W~EREAS, it is the intentic~ of the City of Rancho O~,.~,~a to oor~truct
certain 'n~zwe~nte in the City of Panoho
WHEREAS, the City of Rancho (~r~3a has prepared plans and
specifications for the constructic~ of certain i~m~ements.
NOW, THEREFORE, BE IT RESOLVED that the plans ar~ specifications
presented by the City of Rancho O~'.,nnga be eund are hereby a~ as the
plans and specifications for the Rochester Avenue and Banyan St., Street
Improvement Projects in said City.
BE IT ~ RESOLVSD that the City Clerk is hereby authorized and
directed to advertise as re~i~ed by law for the receipt of sealed bids or
proposals for doing the work specified in the afc~esaid plar~ and
specifications, which said advertisement shall be substantially in the
following words and figures, to wit:
Pursuant to a Resolution of the fkxmcil of tb~ City of Rancho O~a~x)nga,
San Berr~rdino County, California, directing this notice, NC~ICE IS E~BY
GIV~ that the said City of Rancho O~monga will receive at the Office of the
City Clerk in the offices of the City of Rancho (klcamonga, on or before the
hour of 2:00 o'clock P.M. on the 2nd day of December 1993, sealed bids or
proposals for tb~ Rochester Avenue and Banyan St., Street Imp~ in said
city.
Bids will be opened and publicly read immediately in the office of the
City Clerk, 10500 Civic OenterDrive, Rancho Cucamonga, California 91730.
Bids must be rode on a form provided for the purpoee, addressed to the
City of Rancho Cucamonga, California, marked, "Bid for Oonstruction of
Rochester Avenue and Banyan Street Street Imp~m~m~nts.
PREVA~ING ~GE: Notice is hereby given that in aocordance with the
provisions of California Labor ODde, Division 2, Part 7, (]~.~cer 1, Articles 1
and 2, the Contractor is re~red to pay not less than the general prevailing
rate of per diem wages for work of a similar character in the locality in
which the public work is performed, and not less than the general prevailing
rate of per diem wages for b~liday and overtime work. In that re~ard, the
Director of the Department of Industrial P~lations of the State of California
is required to and ba~ dete~ir~d such general prevailing rates of per diem
wages. Copies of such prevailing rates of per diem wages are on file in the
office of the City Clerk of the City of Rancho Cucamonga, 10500 Civic Center

irfoerested party on request. The ~cting A~3ency also shall cause a copy

The (X~tra~ shall forfeit, as penalty to the City of Rancho ~nga,
twenty-five dollars ($25.00) for each ~, workman, or mechanic employed
for each calendar day or portion thereof, if such laborer, w~rkn~an, or
mechanic is paid less than the general prevailing rate of wages hereinbefore
stipulated for any work done under the attached contract, by him or by any
suborn'actor under h/m, in violatic~ of the provisions of said Labor COde.
In accordance with the provisions of Section 1777.5 of the Labor Code as
amex~ed by (~apter 971, Statutes of 1939, and in accordanoe with the
regulations of the California Apprenticeship Council, properly indentured
apprentices may be employed in the prosecution of the work.
Attention is directed to the provisions in Sections 1777.5 and 1777.6 of
the T~hor Code co~cernin~ the employment of apprentices by the Contractor or
Section 1777.5, as amended, requi~ the COntractor or ~nt~actor
employing ~n in any ~ceable occupation to apply to the joint
app~iceship cum~[ttee nearest the site of the public works project and
which administers the apprenticeship ~3I~u in that trade for a certificate
of approval. The certificate will also fix the ratio of apprentices to
journeymen that will be used in the perfcxmanoe of the cc~tract. The ratio of
apprentices to journeymen in such cases shall not be less than one to five

