A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, DETERMINING THE
COST OF SERVICE TO BE FINANCED BY BENEFIT
ASSESSMENTS TO BE LEVIED IN DRAINAGE AREA NO. 91-2
FOR FISCAL YEAR 2004-2005 AND DETERMINING AND
IMPOSING SUCH BENEFIT ASSESSMENTS
WHEREAS, the City Council of the City of Rancho Cucamonga, California,
previously undertook proceedings to authorize the levy and imposition of benefit assessments to
pay for the annual drainage maintenance, including the removal of sediment and debris from the
Day Canyon Channel improvements and basin, pursuant to the terms and provisions of the
"Benefit Assessment Act of 1982", being Chapter 6.4, Division 2, Title 5 of the Government
Code of the State of California (commencing with Section 54703), said area of benefit being
known and designated as DRAINAGE AREA NO. 91-2 (the "Drainage Area"); and
WHEREAS, at this time there has been presented to this City Council a
Supplemental Report (the "Supplemental Report") to the Final Engineer's Report Drainage Area
No. 91-2 City of Rancho Cucamonga setting forth a description of the proposed service, cost
estimate and assessment schedule for fiscal year 2004-2005 (the "Final Engineer's Report");
and
WHEREAS, at this time this City Council desires to determine the cost of
providing authorized services to be financed by the levy of a benefit assessment for fiscal year
2004-2005 and to determine and impose such benefit assessment.
NOW THEREFORE, the City Council of the City of Rancho Cucamonga does
hereby resolve as follows:
SECTION 1: That the above recitals are all true and correct.
SECTION 2: That the Supplemental Report is hereby approved and ordered to
be kept on file in the Office of the City Clerk as a permanent
record and to remain open for public inspection. Said
Supplemental Report generally consists of the following:
A. A description of the service proposed to be financed through
revenue derived through the levy and collection of the benefit
assessment;
B. A description of each lot or parcel of property proposed to be
subject to the benefit assessment;
C. The amount of the proposed assessment for each parcel.

SECTION 3: That the rate and method of apportionment of the benefit
assessment as set forth in the Final Engineer's Report is hereby
adopted and has been utilized as the rate and method of
apportionment of the benefit assessment to be levied in fiscal
year 2004-2005.
SECTION 4: That this City Council hereby determines and orders that the
benefit assessments described in the Supplemental Report
within the Drainage Area are hereby confirmed and levied for
fiscal year 2004-2005.
SECTION 5: That the above confirmed and levied benefit assessment for
fiscal year 2004-2005 shall be collected at the same time and in
the same manner as general County property taxes are collected
and all laws providing for the collection and enforcement of such
County taxes shall be applicable to the collection and
enforcement of these benefit assessments.
