and dimensions of the respective subdivisions of land and within said Assessment District, as the same existed at the time of the passage of said Resolution of Intention, each of which subdivisions have been given a separate number upon said diagram, as contained in said "Report," be, and it is hereby preliminarily approved and adopted; Resolution No. 97-014 Page 2 D. That the proposed assessment upon the several subdivisions of land in said Assessment District, in proportion to the estimated special benefits to be received by such subdivisions, respectively, from said improvements, and of the incidental expenses thereof, as contained in said "Report," be, and they are hereby preliminarily approved and adopted; E. That the descriptions of the works of improvement to be acquired contained in said "Report," be, and the same are, hereby preliminarily approved. SECTION 3: That said "Report" shall stand as the Engineer's "Report" for the purpose of all subsequent proceedings had pursuant to said Resolution of Intention. SECTION 4: NOTICE IS HEREBY GIVEN THAT TWO (2) PUBLIC HEARINGS ARE HEREBY SCHEDULED IN THE REGULAR MEETING PLACE OF THIS LEGISLATIVE BODY, BEING THE COUNCIL CHAMBERS, CITY HALL, AT THE FOLLOWING DATES AND TIMES: A. FIRST PUBLIC HEARING: MARCH 19, 1997, AT 7:00 PM B. SECOND PUBLIC HEARING: APRIL 16, 1997, AT 7:00 PM RIGHT TO SUBMIT WRITTEN PROTEST AND/OR BALLOT Pursuant to the provisions of the Municipal Improvement Act of 1913, any and all persons have the dght to file a protest as described below. In addition, each record owner of property proposed to be assessed has the dght under the provisions of Article XlIIC of the Constitution of the State of California to submit a ballot in favor of or in opposition to the proposed assessment. PROTESTPROCEDURE Any and all persons having any objections to the proposed work, or assessment, or extent of the Assessment District, or to the proposed grades, may appear and show cause why said work should not be done or carried out in accordance with the Resolution of Intention and the "Report" of the Engineer. Protests must be in writing and must be delivered to the City Clerk at or before the time set for the public hearings. If a written protest is filed by owners of more than one-half of the area of land to be assessed, no further proceedings shall be taken for a period of one year, unless the protests are overruled by and affirmative vote of 4/5's of the members of the legislative body, finding that the public health and safety require the improvements. Resolution No. 97-014 Page 3 BALLOTPROCEDURE Ballots will be mailed to the record owner of each parcel located within the Assessment District and subject to a proposed assessment. Each such owner may complete such ballot and thereby indicate their support or opposition to the proposed assessment. All such ballots must be received by the City Clerk at the following address at or before the time set for the commencement of the second public hearing: CITY CLERK CITY OF RANCHO CUCAMONGA 10500 CiViC CENTER DRIVE RANCHO CUCAMONGA, CA 91729 A postmark pdor to such date and time will not be sufficient. At the public hearing, the City Council shall cause the ballots timely received to be tabulated. If a majority protest exists, the City Council shall not impose an assessment within the Assessment District. A majority protest exists if, upon the conclusion of the public hearing, ballots submitted in opposition to the assessments within the Assessment Distdct exceed the ballots submitted in favor of such assessments. In tabulating the ballots, the ballots shall be weighted according to the proportional financial obligation of the affected property. SECTION 5: That the City Clerk is hereby directed to mail notice of said Public Hearings and the adoption of the Resolution of Intention and of the filing of the "Report" to all persons owning real property proposed to be assessed, whose names and addresses appear on the last equalized assessment roll for County taxes prior thereto, or as known to said City Clerk, and to all other persons as prescribed in accordance with the provisions of said Division 12. SECTION 6: That the City Clerk is hereby further directed to file a copy of the proposed boundary map in the Office of the County Recorder within fifteen (15) days of the adoption of the proposed boundary map; said boundary map to be in the manner and form as set forth in Division 4.5 of the Streets and Highways Code of the State of California. For particulars to the identification of said parcels, reference ismadeto the Assessment Diagram, a copy ofwhich is atmched hereto. o As required by law, a Diagram is hereto attached, showing the Assessment District, as well as the boundaries and dimensions of the respective parcels and subdivisions of land within said District as the same existed at the time of the passage of said Resolution of Intention. each of which subdivisions of land or parcels or lots, respectively, have been given a separate number upon said Diagram and in said Assessment Roll. An annual assessment, in an amount not to exceed five percent (5 %) of the annual assessments collected to service the bonded debt, shall be assessed pro rata upon each of the parcels of land upon which there is an unpaid assessment in the Assessment District to pay costs incurred by the City, and not otherwise reimbursed, which result from the administration and collection of any bonds issued or funds administered under the proceedings, as provided in Section 10204(f) of the Act; such costs shall be in addition to any costs collected pursuant to Sections 8682 and 8682.1 of the Bond Law (as defined in Section 4 hereof). GFB-FRIEDRICH & ASSOC., INC. /~SESSM'ENT ENGINEE '~/CITY OF RANCHO CUCAMONGA COUNTY OF SAN BERNARDINO STATE OF CALIFORNIA 18 ENGINEER'S "REPORT" EXHIBIT "A" CITY OF RANCHO CUCAMONGA ASSESSMENT DISTRICT NO. 93-1 (MASl PLAZA) Resolution 97-~14 Page 24 METHOD AND FORMULA OF ASSESSMENT SPREAD The law requires and the statutes provide that assessments, as levied pursuant to the provisions of the "Municipal Improvement Act of 1913", must be based on the benefit that the properties receive from the works of improvement. It is further necessary that the property owners receive a special and direct benefit distinguished from that of the general public. The statute does not specifiy the method or formula that should be used in any special assessment district proceedings, and that responsibility rests with the Assessment Engineer, who is appointed for the purpose of making the analysis of the facts and determining the correct apportionment of the assessment obligation. The boundaries of Assessment District No. 93-1 correspond to the boundaries of Parcel Map No. 13845. The special benefits that inure to the