A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA, COUNTY OF SAN BERNARDINO,
STATE OF CALIFORNIA, FINDING THAT CERTAIN REAL
PROPERTY, MORE PARTICULARLY DESCRIBED HEREIN, IS
NOT REQUIRED BY TITLE TO BE FEE SIMPLE AND
AUTHORIZING THE CITY ENGINEER TO SIGN THE QUITCLAIM
DEED AND TO PRESENT SAME TO THE COUNTY RECORDER
TO BE FILED FOR RECORD
A. RECITALS
(i) The City of Rancho Cucamonga has a fee interest in that certain real property
generally located on the north side of the centerline of Summit Avenue, westerly of
Etiwanda Avenue, known otherwise as a part of the Summit Avenue right-of-way,
in the City of Rancho Cucamonga, County of San Bernardino, California, and
hereinafter referred to in this Resolution as "said property." A full and true complete
description of said property is set forth in that true and correct copy of the Quitclaim
Deed, shown and described in Exhibits 'A' and 'B', and by this reference set forth
herein.
(ii) California Government Code Section 37350 provides as follows:
"A City may purchase, lease, receive, hold, and enjoy real and personal
property, and control and dispose of it for the common benefit."
(iii) California Government Code Section 37351 provides in pertinent part, as
follows:
"The legislative body (City Council) may... dispose of, and convey such
property for the benefit of the City ..... "
(iv) The property was acquired by the City in Fee Simple, through Judgement and
Final Order of Condemnation, by the Superior Court of the State of California in and
for the County of San Bernardino.
(v) Said property is no longer needed by title to be Fee Simple.
(vi) An easement will be reserved for street and public utility purposes.
(vii) The Planning Commission of the City of Rancho Cucamonga heretofore made
the findings on February 12, 1997, that disposing of said property, herein
contemplated, while reserving an easement for street and public utility purposes,
would be in conformity with the General Plan of the City of Rancho Cucamonga.
(viii) All legal prerequisites to the adoption of this Resolution has occurred.

B. RESOLUTION
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does
hereby find, determine, and resolve as follows:
All the facts stated in the Recitals, Part A, of this Resolution hereby are
found to be true and correct.
This Council hereby finds that the quitclaiming of said property to the
persons described in said deed will benefit the City of Rancho
Cucamonga.
3. An Easement for Street and Public Utility Purposes will be reserved.
That the City Engineer is authorized to sign the Quitclaim Deed and to
present same to the County Recorder, to be filed for record, upon
adoption of this Resolution.
5. The City Clerk shall certify to the adoption of this Resolution.

LEGAL DESCRIPTION
Being a portion of the West one-half of Lot 15, Block "C" of Eftwanda Colony Land
Tract No. 1 in the City of Rancho Cucamonga, County of San Bernardino, State of
California, as per plat recorded in Book 2 of Maps, Page 24 Records of said County
described as follows:
Being a 33.00 foot strip of land conveyed to the City of Rancho Cucamonga by
Judgment and Final Order of Condemnation Recorded September 14, 1993, Instrument
No. 93-410861, Official Records.
Also the City of Rancho Cucamonga hereby reserves a 33.00 foot easement for street
and public utilities purposes over the subject property described above.
As shown on Exhibit "B" attached hereto and by this reference made a part hereof.