from the Divisio~ of Appre~i~ ~ and its '~anch offJoes.
Eight (8) hours of labor shall oc~m~:itute a ~ day's wurk for all
workmen e~ployed in the executi~ of this co~f~ract ar~ the Cc~tract~ and any
subcc~tractor under him shall c~ply with and be governed b~ the laws of the
Stats of Califcxnia having to do with ~ hours as set forth in Divisic~
2, Part 7, (b~.r~.r 1, Article 3 of the Labor COde of the Stats of California
The Contractor shall forfeit, as a penalty to the City of Rancho
O,camonga, twenty-five dollars ($25.00) for each laborer, workman, or mealmanic
employed in the execution of the co~tract, by him or any sub.~,~dctor under
him, upon any of the work hereinbefore mentioned, for each cal~ day during
which said laborer, workman, or mechanic is required or permi~ to labor
more than eight (8) hours in violation of said Labor Code.
Contractor agrees to pay travel and subsi~ pay to each workman
P~ed to execute the work required by this contract as such travel and
subsistence payments are defined in the applicable oollective bargaining
agreements filed in aocordance with Labor Code Section 1773.8.
The bidder must subnit with his pxuposal cash, cashier's check, certified
check, or bidder's bond, payable to the City of Rancho O~nnc/a for an amount
equal to at least ten percent (10%) of the amount of said bid as a guarantee
that the bidder will enter into the proposed contract if the same is awarded
to him, and in event of failure to enter into such oontract said cm.~h,
camhier's check, certified check, or bond shall becrm~. the property of the
city of Rancho Cucamonga.
If the City of Rancho O~amonga awards the oontract to the next lowest
bidder, the amount of the lowest bidder's security shall be applied by the
City of Rancho Cucamonga to the difference between the low bid and the second
lowest bid, and the surplus, if any, shall be returned to the lowest bidder.
The amount of the bond to be given to secure a faithful perf~ of
the cc~tract for said work shall be one hundred percent (100%) of the co~tract
price thereof, and an additional bond in an amount equal to fifty percent
(100%) of the contract price for said work shall be given to secure the
payment of claims for any roterials or supplies furm~ for the performanoe
of the work contracted to be done by the Contractor, or any work or labor of
any kind done thereon, and the Contractor will also be required to furnish a
certificate that he carries cc~pensa~ion insurance covering his employees upon
work to be done under contract which my be entered into between him and the

said City of Rancho Cucamonga for the construction of said work.
No proposal will be cc~sidered frum a Contractor whum a ~posal form has
not been issued by the City of Pancho
Co~cra~ shall possess a Class "A" License (General Engineering
(kxfcractor) in acco~-danoe with the provisions of the (k~tractx~'s License Law
(Calif~-~,~a Business and Professions Code, Section 7000 et. seq.) and rules
ar~ re~/latic~ __~___~Yced pursuant thereto at the time this co~tract is awarded.
The w~rk is to be do~e in acook--dance with the profiles, plans, and
specifications of the City of Rancho Cucamonga on file in the Office of the
City Clerk at 10500 Civic C~nter Drive, Rancho Cucamonga, California. Copies
of the plans and specifications, available at the office of the City Engineer,
will be furnished upon application to the City of Rancho Cuc~3a and payment
of $35.00, said $35.00 is noirefusible.
Upon written request by the bidder, copies of the plans and
specifications will be railed when said request is acornSshied by payment
stipulated above, together with an additional nc~re~le payment of
$15.00 to oover the cost of mailing charges and
The successful bidder will be required to enter into a contract
satisfactory to the City of Rancho O~,~gd.
In accordance with the re~H~ments of Section 9-3.2 of the General
Provisions, as set forth in the Plans and Specifications rega~ the work
cc~fc~-T~d to be done by the Contractor, the Oontractu~ my, upon the
(Ixfcracto~,s request and at the Cc~tracto='s sole cost and expense, subetitute
authorized securities in lieu of monies withheld (performance retention).
~he City of Rancho Cu~, California, reserves the right to reject
any and all bids.