property owners within the boundary of Assessment District No. 93-1 are the construction of street, storm drainage, water system, and sewerage improvements, and the necessary appurtenant work to provide complete, functional improvements for all parcels of !and within this commercial development project. The construction cost and proportionate share of the incidental costs for bid items will be spread on a net assessable acreage basis to those areas or subareas of the Assessment District that benefit from the works of improvement. The benefit received from the above-cited works of improvement is estimated to be in direct proportion to the number of assessable net acres of the recorded lots. Assessments are spread over all parcels within the Assessment District in the following manner: Because each lot within this subdivided commercial project receives direct and special benefit from the access provided by street and traffic signal improvements, from the water provided by the water system improvements, from the sewage disposal provided by the sewerage system improvements, from the flood protection provided by the storm drainage improvements, and from landscaping and historic area improvements: each lot will be assessed based upon its proportion of the total assessable acreage within Assessment District No. 93-1 (Parcel Map No. 13845). Net assessable acreage for all lots within the Assessment District is taken directly from the "per lot" net acreage shown on the recorded parcel map (acreage of easements for ingress/egress, landscaping, Activity Zone, Vintner's Walk, drainage, water and sewerage facilities will not be deducted from net lot acreages). 19 Resolution 97-014 Page 25 All benefit within this project is determined to be special benefit in that all of the improvements to be financed, as described herein, will ultimately be paid for solely by the owners of the property within the assessment district boundary. It is not logical, nor is it expected, that owners of property outside of the assessment district boundary will be making financial contributions to the project. Therefore, it is determined that no general benefit applies to this project. Also, the ability to develop the property within the assessment district boundary into viable commercial lots is in itself a special benefit to said property. There are no potentially assessable lots or parcels of land that are owned by a public agency within the boundaries of Assessment District No. 93-1. Other methods of spreading the assessments were considered. Front footage for linear improvements (streets, water, sewerage) is not a fair method of spreading assessmenu to parcels within this Assessment District because some of the parcels have a disproportionately large amount of front footage and other parcels have very small front footage, which would lead to certain parcels receiving either unfairly large or unfairly small assessments for said improvements. Using an equivalent unit method is not feasible because the future commercial use is unknown in some cases and is subject to change in other cases. Therefore, net assessable acreage has been chosen as the spread method of choice. Future apportionments, if any, may be made utilizing the remaining assessable acreage of any future parcels within the apportioned area. In conclusion, it is my opinion that the assessments for the above-referenced Assessment District have been spread in direct accordance with the benefits that each parcel receives from the works of improvement. The improvements can generally be separated into four construction zones: Masi Drive (the new north/south internal street), Sebastian Way (the new east/west internal street), Rochester Avenue, and Foothill Boulevard. 1. Masi Drive. Masi Drive includes all phases of public street construction including paving and base, curb and gutter, sidewalk, commercial driveways, sidewalk drains, street lighting, street trees, landscaping, signage and striping, and public utilities. Masi Drive also contains water, sewer and storm drain facilities with appurtenances. Masi Drive has a centerline length of approximately 750 linear feet and is 44 feet in width from curb-to-curb in a 66- foot right-of-way, except where it gradually increases in width as it approaches Foothill Boulevard. A traffic signal will be constructed at the intersection of Foothill Boulevard and Masi Drive. 2. Sebastian Way. Sebastian Way includes all phases of public street construction including paving and base, curb and gutter, sidewalk, commercial driveways, sidewalk drains, street lighting, street trees, landscaping, signage and striping, and public utilities. Sebastian Way also contains water, sewer and storm drain facilities with appurtenances. Sebastian Way has a cen- terline length of approximately 1,010 linear feet and is 44 feet in width from curb-to-curb in a 66-foot right-of-way. 22 Resolution 97-014 Page 3. Foothill Boulevard. The Foothill Boulevard widening contains the same scope of street improvements as Masi Drive with the addition of a raised landscape median. Special historic and landscaping features such as the "Vintners Walk" and landscaping to address the Rancho Cucamonga guidelines for the Foothill Activity Zone are also part of the Foothill Boulevard improvements. These improvements extend from the centerline of Rochester Avenue west past the west property line of this project to include a pavement taper on both the north and south sides of Foothill Boulevard. Within Foothill Boulevard is a 10-inch diameter CML&W steel water pipe with appurtenances. 4. Rochester Avenue. The Rochester Avenue improvements include the repositioning of the traffic signal at the southwest corner of Foothill Boulevard and Rochester Avenue. Minor curb, pavement widening and landscaping was added to the relatively new improvements completed by the City, as well as a bus bay. The existing overhead electric and telephone lines have been undergrounded in Rochester Avenue. The work within Rochester Avenue extends from the centerline of Foothill Boulevard south to the south property line of this project. In addition to the storm drain and utilities built within the road right-of-way, a storm drain within a public easement was built running east-west through the upper half of the site between Masi Drive and Rochester Avenue. This storm drain provides relief from overflow in the event of failure of the storm drain improvements within the Foothill Boulevard Zone. This drain varies in diameter from 24-inch to 30-inch and is approximately 800 feet in length. Landscaping, irrigation improvements, and irrigation controls are part of the improvements. The limits of the landscaping along the internal streets, Masi Drive and Sebastian' Way, will be curb face to right-of-way.
