WHEREAS, it has been reo,,..~led that an Underground Utility
District, hereinafter called District, be foxmined; and
WHEREAS, Rancho Cucamonga Municipal COde Sectic~ 13.04 establishes a
p~x~dure for the creation of Underground Utility Districts and requires as
the initial step in such prooedure the holding of a public hearin~ to
ascertain whether public neoessity, health, safety, or w~lfare requires the
removal of overhead wires and associated overhead structures and the
underground installation of wires and facilities for supplying electric,
communication or similar associated service in any such district.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Rancho Cucamonga, California as follc~s:
S~'TION 1: That an Undergrour~ Utility District be formed in the
following described area:
~nose portions of Map of Rochester tract, Map Book 9 Page 20, as
recorded in the office of the San Bernal~i~o County Recorder,
California, lying within a strip of land 240 feet wide, the
centerline of said strip being the centerline of Rocb~ Avenue
(Orange Avenue) as shown on said Map.
S~"rION 2: NOTICE IS HEREBY GIV~q that a public hearing will be held
by the City Council of the City of Rancho Cucamonga on January 19, 1994, at
the hour of 7:00 p.m. in the City Council Chambers at 10500 Civic Center
Drive, Rancho Cucamonga, California, to ascertain whether the public
necessity, health, safety or welfare requires the removal of overhead wires
and associated overhead structures and the underground installation of wires
and facilities for supplying electric, c~m~utication or similar associated
service in the District herein described.
S~/CION 3: At such hearing, all persons interested shall be given an
opportunity to be heard. Said hearing my be continued fr~n time to time as
may be determined by City Council.
S~CTION 4: ~ne city Clerk shall notify all affected pr~ owners
as shown on the last equalized assessment roll and utilities cc~oerned, of the
time and place of such hearing and by mailing a copy of this Resolutic~ to
such property owners and utilities concerned at least ten (10) days prior to
the date thereof.
S~CTION 5: The areaproposedtobe included in theDistrict is shown
upon that certain map entitled "Underground Utility District No. 3", which is
on file in the office of the City Clerk of the City of Rancho O,camonga,
California.
