A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCliO
CU CAMONGA, CALIFORNIA, STATING INTENT TO ACQUIRE REAL
PROPERTY FOR THE AREA VII STORM DRAIN BY EMINENT DOMAIN
PROCEEDINGS SETTING THE PUBLIC HEARING FOR SEPTEMBER 16,
1987
WHEREAS, the City of Rancho Cucamonga desires to construct the area VII
storm drain serving drainage area VII of the master plan of storm drains, such
area noted as being bounded by Foothill Avenue at the north the Atchison and
Topeka and Santa Fe railroad on the south, Ramona Avenue on the west and
Turner Avenue on the west.
WHEREAS, the storm drain construction will require the crossing of
three private parcels identified as Assessor' s Parcels Nos. 209-085-16,
209-085-17 and 209-085-12.
WHEREAS, attempts by the City to acquire easements by purchase offer
have been rejected by the owners of this noted parcels.
NOW, THEREFORE, BE IT RESOLVED by the virtue of the power vested in
the City Council of the City of Rancho Cucamonga, California, that:
1. Easements across the before mentioned parcels shall
be acquired by an action of eminent domain.
2. A public hearing shall be set for the regular City
Council meeting of September 16, 1987, to hear all
comments or protests to the proposed action of
Eminent Domain.
3. Owners of the affected parcels shall be notified in
writing and by public posting of the intended action
and protest hearing.
PASSED, APPROVED, and ADOPTED this 19th day of August, 1987.
