Regular Meeting
January 12, 1993
Chairman Marsha Banks called the Regular Meeting of the City of Rancho
Cucamonga Historic Preservation Commission to order at 5:00 p.m. The meeting
was held in the Council Chamber at Rancho Cucamonga Civic Center, 10500 Civic
Center Drive, Rancho Cucamonga, California. Chairman Banks then led the
pledge of allegiance.

APPROVAL OF MINUTES
Motion: Moved by Billings seconded by Schmidt, carried 6-0-1, to approve the
December 8, 1992 minutes.
PUBLIC HEARINGS
A. LANDMARK DESIGNATION 93-01 AND MILLS ACT CONTRACT 93-01 - JAN SUTTON AND
DALE SUTTON - An application to designate the Emory Allen House, located
at 9441 Lomita Avenue, as a local Landmark. In addition, review of a
request to enter into a Mills Act Contract for the said property. APN:
202-082-13• This action will be forwarded to the City Council for final
action and the date of the Public Hearing before City Council will be
separately noticed.
Anthea Hartig, Associate Planner, presented the staff report.
Chairman Banks opened the public hearing.
Jan Sutton, co-owner of the Emory Allen house, stated she and her sister
looked specifically for a house that was at least 50 years old. She commented
that they could tell the house was a "swan" underneath its rough exterior and
that the former owners had not appreciated the house for what it may have
represented to the community. She expressed that they wish to bring the house

back as closely as possible to its original state. She asked the Commission
to forward any information about the history of the house along to her.
Commissioner Billings stated he had addresses of some of the Allen family and
he would pass along that information.
Commissioners Arner and Tessier expressed pleasure that the owners are seeking
landmark status for the property.
Commissioner Billings stated that this house was not the Allen's original
house. He commented that the Allens previously lived in a house around the
corner that belonged to the water company.
Chairman Banks closed the public hearing.
MOTION: Moved by Schmidt, seconded by Billings, carried 6-0-1 , to accept
staff's recommendation for a Landmark designation for LD 93-01 and forward
that recommendation to City Council for final approval.

Chairman Banks closed the public hearing. She commented on the excellent
restoration work the applicant's have done.
There was discussion on the location of the former local town of Grapeland.
It was thought that Grapeland covered areas in what we now call Fontana and
Lytle Creek.
Commissioner Tessier asked about the size of the applicant's lot.
Ms. Hartig stated it is a half acre lot.
Chairman Banks stated she felt that, should additional changes come up later
involving the Mills Act for this property, those changes should be deferred to
staff rather than coming before the Commission again.
The Commission concurred.
MOTION: Moved by Schmidt, seconded by Arner, carried 6-0-1, to accept staff's
recommendation for a Landmark designation for LD 93-03 and forward that
recommendation to City Council for final approval.

Anthea Hartig presented the staff report. She stated that since the staff
report was written some question has arisen regarding the 1928-29 construction
date. It seems that the building may actually have been constructed during
1946-47, which would mean that it is not subject to the Unreinforced Masonry

Building (URMB) Ordinance. She stated she had also discovered that th
building was built by Henry Klusman, who was a locally renowned contractor.
She commented that the staff report will require amending after further
research and suggested the item be continued until next month's meeting.
Chairman Banks stated she had spoken with Lawrence Mueller, who bought the
property in 1945, and he told her that the garage was not on the property at
that time. She stated that he told her that Mr. Klusman could not have built
the building prior to 1946 and that he was willing to sign an affidavit to
that effect. She also talked to Hap Harne, who married Tom Harne in
they lived in Virginia for two years before coming to California and
uying
the subject property and hiring Mr. Klusman to construct the gar

could not have been built prior to 1946.

public hearing to the regularly scheduled HPC meeting of February 9, 1993.

D. UPDATE ON PEARSON FILLING STATION AND GARAGE - ORAL REPORT
Anthea Hartig presented the staff report. She commented that staff has not
heard from the State Office of Historic Preservation regarding the potential
for national landmark status for the garage.
Chairman Banks asked about the status of the project with City Council.
Larry Henderson, Principal Planner, stated that the Council indicated at their
last meeting they did not wish to delay this matter any further.
Chairman Banks asked if the canopy could be moved and preserved and the
NABS/HAER drawings completed prior to declaring the garage landmark.
Ms. Hartig stated that is what her staff report to City Council recommends.

ANNOUNCEMENTS
Larry Henderson, Principal Planner, announced that the Ledig house is
proceeding slowly because of the rain but it is listed with an agent and they
have started advertising for its sale.
Mr. Henderson also mentioned that he had received information from the State
of Historic Preservation regarding the Intermodal Surface Transportation and
Efficiency Act 1991 (ISTEA) program. He listed some potential HPC projects
which could qualify for funding under this act:
1 . Purchase and rehabilitation of the Cucamonga Pioneer Winery Property as a
potential site for the City's Metrolink station.
2. Purchase or improvement of the Southern Pacific line right-of-way as a
bicycle trail through the City connecting to the Upland commuter rail
site.
3. Purchase or improvement of the Pearson Filling Station on Route 66 for
rehabilitation and/or moving the building.
4. Purchase and conservation of portions of Etiwanda and Alta Loma North
Sphere areas for habitat conservation as an enhancement to the Route 30
Freeway.
Mr. Henderson commented that ISTEA is looking for volunteers to serve on the
Statewide Transportation Enhancement Advisory Board and that Commission
members might want to consider serving on the board.
Chairman Banks suggested the possibility of moving structures along Route 30
and the placement of rock curbing in Etiwanda as potential projects.
Mr. Henderson stated these projects could be considered eligible.

