A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCliO
CUCAMONGA, CALIFORNIA, ORDERING THE WORK IN CONNECTION
WITH ANNEXATION NO. 7 TO LANDSCAPE MAINTENANCE DISTRICT
NO. 4 AND ACCEPTING THE FINAL ENGINEER' S REPORT FOR TRACT
NO. 12671-1, 12671-2, 12671-3 and 12671-4
WHEREAS, the City Council of the City of Rancho Cucamonga did on the
19th day of August, 1987, adopt its Resolution of Intention No. 87-454 to order
the therein described work in connection with Annexation No. 7 to Landscape
Maintenance District No. 4, which Resolution of Intention No. 87-454 was duly
and legally published in the time, form and manner as required by law, shown by
the Affidavit of Publication of said Resolution of Intention on file in the
office of the City Clerkl and
WHEREAS, after the adoption thereof, notice of the passage of said
Resolution of Intention, headed "Notice of Improvement", was duly and legally
posted in the time, form, manner, location, and number as required by la~, as
appears from the Affidavit of Posting said notices, on file in the office of
the City Clerk= and
WHEREAS, after the adoption thereof, notices of the adoption of the
Resolution of Intention were duly mailed to all persons owning real property
proposed to be assessed for the improvements described in said Resolution of
Intention No. 87-454, according to the names and addresses of such owners as
the same appears on the last mailing or as known to the City Clerk of the City
of Rancho Cucamonga, which said copies were duly mailed in the time, form, and
manner as required by law, as appears from the Affidavit of Mailing on file in
the office of the City Clerk~ and
WHEREAS, said City Council having duly received considered evidence,
oral and documentary, concerning the j urisdiction facts in this proceeding and
concerning the necessity for the contemplated work and the benefits to be
derived therefrom and said City Council having now acquired jurisdiction to
order the proposed work.
SECTION 1: It is hereby resolved by the City Council of the City of
Rancho Cucamonga that the public interest and convenience requires the
annexation to the District and the ordering of the work, and said City Council
hereby orders that the work, as set forth and described in said Resolution of
Intention No. 87-454, be done and made; and
SECTION 2: Be it further resolved that the report filed by the
mngineer is hereby finally approved; and

SECTION 3: Be it further resolved that the assessments and method of
assessment in the Engineer's Report are hereby approved.
SECTION 4: Be it finally resolved that said assessments shell not
begin until after 60 percent of said tracts have been occupied.

Engineer's Report for
ANNEXATION NO. 7
to
LANDSCAPE MAINTENANCE DISTRICT NO. 4
Terra Vista Planned Conmnunity
Tracts 12671-1, -2, -3, -4, and street right-of-way
SECTION 1. Authority for Report
This report is prepared in compliance with the requirements of Article 4,
Chapter 1, Division 15 of the Streets and Highways Code, State of California
(Landscaping and Lighting Act of 1982).
SECTION 2. General Description
Landscape Maintenance District No. 4 (the "District") maintains street
planrings, parks, trails, and similar areas throughout the Terra Vista Planned
Conmnunity. All residential developments in Tetra Vista are to be annexed to
the District pursuant to Ordinance No. 190; areas to be maintained which lie
outside residential developments are also to be annexed for maintenance
purposes. This Annexation No. 7 annexes to the District the following area:
o Tracts Nos. 12671-1, 12671-2, 12671-3, 12671-4
o Milliken Avenue Parkway (west half) from Mountain View Drive to
northern boundary of Tract 12671
o Mountain View Drive (north half) from Milliken Avenue to easter.
boundary of P.M. 8842
All landscaped areas to be maintained in the annexed tracts are shot on
the tract maps (or by separate instrument) as roadway right-of-way, dr ,ca-
tions, or easements to be granted to the City of Rancho Cucamonga.
SECTION 3. Plans and Specifications
The plans and specifications for the landscaping within re",dential
tracts have been prepared by the developer and have been approved as part of
the improvement plans for those tracts. The plans and specifications are in
conformance with the Planning Conmnission conditions of approval. Plans and
specifications for landscaped areas outside residential tracts have been
separately prepared by the developer.
Reference is hereby made to the subject tract maps and the assessment
diagrams for the exact location of the landscaped areas. The plans and
specifications by reference are hereby made a part of this report to the same
extent as if said plans and specifications were attached hereto.

SECTION 4. Estimated Costs
No costs will be incurred for construction. All improvements will be
constructed by developers. Based on historical data, contract analysis, and
developed work standards, it is estimated that maintenance costs for assess-
ment purposes will be as set forth below. These costs are estimated only;
actual assessments will be based on actual cost data.
The estimated annual maintenance cost for Annexation No. 7 is as follows:

Assessment shall apply to each residential dwelling as enumerated in
Section 6.
SECTION S. Annexation Diagram
A copy of the proposed annexation diagram is attached to this report. By
this reference the diagram is hereby incorporated within the text of this
report.
SECTION 6. Assessment
Maintenance costs for the entire District are found to be of specific
benefit to all developed residential property within the District in accor-
dance with the following relationship:
Land Use Assessment Units

Multifamily residential dwelling .S unit
The City Council holds a public hearing in dune to determine the actual
assessments based upon the actual costs incurred by the City during the prior
fiscal year.
SECTION 7. Order of Events
1. City Council adopts Resolution of Preliminary Approval of City Engineer's
Report.
2. City Council adopts Resolution of Intention to Annex to District and sets
public hearing dates.
3. City Council conducts public hearing, considers all testimony and deter-
mines to annex to the District or abandon the proceedings.
4. Every year in May, the City Engineer files a report with the City
Council.
S. Every year in dune, the City Council conducts a public hearing and
approves, or modifies and approves the individual assessments.
