Brad Buller, City Planner, called the Regular Meeting of the City of Rancho
Cucamonga City Planner to order at 2:00 p.m. The meeting was held in the
Planning Division Conference Room at Rancho Cucamonga Civic Center, 10500
Civic Center Drive, Rancho Cucamonga, California.

PUBLIC HEARINGS
CONDITIONAL USE PERMIT 94-17 - CAMEO FURNITURE MANUFACTURING - A request
to establish a furniture manufacturing business in a leased space of
27,400 square feet within an existing Industrial Park on 1.79 acres of
land in the General Industrial District (Subarea 8) of the Industrial Area
Specific Plan, located at 12067 Arrow Route - APN: 229-121-36.
Dan Coleman, Principal Planner, presented the staff report.
Brad Buller, City Planner, opened the public hearing.

He then asked the
Mr. Joe Black, owner of Cameo Furniture, stated he did not know about the sign
that did not comply with code. He said it would be taken care of once he
received the necessary sign information.
Mr. Buller asked if he had received a copy of the sign program for the
complex.
Mr. Black stated he had not received the information. He stated he had
contracted Republic Sign Company to take care of signs and he thought
everything had been done. He commented he has been unable to contact the
contractor to verify exactly what had been done.
Mr. Buller asked Mr. Black if he understood the conditions in the resolution
pertaining to Building and Safety and Fire Divisions' code requirements.
Mr. Black stated he had met with Ron Nee, Fire Prevention Analyst, and he was
given information and guidance regarding their requirements.

Mr. Buller asked for any comments from the public.
Ms. Pilar Perry, Watson Land Company, stated that she was there to assist
Watson's tenant, Mr. Black, with the process and requirements of the City.
She commented that she had spoken with Dan Coleman, Principal Planner, and was
informed of the options available regarding the sign. She stated she had been
given a copy of the Sign Program and wished to discuss Mr. Black's options.
Mr. Black stated that his company was over budget on this project, but
adjusting the sign should not be a problem.
Ms. Perry stated that removal of the sign might be an issue, but they did want
to explore what options are available.
Mr. Coleman stated he would meet with Mr. Black and Ms. Perry after the public
hearing and discuss the process and/or modify the Sign Program, if the
applicant desires.
Mr. Buller commented that the condition states a sign fee and application
shall be submitted within 30 days from this date. He asked that Mr. Black
either have the sign removed within 30 days or request an amendment to the
sign program.
Mr. Buller moved that the Resolution be adopted. He explained that this
decision is final unless appealed within 10 days. He also stated that any
changes or modifications to the use from that point on would require an
amendment. Mr. Buller said he was pleased with the site and that Cameo was an
asset to the industrial community and Rancho Cucamonga.
Mr. Buller closed the public hearing.

ANALYSIS:
ae
General: The applicants, Clifford and Patricia Johnson, are requesting a
Conditional Use Permit to operate a health spa business, with ancillary
full body massage services, within an existing multi-tenant industrial
complex of 4.92 acres. Business hours are 9 a.m. to 10 p.m., Monday
through Sunday. Under Industrial Area Specific Plan (ISP) provisions,
health spas are classified as recreational facilities which can be
authorized with the approval of a Conditional Use Permit.
This complex was approved by Design Review (DR 85-38), which included
21,625 square feet of support services space and 41,355 square feet of
multi-tenant industrial space. The request is to allow the health spa to
operate in two leased spaces within the support services buildings.
Compatibility: The premise of all Conditional Use Permit reviews is to
ensure the compatibility of adjacent uses and separation of potential
nuisance activities. The industrial center in which the proposal is
located was designed and approved for comercial support services in two
buildings facing Archibald Avenue. The activities which are proposed in
the health spa should not cause any conflict with the existing neighboring
uses. The parking provided in the center exceeds the demands/requirements
of the uses existing in the center. The center was approved with
216 spaces and the total required spaces, including this application, will
be 201 spaces. It is noted, however, that the spaces are very poorly
marked and should be repainted.
The Police Department noted the absence of other businesses in the
immediate area open in the evening "that would provide natural
surveillance (of patrons) of the center during evening hours." There is
no parking lot lighting at present, and only a small under soffit light
over the entry doors. Therefore, the Police recommend that the applicant
install lighting at the front and rear entrances to the business to
provide some security illumination during evening operating hours.

Ancillary Massage: Any business conducting massage, even ancillary to the
primary use, is subject to the regulations of Ordinance No. 485. The
business is required to submit a separate application for a massage
establishment permit and each massage technician must also apply for a
permit. Therefore, massage cannot be approved by this Conditional Use
Permit request and appropriate conditions have been included in the
attached Resolution. The applicant has filed an application for a massage
establishment which has been deemed incomplete.
RECOMMENDATION: Staff recommends that the City Planner approve Conditional
Use Permit 94-27 through the adoption of the attached Resolution of Approval.

We agree with Associate Planner Alan Warren that the applicants for the health spa
in the above CUP do in fact need to be more specific in the areas referred to as
"therapeutic massage" and "body toning." Given the description of the use of this facility given
in the CUP application, we feel the applicants fall into the guidelines required by
R.C. Ordinance NO. 485 (see attached). ALL pertinent Articles and Sections should be
complied with. Especially without the information required in Section 9.24.040
Detective Scaturro is unable to pursue this application further.
Further, on Tuesday, September 15, 1994, at approximately 10:30 a.m. Fatland and Scamrro
visited the site at 9135 Archibald Avenue, Suites B & C and share the following crime
prevention concern:
Other than the beauty shop directly north of the site, this business center is primarily
used during the day (Monterrey Mortgage to the south, and the deli also north of the
site). There are no other businesses that directly face the site that would provide
natural surveillance of the center during evening hours. Therefore, the business
and its patrons would be exposed to a high probability for robbery.
We will further pursue this application upon receipt of a response to these comments.

