A RESOLUTION OF THE CITY COUNCIL OF R/{E CITY OF RAN~O
CU~GA, CALIFORNIA, APPROVING A PdDQUES~ FOR AD3USTMEN~
TO CONDITIONS OF APPRDVAL FOR TfIgTATIVE PARCEL MAP 13808
AND C.U.P. 90-42 IN THE VICIORIA PLANNED ~,
IDCAT~) SOUTH OF ~LL BOULEVARD AND WEST OF DAY CRk~K
BOULSVARD - APN 229-021-10, 15, 19 AND 28
A. Recitals
(i) Hughes Investments has filed an application for Tentative
Parcel Map 13808 and C.U.P. 90-42 as described in the title of this
Resolution. Hereinafter in the Resolution, the subject Tentative Parcel Map
and C.U.P. request is referredto as the "Application."
(ii) On July 10, 1991, the Planning C~m~ssion of the City of Rancho
Cucamonga conducted a duly noticed public hearing on the Application and,
following the conclusion of said public hearing, adopted Resolutions No.
91-108 and 91-109 thereby conditionally approving said Application.
(iii) Hughes Investments has submitted a request for adjustment to
said conditions as authorized by said conditions.
(iv) Said request is for adjustment to the following conditions:
Provide necessary right-of-way and construct
Foothill Boulevard full width from Rochester Avenue
to Route 15. Sidewalk and parkway landscaping
shall be constructed along the south side of the
street from the centerline of Day Creek Channel to
the centerline of the Southern California Edison
Corridor on the east side of Day Creek Boulevard
and may be deferred for the remaining portion of
the street until development of the adjacent
property. The limits of the off-site improvements
may be reduced if approved by the City Council.
(v) The adjustment being proposed is as follows:
Provide necessary right-of-way and construct Foothill Boulevard as follows:
a)
Full improvements, including sidewalk and parkway landscaping,
on the south side from the centerline of Day Creek Channel
easterly to Day Creek Boulevard (including curb return at the
southeast corner of the intersection).
b)
c)
Street paving, curb and gutter on the south side from Day Creek
Boulevard easterly to Route 15.
Sidewalk and parkway landscaping on the south side from Day
Creek Boulevard easterly to the centerline of the Southern
California Edison Corridor.

d)
A landscaped median from the centerline of Day Creek Channel
easterly to Route 15.
e)
Thirty-two feet of pavement on the north side of the median
from Day Creek Channel easterly to Route 15.
(vi) On March 17, 1993, the City Council of the City of Rancho
Cucamonga conducted a duly noticed hearing on the Application and request and
concluded said hearing on that date.
(vii) All legal prerequisites prior to the adoption of this
Resolution have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined, and resolved by the
City Council of the City of Rancho Cucamonga as follows:
1. This Council hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Council
during the above-referenced March 17, 1993, hearing, including written staff
report, and the contents of Planning Co~ut,~ssion Resolutions No. 91-108 and 91-
109, this Council hereby specifically finds as follows:
(a) The Application applies to property located at the
southwest corner of Foothill Boulevard and Day Creek Boulevard. The parcel is
presently vacant; and
(b) Approval of said request for adjustment to said condition
is consistent with the goals and objectives of the City for development along
Foothill Boulevard.
3. Based upon the substantial evidence presented to this Council
during the above-referenced hearing including written staff report, this
Council hereby finds and concludes as follows:
(a) That the request to adjust said conditions under
Engineering Division Planning Co~l-~ssion Resolutions No. 91-108 and 91-109 be
approved and modified as follows:
Provide necessary right-of-way and construct Foothill Boulevard as
follows:
a)
Full improvements, including sidewalk and parkway landscaping,
on the south side from the centerline of Day Creek Channel
easterly to Day Creek Boulevard.
b)
Street paving, curb and gutter on the south side from Day Creek
Boulevard easterly to Route 15.

c)
Sidewalk and parkway landscaping on the south side frc~ Day
Creek Boulevard easterly to the centerline of the Southern
California Edison Corridor.
d)
A landscaped median fr~m the centerline of Day Creek Channel
easterly to RDute 15.

Thirty-two feet of pavement on the north side of the median
from Day Creek Channel easterly to Route 15.
4. The City Clerk of the City of Rancho Cucamonga, is hereby
directed to: (a) certify to the adoption of this Resolution, and (b)
forthwith transmit a certified copy of this Resolution, by certified mail,
return receipt requested, to Hughes Investments at the address identified in
City records.

Proposed Developments shall construct street improvements as follows:
A. Streets adjacent to or required of projects shall be constructed full
width to include curb on both sides of the street.
Streets shall be extended (full width) off-site to an existing public
street(s) in order to provide two separate mean of access.
The Developer shall be eligible for reimbursement of the cost of off-site
improvements from future Development of the adjacent property upon its
development.
Projects within the Areas shown on the map below (left) shall construct
the specific street segments designated below (right):

As a follow up to our meeting last mk, we are requesting a
reduction in the offsits h~&ov.- -nts required by the above
Cond/tional UIO Per~Lt and Tentative P~rcel Nap as approved by the
Planning Commission on July 10, 1991. ! have provided a copt of
the conditiOnl which relatel to the lmp&~v,- -nil on Foothill
Boulevard that states 'The ll~Lts of the offsite ~oY~ -nil may
be reduced as approved by the City Council'.
Now that Cc~u~Lty Pacil£ties Dlsf~lct 91-1 is on hold
lndefin/tely, we are requesting redevelol~ent assistance to
construct the offsites which were conditions of approval for
Tentative Parcel M&p 13808. As such, before we make a formal
proposal to theL,:.~l.i].Oplmnt agencF, we needto specif~the limits
of construc~ion ns well as the associated costs.
I have enclosed for ~mur lnfor~tion and review a copt of a blue
line drawing prepared by Charchol/Har~m-n and Associates which
depicts the ll~Lts of construction on Foothill Boulevard per Jack
Charchoi,s discussions with Shintu Bose. It is our undgrstanding
that the scope of h~)~'OvC lnts we are requesting would he
consistent with other proJectl approved mfter Victoria Courtyard
such as the Nasi project, Foothill Marketplace, ~he hoteX project
at Rochemterand Foothill and therecently approved SmtthaPoodking
project.

possible to the public works subcommittee to get a reading as to
their thoughts prior to proceeding to the City Council. As you
know, we are on a very tight time line and are ~7ing to keep
Kmart, Home Depot, Circuit City and Carl's tied together so the
project will happen. Should you have any questions regarding the
enclesedplease let meknow, I would appreciate if youwould let me
know after you have had a chance to talk to the public works
subcommittee as to their thoughts. I would also like to know if
public notice is requiredprior to being heard by the CityCouncil.
