R~citals (i) Western Properties ba~_~ filed an application for the approval of Development R~vie~ No. 93-13 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Develo~ Review request is referred to as "the application." (ii) On the August 11, August 25, October 13, October 27, 1993, the Planning C~,ut~ssionofthe City ofRanchoCucamonga ~dulyr~tioed publichearings on the application and following theconclusionof saidpublic h~arings, adopted ResolutionNo. 93-89 thereby denying said application. (iii) The decision represented by said Planning C~t~ssion Resolution was timely appealed to t_his Council. (iv) On December 1, 1993 and January 5, 1994, the City Council of the City of Rancho Cucamonga conducted public hearings on the application and concluded said hearing on January 5, 1994. (v) All legal prerequisites prior to the adoption of this Resolutionhave occurred. B. Resolution NOW, THEREFORE, it is hereby found, determined, and resolved by the City Council of the City of Rancho Cucamonga as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon ~3___hstantial evidence presented during the above referenced December 1, 1993 and January 5, 1994 hearings, including written and oral staff reports, the minutes of the above-referenced Planning Cc~i.~sion meetings, and the contents of Planning C~,mdssion Resolution No. 93-89, this Council hereby specifically finds as follc~s: Resolution No. 93-230 Page 2 a. The application applies to property identified as Pads X and is located at the nexTbeast corner of Foothill Boulevard and Haven Avenue is m ntly with lan oape h dscape; b. The property to the north and east of the subject site is developed with a shopping oenter, the property to the south is dev~1o~ with an office park, and the property to the west is developed with a mixed-use c. Buildings X is part of the Terra Vista Town Center and w-as approved as a two-story office kuild/ng; and d. The applicant requested to change the apuroved elevations for Buildings X frc~ a two-story to a single-story design and from office to e. The proposed elevations of Building X, as shown in the revised elevations, are cc~s~ with the architectural standards established in the Terra Vista Town Center. 3. Based upon the substantial evidence presented to this Council during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Council hereby finds and concludes as follows: a. That the proposed project is consistent with the objectives of the General Plan; and b. That the proposed use is in accord with the objectives of the Development Code and the purposes of t_he district in which the site is c. That the architecture of Building X is consistent with the architectural standards established in the Terra Vista Town Center through Conditional Use Permit 88-12. 4. The City Oouncil of the City of P~ncho Cucamonga bmreby approves the application with the following conditions: 1) Approval of Building~ X shall expire, unless extended by the Planning O~,,dssion, if use bar ~ot -~-'~e~oed within 24 months frc~ the date of approval. Resolution No. 93-230 2) The proposed plaster trim with scored lines around the arches at the north and south elevati~s of Build/n~ X shall be changed to precast concrete mterial. 3) Precast concrete trim shall be added to all archway elements of Building X. 5. This Council hereby -f~ovides notice to Rick Mager of Western Properties that the time within which judicial review of the decision of California Code of Civil Procedure Section 1094.6. 6. The City Clerk of the City of Rancho (k%ca~longa is hereby d~rect_~d__ to: (a) certify to tbm adoption of this Resolution, and (b) forthwith transmit a certified copy of t_his Resolution, by certified mail, return-receipt requested, to Rick Mager of Western Properties at the address identified in City records. 7. The City Clerk shall certify to the adoption of this Resolution.
