ITEMS OF BUSINESS APPROVAL OF A RESOLUTION CERTIFYING SPECIAL MUNICIPAL ELECTION RESULTS RESOLUTION NO. 98-120 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, RECITING THE FACT OF THE SPECIAL MUNICIPAL ELECTION HELD IN SAID CITY OF RANCHO CUCAMONGA ON THE 2ND DAY OF JUNE, 1998, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW ADMINISTRATION OF OATH OF OFFICE - Oath of Office will be administered by the Honorable Judge Jeffrey King, San Bernardino County Superior Court. Oath to be administered to: Bob Dutton, Councilmember 3. PRESENTATION BY GWYN FROST C. COMMUNICATIONS FROM THE PUBLIC This is the time and place for the general public to address the City Council. State law prohibits the Council from addressing any issue not previously included on the agenda. The Council may receive testimony and set the matter for a subsequent meeting. Comments are to be limited to five minutes per individual. D. ADJOURNMENT I, Debra J. Adams, CMC, City Clerk APPROVAL OF RESOLUTION CERTIFYING MUNICIPAL ELECTION RESULTS It is recommended that the City Council approve the attached Resolution in order to certify the special municipal election results of June 2, 1998. A complete canvass of this election was accomplished by the San Bernardino County Registrar of Voters as required by state law. Their certified results are attached to the Resolution as "Exhibit A". If you have any questions, please feel free to contact the City Clerk's office. /dja Attachment (as noted) RESOLUTION NO. 98-120 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, RECITING THE FACT OF THE SPECIAL MUNICIPAL ELECTION HELD IN THE CITY OF RANCHO CUCAMONGA, ON JUNE 2, 1998, DECLARING THE RESULTS AND SUCH OTHER MATTERS AS PROVIDED BY THE PROVISIONS OF LAW WHEREAS, a special municipal election was held and conducted in the City of Rancho Cucamonga, California, on Tuesday, June 2, 1998, as required by law; and WHEREAS, notice of the election was duly and regularly given in the time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in the time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in cities; and WHEREAS, the Registrar of Voters of the County of San Bernardino canvassed the returns of the election and has certified the results to this City Council, the results are received, attached and made a part hereof as Exhibit "A". NOW, THEREFORE, the CITY COUNCIL of the CITY OF RANCHO CUCAMONGA, CALIFORNIA, does hereby resolve, declare, determine and order as follows: SECTION 1: That there were 57 voting precincts established for the purpose of holding said election consisting (of consolidations) of the regular election precincts in the City of Rancho Cucamonga as established for the holding of state and county elections. SECTION 2: That said special municipal election was held for the purpose of electing the following officers of said City as required by the laws relating to cities in the State of California, to wit: One member of the City Council of said City to fill a vacancy with the tern ending in November, 2000; SECTION 3: That the number of votes given at each precinct and the number of votes given in the City to each of such persons above named for the respective officers for which the persons were candidates, and the above stated ballot measure were listed in Exhibit "A" attached. Resolution No. 98-120 Page 2 SECTION 4: That the whole number of votes cast in said City was (Inf©rmation Comin~l from the Registrar of Voters Office). SECTION 5: That the name of the person voted for at said election for Member of the City Council of said City is as follows: Bob Dutton That the number of votes given at each precinct and the number of votes given in the City to such person above named for the respective officer of which said person was a candidate is as listed in Exhibit "A" attached. SECTION 6: The City Council does declare and determine that: Bob Dutton was elected as Member of the City Council of said City to fill a vacancy with the term ending November, 2000. SECTION 7: The City Clerk shall enter on the record of the City Council of the City, a statement of the result of the election, showing: (See Exhibit (1) The whole number of votes cast in the City; (2) The names of the persons voted for; (3) For what office each person was voted for; (4) The number of votes given in the City to each person; SECTION 8: That the City Clerk shall immediately make and deliver to each of such persons so elected a Certificate of Election signed by the City Clerk and duly authenticated; that an Oath of Office shall also be administered to each person elected as prescribed in the State Constitution of the State of California and shall have them subscribe to it and file it in the Office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. SECTION 9: That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions.
