A RESOI//fION OF %~E CITY OOUNCIL OF THE CITY OF RANCHO
CUCAMDNGA, CATIFORNIAOPPOSINGTHEMOBILEH~4E INITIATIVE
WHEREAS, there exists within the City and the surroundir~ areas a
serious shortage of mobile home rental spaces, which has resulted in low
vacancy rates a3~ potential for rising space rents; and
WHEREAS, because of the high cost of moving mobile homes, the
potential for damage resulting therefrom, the requirements relating to tb~
installation of mobile homes, including permits, landscaping and site
preparation, the lack of alternative hc~e sites for mobile hc~e residenoes and
the substantial investment of mobile hc~e owners in such homes, there exists a
shortage of mobile home park spaces; and
WHEREAS, it is necessary to potect the residents of mobile homes from
unreason_a_ble space rent increases, while at the same time recognizing the r~
for mobile hc~ne park owners to receive a just and reasonable income sufficient
to cover the costs of repairs, maintenance, insurance, employee services,
additional amenities and other operations, as well as a just and reasonable
return on investment; and
WHEREAS, it is co~m¥only known that, after initial installation,
virtually all mobile homes are never thereafter moved and when a resident
decides to move, the mobile home is conm~nly sold in place and if rents are
below free-market levels, the possibility exists that a portion of the mobile
hc~e space value might be transferred upon such sale unless rents are allowed
to rise upon such sale to levels which are closer to or at free-market levels;
WHEREAS, decisions of a rent stabilization board or similar decision-
making body may not necessarily fulfill the intent of protecting mobile home
residents from unreasonable space rent increases, nor do such decisions always
provide an owner with the opportunity for a just and reasonable income
sufficient to operate a mobile home park, and to gain a fair and reaso_r~_ble
return on investment; and
WHEREAS, concerns among residents and owners of mobile home parks
over rent increases and other park-related situations can often best be
resolved between the two parties, provided there exists the incentive for both
parties to negotiate in good faith and reach agreement; and
WHEREAS, it is the intent of the City of Rancho Cucamonga's accord to
protect mobile home park residents from unre~__.~oDable space rent adjustments
and mobile hc~e tk3rk owners from infringement upon property rights; and
WHEREAS, this mobile home initiative may invalidate existing mobile
home rent control laws and limit existing local mobilehome rent control laws.

NOW, THEREFORE, the City Council of the City of Rancho Cucamonga
hereby resolves that this body opposes the "Rental Assistance" initiative
currently in circulation, and directs that such opposition be cuu~u%icated to
the Legislature and the Governor and those advocacy organizations to which we
belong o