RESOLUTION NO.
A RESOLUTION OF THE CITY PLANNER OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, APPROVING CONDITIONAL
USE PERMIT NO. 94-27 FOR A HEALTH SPA LOCATED AT 9135
ARCHIBALD AVENUE, SUITES "B" & "C" IN SUBAREA 4 OF
THE INDUSTRIAL AREA SPECIFIC PLAN, AND MAKING
FINDINGS IN SUPPORT THEREOF - APN: 209-211-48.
A. Recitals.
1. Clifford and Patricia Johnson has filed an application for
the issuance of Conditional Use Permit No. 94-27, as described in the title of
this Resolution. Hereinafter in this Resolution, the subject Conditional Use
Permit request is referred to as "the application."
2. On the 11th day of October 1994, the City Planner of the City
of Rancho Cucamonga conducted a duly noticed public hearing on the application
and concluded said hearing on that date.
3. All legal prerequisites prior to the adoption of this
Resolution have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined, and resolved by
the City Planner of the City of Rancho Cucamonga as follows:
1. The City Planner hereby specifically finds that all of the
facts set forth in the Recitals, Part A, of this Resolution are true and
correct.
2. Based upon substantial evidence presented to the City Planner
during the above-referenced public hearing on October 11, 1994, including
written and oral staff reports, together with public testimony, the City
Planner hereby specifically finds as follows:
a. The application applies to property located at 9135
Archibald Avenue, Suites "B" & "C" with a street frontage of 310 feet and lot
depth of approximately 700 feet and is presently improved with a multi-tenant
industrial center with no parking lot lighting; and
b. The property to the north of the subject site is vacant,
the property to the south consists of a multi-tenant industrial center, the
property to the east is a single family residential neighborhood, and the
property to the west is a multi-tenant industrial center; and
c. The application contemplates the operation of a health
spa, including isokenitic body toning, sauna, massage, skin treatments,
tanning, manicure/pedicure, and foot reflexology. The proposed hours of
operation are 9:00 a.m. to 10:00 p.m., seven days a week; and

d. The massage services contemplated by the application are
subject to the regulations of Ordinance No. 485 (RCMC Chapter 9.24) which
requires a separate application and permit for a massage establishment.
Therefore, the requested ancillary massage cannot be considered with this
permit request; and
e. Evidence has been submitted from the Police Department
that inadequate lighting exists on the subject property which could expose
customers to crimes in the evening.
3. Based upon the substantial evidence presented to the City
Planner during the above-referenced public hearing and upon the specific
findings of facts set forth in paragraphs 1 and 2 above, the City Planner
hereby finds and concludes as follows:
a. That the proposed use is in accord with the General
Plan, the objectives of the Development Code, and the purposes of the district
in which the site is located.
b. That the proposed use, together with the conditions
applicable thereto, will not be detrimental to the public health, safety, or
welfare, or materially injurious to properties or improvements in the
vicinity.
c. That the proposed use complies with each of the
applicable provisions of the Development Code.
4. The City Planner hereby finds and determines that the project
identified above in this Resolution is exempt from the requirements of the
California Environmental Quality Act of 1970, as amended, and the Guidelines
promulgated thereunder, pursuant to Section 15061(b)(3) of the State CEQA
Guidelines.
5. Based upon the findings and conclusions set forth in
paragraphs 1, 2, 3, and 4 above, the City Planner hereby approves the
application subject to each and every condition set forth below:

Approval shall expire, unless extended by
the City Planner, if use has not commenced
within 24 months of this date.
2)
Approval of this request shall not waive
compliance with any sections of the
Industrial Area Specific Plan, State Fire
Marshal's regulations, Uniform Building
Code, or any other City Ordinances.
3)
If operation of the facility causes adverse
effects upon adjacent businesses or
operations, the Conditional Use Permit shall
be brought before the City Planner for

consideration and possible termination of
the use.
This approval is for a health spa business
only. Any change or intensification of use
shall require modification to this
application.
A complete set of improvement plans shall be
submitted to the Fire Division to include,
but not limited to, the following items:
interior finishes, existing and/or modified
fire sprinklers and/or alarms, existing
and/or locations and types of portable fire
extinguisher.
Prior to occupancy, plans shall be submitted
to the Building and Safety Division and the
Fire District for approval and inspection
shall be completed.
The health spa is limited to 3,168 square
feet of building area, and hours of
operation from 9 a.m. to 10 p.m., Monday
through Sunday.
Massage requires separate application for a
massage establishment permit. The
operators, employees, and any persons
providing massage services, shall comply
with all pertinent articles and sections of
Ordinance No. 485 (City Code Chapter
9.24). No massage service shall be
conducted without first obtaining a massage
establishment permit.
The total of employees working at the
premises at any one time is limited to five.
All parking spaces in the front (westerly)
parking area, on the north side of the
building, and immediately to its rear, shall
be repainted prior to occupancy.
The applicant shall install adequate
lighting to illuminate the parking areas,
and the front and rear entrances into the
business, prior to operation during evening
hours. The type, style and location of the
lighting fixtures shall be subject to City
Planner and Police Department review and
approval.

6. The Secretary to the Planning Division shall certify to the
adoption of this Resolution.
