HomeMy WebLinkAbout87-498 - Resolutions RESOLUTION NO. 87-498 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCliO CUCAMONGA, CALIFORNIA, APPROVING AN APPLICATION FOR DEVELOPMENT REVIEW NO. 87-20, FOR DEVELOPMENT OF THREE (3) MULTI-T~ANT AND ONE WAREHOUSE BUILDING TOTALING 66,374 SQUARE FEET IN THE GENERAL INDUSTRIAL DISTRICT, 'SUBAREA 5, ON 3.8 ACRES OF LAND LOCATED AT THE NORTHEAST CORNER OF TURNER AVENUE AND 6TH STREET. RANCliO CUCAMONGA. AND MAKING FINDINGS AND SUPPORT THEREOF A. RECITALS. (i) Mark C. Boen and John Willerr filed an application for Development Review No. 87-20, described above in the title of this Resolution. Hereinafter in this Resolution. the subject Development Review request is referred to as the "application". (ii) On July 8, 1987, the Planning Commission of the City of Rancho Cucamonga adopted its Resolution No. 87-118 thereby approving the application subj act to all Conditions and Standard Conditions contained in said Resolution. (iii) The decision represented by said Planning Commission Resolution No. 87-118 was tlmely appealed to this Council by the applicants referenced in subparagraph (i) above. Said applicants specifically appealed the imposition a condition of Resolution No. 87-118 described as follows: The requirement for undergrounding of existing utilities (Condition No. 1.a. - Engineering Division). (iv) On September 2, 1987 this Council conducted a hearing with respect to the appeal of the conditions of Resolution No. 87-118 and concluded said hearing on that date. (v) All legal prerequisites to the adoption of this Resolution have occurred. B. RESOLUTION NOW, THEREFORE, it is found, determined and resolved by the City Council of the City of Rancho Cucamonga as follows: 1. This Council hereby specifically finds that all of the facts set forth is the Recitals, Part A, of this Resolution are true end correct. Resolution No. 87-498 Page 2 2. This Council hereby finds and certifies that the project has been reviewed and considered in compliance with the Environmental Quality Act of 1970 and concurs with that Negative Declaration issued with respect to the project on July 8, 1987. 3. Based upon substantial evidence presented to this Council during the above-reference September 2, 1987, hearing, including written staff reports, the minutes of the above referenced Planning Commission meeting and the contents of Planning Commission Resolution No. 87-118 this Council specifically finds as follows: a. The application applies to property within the General Industrial District (Subarea 5) and is located at the northeast corner of Turner Avenue and 6th Street. 5. All properties adjacent to the site are located within the General Industrial District. All properties adjacent to the site are vacant except for the property to the east which is developed as an Industrial Park= c. The project contemplates the construction of three (3) multi- tenant and one warehouse building totaling 66,374 square feet on 3.8 acres of land. Such a use as contemplated conforms to the General Plan of the City of Rancho Cucamonga and is a permitted use within the General Industrial District of the Industrial Specific Plan; d. The application has been submitted pursuant to the requirements of Chapter 17.06 of the Development Code to allow design review of the proposed use so as to minimize any adverse impact on the visual or aesthetic environment surrounding the subject site and to insure a harmonious appearance of the proposed use in conformity with all applicable local design guidelines, standards and ordinances; e. The appeal to eliminate the condition of Resolution No. 87-118 requiring the undergrounding of existing overhead utilities along 6th Street (Condition No. 1.a. - Engineering Division) was denied because the requirement is consistent with current Planning Commission policy as contained in the Planning Commission Resolution No. 87-96. The undergrounding of existing overhead utilities contributes to the improved esthetics of the area, and the removal of the requirement would have granted a special privilege to this project. 4. Based on the substantial evidence presented to the Council during the above-referenced September 2, 1987 hearing and upon the specific finding of facts set forth in paragraphs 1.2 and 3 above, this Council hereby finds and concludes as follows: a. The proposed use is consistent with the objectives of the General Plan of the City of Rancho Cucamonga; Resolution No. 87-498 Page 3 b. The proposed use is in accord with the obj ectlves of the Development Code of the City of Rancho Cucamonga and the purposes of the Industrial Specific Plan and the district in which the site is located; and c. The proposed use, ~ogether with the Conditions applicable thereto, will not be detrimental to the public health, safety or welfare and will not be materially injurious to properties and improvements in the vicinity. 5. Based upon the findings and conclusions set forth in paragraphs 1. 2, 3 and 4 above, this Council hereby approves the application subject to all Conditions and Standard Conditions as set for forth in Plannin8 Commission Resolution No, 87-118 (a full, true and correct copy is attached hereto, marked as Exhibit "A". 6. This Council hereby provides notice to Mark C. Boen and John Willerr that the time within which j udlcial review of the decision represented by this Resolution must be sought is governed by the provisions of California Code of Civil Procedure Section 1094.6. 7. The City Clerk is hereby directed to: (a) certify to the adoption of this Resolution and (b) forthwith transmit a certified copy of this Resolution, by Certified Mail, Return Receipt Requested, to Mark C. Boen and John Willerr at their respective addresses as per City records. PASSED, APPROVED, and ADOPTED this 16th day of September, 1987.
