WH~RFAS, it is the /ntention of the City of Rancho O~mor~3a to cor~-truct
certain improvements in the City of Ranoho O~amcx~/a.
WHfREAS, the City of Rancho O~amcF~3a has prepared plans and
specifications for the constructic~ of certain i~x~vements.
NOW, TH~{EFORE, BE IT RESOLVED that the plans and specifications
presented by the City of Rancho Cucamonga be and are hereby apuroved as the
plans and specifications for '~Vinmar Avenue Street Improvements, located from
Ninth Street to Chaffee Street Alley."
BE IT ~ RESOLVED that the City Clerk is hereby authorized and
directed to advertise as required by law for the receipt of sealed bids or
proposals for doing the work specified in the aforesaid plans and
specifications, which said advertisement shall be substantially in the
following words and figures, to wit:

Urban DeveloF~n~t (24 CFR, Part 57) and subject to certain recruitments
including payment of Federal prevailing wages, compliance with "Section 3"
Affirmative Action ~equirements, Executive Order #11246 and others.

the bid documents. Additional information pertaining to the Federal
requirements is on file with the City of Rancho Cucamonga's C~,,,unity
Development Department.
Pursuant to a Resolution of the Council of the City of Ranchin O~Amonga,
San Bernardino County, California, directing this notioe, NOTICE IS HERfBY
GIV~ that the said City of Rancho O]camonga will reoeive at the Office of the
City Clerk in the offices of the City of Rand%o Cucamonga, on or before the
hour of 2:00 o'clock P.M. on the 9th day of December 1993, sealed bids or
proposals for the '~;~ Avenue Street Improvements, located frc~ Ninth
Street to Chaffee Street Alley" in said City.
A prebid meeting is scheduled for 2:00 P.M. ~3ESDAY, ~~ 30, 1993, at
10500 Civic Center Drive, Engineering Division, Rains Ro~m. This meeting is
to inform DBEs of subcontracting and material supply opportunities. Bidder's
atter~ance at this meeting is a prerequisite for demonstrating reasor~ble
effort to obtain DBE participation.
Bids will be opened and publicly read immediately in the office of the
City Clerk, 10500 Civic Center Drive, Rancho Cucamonga, California 91730.

Bids must be made on a form-pi-ovided for the purpose, addressed to the
City of Rancho Ow~a,,,z~a, California, marked, "Bid for C0~struction of Vinmar
Aver~__~ Street ~, located from Ninth Street to Chaffee Street
Alley."
~ ~AGE RATE: Notice is hereby given that this project is funded
with U.S. De~ of Housing and Urban Development funds and that the rate
of wage for each craft or type of workman or mechanic employed under this
cc~tract shall be not less than as specified under the U.S. D~ of

The Cuntfair shall forfeit, as penalty to the City of Rancho Cucamonga,
not more than fifty dollars ($50.00) for each laborer, workman, or m~d~ic
employed for each calendar day or portion thereof, if such laborer, workman,
or mechanic is paid less than the general prevailing rate of wages
hereinbefore stipulated for any work done under the attached contract, by him
or by any subcontractor under him, in violation of the provisions of said

