A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCh40
CUCAMONGA ORDERING THE WORK IN CONNECTION THE FORMATION OF
STREET LIGHTING MAINTENA/~CE DISTRICT NO. 6 AND ACCEPTING
THE FIE ENGINEER' S REPORT FOR CUP 84-37 (PM 8901) AND DR
85-37 (PM 9409)
WHEREAS, the City Council of the City of Rancho Cucamonga did on the
17th day of June, 1987, adopt its Resolution of Intention No. 87-314 to order
the therein described work in connection with the formation of Street Lighting
Maintenance District No. 6, which Resolution of Intention No. 87-314 was duly
and legally published in the time, form and manner as required by law, shown by
the Affidavit of Publication of said Resolution of Intention on file in the
office of the City Clerk; and
WHEREAS, the City Council of the City of Rancho Cucamonga did on June
7, 1987, adopt Resolution No. 87-314 declaring its intention to order the
formation of an Assessement District to be known as "Street Lighting
Maintenance District No. 6" and to levy and collect assessments pursuant to the
Landscaping and Lighting Act of 1972; and
WHEREAS, after the adoption thereof, a notice of public hearins was
duly mailed to all persons owning real property proposed to be assessed for the
improvements described in said Resolution of Intention No. 87-314, accordins
to the names and addresses of such owners as the same appears on the last
mailing or as known to the City Clerk of the City of Rancho CucamonSa, which
said copies were duly mailed in the time, form, and manner as required by law,
as appears from the Affidavit of Mailing on file in the office of the City
Clerk] and
WHEREAS, said City Council havins duly received considered evidence,
oral and documentary, concernins the j urisdictian facts in this proceedins and
concernins the necessity for the contemplated work and the benefits to be
derived therefrom and said City Council hayins now acquired jurisdiction to
order the proposed work.
SECTION 1: It is hereby resolved by the City Council of the City of
Rancho Cucemonga that 'the public interest and convenience requires the
formation of the District and the ordering of the work, and said City Council
hereby orders that the work, as set forth and described in said Resolution of
Intention No. 87-314, be done and made; and
SECTION 2: The Report filed by the Engineer is hereby finally
approved; and

SECTION 3: The assessments and method of assessment in the Engineer's
Report are hereby approved.
SECTION 4: The City Clerk of the City of Rancho Cucamonga is hereby
authorized and directed to file the diagram and assessment contained in the
Engineer's Report, or a certified copy thereof, with the County.

ENGINEER 'S REPORT
STREET LIGHTING RAINTENANCE DISTRICT NO. 6
(COMHERCIAL AND INDUSTRIAL AREAS)
SECTION 1. AUTHORITY FOR REPORT
This report is prepared in compliance with the requirements of Article 4,
Chapter 1, Division 15, of the Street and Highways Code, of California
(Landscape and Lighting Act of 1972).
SECTION 2. GENERAL DESCRIPTION
This report deals with the establts~mnent of a Street Lighting Maintenance
District for the Conmnercial and/or Industrial properties within the City
mainly within the Industrial and Foothill Specific Plan areas. Areas to
be included in the work program are the street lights within the
rights-of-way or designated easements of streets dedicated to the City
and are limited to local streets. The work program excludes maintenance
of street lights in rights-of-way of major streets, which will be
included in the Lighting District No. i for major streets.
SECTION 3. SCOPE OF WORK
The specific areas to be maintained by the District as defined in the
preceding section, will become part of the active work program at such
time as the specific areas are annexed into the District. The normal
process will be the dedication of the areas to the City, construction of
the street lighting system, and, upon demonstration of satisfactory
operation, the acceptance by the District no later than the following
July. The Developer will make a sufficient deposit with the Southern
California Edison Company to provide for up to twelve (12) months of
ordinary and usual maintenance, operation and servicing costs of the
street lights in each development at the time of initial operation of the
lighting system. Upon establishment of assessment effective July 1 of
each year, any remaining deposit shall be refunded to the developer.

The estimated cost (at current dollars) for the District upon
completion of all areas within the entire Comnercial and Industrial
areas.

and size may vary.
** All night energy service per lamp per month including maintenance
costs. All the costs are based on Southern California Edison Company
monthly rates including maintenance. All costs and areas are based
on current estimates and may or may not be valid for future years.
The total cost and unit cost vary as the monthly rate varies and as
additional areas for maintenance are annexed to the District. The
monthly rate is established by the Southern California Edison Company
and is not currently controlled by the size of an area of any
operation of the developer. The size of the areas being annexed to
the District only' has an influence on the total cost. The costs
shown are estimates only, and the actual assessment will be based on
actual cost data.

Work to be provided for, with the assessments establ i shed by the
District, consists of installation, maintenance, operation and servicing
of street lights. Annual Engineer's Reports will be prepared and
approved by the City Council defining the specific work program for each
year and its estimated cost. The plans and specifications for. all street
lighting will be prepared by the City or by the developers for the
subdivision improvements and will be approved by the City Engineering
Division.
Detailed maintenance activities on the Street Lighting Maintenance
District include: the furnishing of services and materials for the
ordinary and usual maintenance, operation and servicing of any street
1 i ght improvement and the repai r, removal, or replacement of al 1 or any
part of any improvement, providing for the ill~nination of the subject
area.
SECTION 4. ESTIITED COSTS
As development proceeds within the and Industrial/Commercial Areas, the
area to be maintained by the District will increase and so will the cost;
however, the nmber of commercial and industrial developments will also
increase. It is anticipated that the nmber of conmercial and/or
industrial developments will increase at approximately the same rate as
the maintenance area will increase, thereby keeping the maintenance cost
per acre relatively constant, excluding cost of living increases. Based
on historical data adjusted for inflation, it is estimated that the
quantity of street lights and the maintenance and energy costs for
assessment purposes will be as follows:
A. District at the time of formation

formed comprising the 5.5 acres area of CUP 84-37 (PM 8gO1} and DR
85-37 ( PN 9409)

SECTION 5. ASSESSRENT DIAGRAM
A Copy of the proposed Assessment Diagram for the developments that will
comprise the Maintenance Dtstrict originally is attached to this report
and labeled "Street LIghting Maintenance District No 6". This diagram is
hereby incorporated within the text of this report. The District will
originally comprise CUP 84-37 (PM 8901) and DR 85-37 (PM 9409).
Additional commercial or industrial projects will be annexed into the
District upon individual project approval and/or recordation.
SECTION 6. ASSESSRENTS
Maintenance costs for the entire District are found to be of specific
benefit to all developed commercial and/or industrial property within the
District in accordance with the following relationship:

conmnercial and/or .industrial areas will initially be required for the

Thus, estimated annual assessments of $61.03 per acre of commercial
and/or industrial area is projected to be required at the time of
project completion.
Estimated assessments are for compari son only. Actual assessments wi 11
be set by public hearing each year in June and will be based on actual
energy and maintenance expenses and developed land use s~nmaries.
SECTION 7. ORDER OF EVENTS
1. City Council approves institution of District proceedings.
2. City Council adopts resolution of Preliminary Approval of City
Engineer ' s Report.
3. City Council adopts Resolution of intention to form a District
and sets a public hearing date.
4. City Council conducts public hearing, considers all testimony
and determines to form a District or abandon proceedings.
5. Every year in Hay, the City Engineer files a report with City
Council.
6. Every year In June, the City Council conducts a public hearing