BACKGI DUND
The Commission continued this item from their January 12, 1993 meeting in
light of new research completed by staff that suggested that the structure
was built in 1946 or 1947. The 1989 survey of unreinforced masonry
buildings indicated that this building had been constructed in 1929 and
thus it was thought to fall under the purview of the URMB Ordinance because
of this early construction date. The current owners, Jose and Nora Chao
had sought to pull a permit to demolish the structure in order to comply
with the time frame established in the URMB Ordinance.
ANALYSIS
Since the January meeting, staff has confirmed that indeed the Harne family
had the service station and garage constructed in 1947. We located
detailed information on the building's chronology from the local Assessor's
office and have forwarded this information to the City's Building and
Safety Department. Since amendments to the California Building Code in
1947 toughened considerably the reinforcement requirements for masonry
construction, and now we know that Henry Klusman constructed Harne's Garage
that same year, the structure no longer must comply to the provisions of
the City's URMB Ordinance. The Chaos are not longer under pressure to
either retrofit or demolish the building.
RSCOMNUER ,TION
Staff recommends that the Commission table further discussion of the
landmark application for Harne's Garage/Etiwanda Auto Repair until such
review is required or requested.

SUBJECT: WAIVER OF FEES - UNITED METHODIST CHURCH, 7690 ARCHIBALD AVENUE
REC"ENDATION
It is recommended that the Historical Preservation Commission review the
request of the applicant and make their recommendations to the City Council
concerning the waiver of fees.
BACKGROUND/ANALYSIS
In April 1990, City Ordinance No. 417, requiring the strengthening of
unreinforced masonry buildings went into effect, consistent with State of
California mandate to local jurisdictions to develope programs for elimination
of such hazardous structures.
Plans for strengthening the subject building have been submitted and are into
the plan review process. The deadline for issuance of permits for repair
including the maximum administrative time extension, is May 1, 1993.
The church has submitted the accompanying letter requesting the waiver of fees
for "engineering review, building permits and other fees that may be
applicable".
The only fees administered by the Building and Safety Division that would be
assessed by the city for the physical repair are the building permit and plan
; checking fees, which in this case would total something under $350.00. Since
there will be costs to the city for outside plan check consultation of
approximately $ 650.00 and additional indirect costs of providing inspections,
the Building and Safety Division cannot recommend waiver of the permit and
plan review fees. The "engineering review" fees are presumably those
referenced in Ordinance No. 417, relating to Community Development Block Grant
funding for design consultation.
Staff has reviewed the church's potential for receiving CDBG monies to
accomplish compliance with the URMB Ordinance and has concluded that the
church is not eligible for CDBG funds per Federal guidelines, nor are most of
the incentives outlined in the ordinance applicable in this case.

CONCLUSION
Because there will be direct and indirect costs to the city associated with
plan checking and inspection, waiver of the plan review and permit fees is
not, in our view, justifiable. Federal CDBG funds may not be used for church
purposes.

Dear Mr. Grant:
We are sending you this letter at the suggestion of Mr. Carlos Silva, Sr.,your Rehabilitation
Specialist who we have been working with since being served with City ordinance #417
which requires us to seismically upgrade our 84 year old historic stone sanctuary building.
At the planning commission pre-adoption hearings in early 1990 which we attended, it was
mentioned that some assistance might be available to non-profit organizations to help with
the financial impact created by this ordinance. These included various items including low
interest loans, grant, and possible waiver of City fees for plan checking and permits.
Unfortunately most loans and all grants that might be available are apparently linked to
federal funds which we are told preclude any use for purposes that might be construed to
be religious, in spite of the historical significance of our facility.
After considerable time and effort to locate testing labs and professionals with knowledge
and experience with unusual stone versus uniform masonry construction far more common
Today, and with numerous conversations between Mr. Silva and our structural engineer, Mr.
Don Woods of Woods Engineering in Rancho Cucamonga, we are apparently ready to
submit plans for the seismic retrofit of this unique structure in the very near future. Hence
at this time, we wish to ask if the City of Rancho Cucamonga would consider waiving or
reducing its fees for our engineering review, building permits, and other fees that may be
applicable.

As with many others in these difficult economical times, our Church is in serious financial
difficulty. We are currently attempting to renegotiate the terms of loans for our recently
constructed facilities to avoid imminent foreclosure. We intend to work very closely with
Mr. Silva to identify those aspects of our facility upgrade that would provide the provide the
most significant improvements and undertake those first We anticipate that we will only
have volunteer help and very limited financial resources for purchasing materials to
undertake this City mandate. Any assistance that you or the City can provide will be greatly