Information relative to apprenticeship standards, wage schedules, and
other requirements may be obtained frc~ the Director of Industrial ~lations,
ex-officio the Administrator of Apprentioeship, San Francisco, California, .or
frc~ the Division of Apprenticeship Standards and its bz~anch offioes.
Eight (8) hours of labor shall constitute a legal day's work for all
workmen employed in the execution of t_his contract and the Co~tractor and any
subcontractor under him shall comply with and be governed by the laws of the
State of California having to do with working hours as set forth in Division
2, Part 7, Chapter 1, Article 3 of the Labor Code of the State of California
The Contractor shall forfeit, as a penalty to the City of Rancho
Cucamo~ga, twenty-five dollars ($25.00) for each laborer, workman, or mechanic
him, upon any of the work hereinbefore mentioned, for each calendar day during
which said 1~, workman, or mechanic is required or permitted to labor
more than eight (8) hours in violation of said Tabor Code.
Contractor agrees to pay travel and subsistence pay to each w~rkman
needed to execute the work required by this contract as such travel and
subsi~ payments are defined in the applicable collective barga'mdr~
agreements filed in accord__a_nce with Labc~ Code Section 1773.8.
The bidder must subnit with his proposal cash, cashier's check, certified
check, or bidder's bond, payable to the City of Rancho Cucamonga for an amount
equal to at least ten percent (10%) of tb~ amount of said bid as a guarantee
that the bidder will enter into the prc~ contract if the same is awarded
to him, and in event of failure to enter into such cc~tract said cash,
ca~.~hier's check, oertified check, or bond shall b~com~ the pr~ of the
City of Rancho Cucamonga.

If the City of Rancho O~k~,,;~Wu awards the contract to the next lowest
bidder, the amount of the lowest bidder's security shall be applied by the
City of Rancho O~amonga to the difference bet%~ the l~w bid and the second
lowest bid, and the surplus, if any, shall be returned to the lowest bidder.
BONDS: The amount of the bond to be given to secure a faithful
perf~m~nce of the cc~tract for said work shall be c~e hundred percent (100%)
of the oontract prioe thereof, and an additional bond in an amount equal to
fifty perue~,t (100%) of the cc~tract price for said work shall be given to
secure the payment of claims for any materials or supplies furnished for the
perf~ of the wv~-k oontra~ to be done by the Cc~tract~, or any work
furnish a certificate that he carries ccm~pensation insurance covering his
employees upon work to be d~e under contract which may be entered into
~ him and the said City of Rancho O~m~mqa for the oomstruction of said
wo~k.
~ ACTION: The City of Rancho Cucamonga hereby notifies all
bidders that it will affirmatively ensure that in any contract entered into
pursuant to this advertisement, minority business enterprise will be afforded
full o~ tunity to subnit bids in response to this invitation and will not be
discriminated against on the grounds of race, color, sex, or national origin,
in oo~ideration for the award.
No proposal will be oonsidered from a Oontractor whc~ a p~oposal form has
not been issued by the City of Rancho Cucamonga.
Contractor shall possess any and all contractors licenses, in form and
class as required by any and all applicable laws with the respect to any and
all of the ~ to be p~eformed under this contract; including, but not
limited to a Class "A" License (General ~x~ineering Contractor) in accordance
with the provisions of the Oontractor's License Law (California Business and
Professions Code, Section 7000 et. seq.) and rules and regulations adopted
pursuant thereto at the time this contract is awarded.
The C~ntra~, pursuant to the "California Buisness Professica~s Code",
Section 7028.15, shall indicate his or her State License Number on the bid,
under penalty of perjury, that the information being p~ovi__~gd___ is true and
~he ~=rk is to be done in acc~rdanoe with the profiles, pla~, and
specificatioms of the City of Rancho O~-~ on file in the Office of the
City Clerk at 10500 Civic (kmYoer Drive, Rancho Cucamonga, California. Orepies
of the plans and specifications, available at the office of the City Engineer,
will be furnished upc~ application to the City of Rancho Owoa,.,,~3~ and payment
of $35.00, said $35.00 is n0~refundmble.

Upon writtan request by the bidder, copies of the plans and
specifications will be mailed when said request is aco~ed by payment
stipulated above, together with an additional noble payment of
$15.00 to cover the oost of mailin~ charges and overhead.

satisfactory to the City of Rancho
In aocordance with the requ{re~ents of Section 9-3.2 of the General
Provisions, as set forth in the Plans and Specifications regard/n~ the %~=rk
Cc~cractc~,s request and at the Cc~fcractor,s sole ooet and expense, substitute
authcu~ized securities in lieu of monies withheld (performanoe retention).
The City of Rancho O,c~monga, Califoxnia, reserves the right to reject
any and all bids.
