HomeMy WebLinkAbout87-439 - Resolutions RESOLUTION NO. 87-439 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANC~O CUCAMONGA, CALIFORNIA, OF PRELIMINARY APPROVAL OF CITY ENGINEER' S REPORT FOR ANNEXATION NO. 29 TO STREET LIGHTING MAINTENANCE DISTRICT NO. 1 WHEREAS, on August 19, 1987 the City Council of the City of Rancho Cucamonga directed the City Engineer to make and file with the City Clerk of said City a report in writing as required by the Landscaping and Lighting Act of 1972] and WHEREAS, the City Engineer has made and filed with the City Clerk of said City a report in writing as called for pursuant to said Act, which report has been presented to this Council for consideration~ and WHEREAS, said City Council has duly considered said report and each and every part thereof, and finds that each and every part of said report is sufficient, and that said report, nor any part thereof, requires or should be modified in any respect. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rancho Cucamonga as follows: SECTION 1: That the Engineer'e Estimate of the itenized costs and expenses of said work and of the incidental expenses in connection therewith. contained in said report be, and each of then are hereby, prel iminarily approved and confirmed. SECTION 2: That the diagram showing the Assessment District referred to and described in said report, the boundaries of the subdivisions of land within said Assessment District are hereby preliminarily approved and confirmed. SECTION 3: That the proposed assessment upon the subdivisions of land in said Assessment District in proportion to the estimated benefit to be received by said subdivision, respectively, from said work and of the incidental expenses thereof, as contained in said report is hereby prelimlnarily approved and confirmed. SECTION 4: That said report shall stand as the City Engineer'e Report for the purposes of all subsequent proceedings, and pursuant to the proposed district. SECTION 2. ~neral Description This Ctt~y Council has e]ectad t~ annex the tracts enumerated in Exhibit "A' tnt~ Street Lighting Natnt~nance District No. 1. The City Council has determined that the street ]tghts t~ be maintained will have an effect upon all lots wtthtn said tracts as ~e]l as on t~ 1 ors dtrect]y abutting the street ]tghts. Work ~ be provided for with the assessments established by the district are: The furnishing of services and materials for the ordinary and usual ~tnt~nance, operating and servicing of street ]tght i~rovements on arteria] and cerl~in co]]ec~r streets. I~rovement maintenance is considered of genera] benefit to a]] areas in the District and cost shall be divided on a per lot basis. In the case of con~tntums with atrspace ownership on]y, and apar~nts, a ~]ling unit shall be considered ~ benefit the same as a lot. SECTION 3. Plans and Specifications The plans and specifications for street ]tghttng have been prepared by the developers7 The plans and street lights are as sttpu]a~d tn the conditions of approval for the deve]ol~aent and as approved by the City Engineering Division. Reference ts hereby ~de b3 the subject tract map or deve]o~ent plan and the assessment diagram for the exact location of the street lighttrig areas. The plans and specifications for street lighting t~rovement on the individual deve]o;xeent ts hereby made a part of this report to the same extent as if said plans and specifics were attached hereto. Oetailed netntenance activities on the street lighting district include: the repair, removal or replaceeent of all or any part of any improvement, providing for the illumination of the subject area, Resolution No. 87-439 Page 4 SECTION 4. Estimated Costs No costs wi 11 be incurred for street 1 ighti ng improvement construction. All improvements will be constructed by developers. Based on available data, it is estimated that maintenance costs for assessment purposes will be as indicated below. These costs are estimated only, actual assessments will be based on actual cost data. The estimated total cost for Lighting Maintenance District No. 1 including Annexation rio. 29 is shown below: 1. SECTION 5. Assessment Diagram Copies of the proposed Assessment Diagrams are attached to this report and labeled "Street Lighting Maintenance District No. 1", Annexation No. 29. These diagrams are hereby incorporated within the text of this report. Resolution No. 87-439 Page 5 SECTION 6. Assessment Improvements for the District are found to be of general benefit to all dwelling units within the Otstrtct and that assessment shall be equal for each unit. Where there is more than one dwelling unit per lot or parcel of assessable land, the assessment for each lot or parcel shall be proportional to the number of dwelling units per lot or parcel. It ts proposed that all future development shall be annexed to the District. SECTION 7. Order of Events 1. City Counctl adopts Resolution of Preliminary Approval of City En3tneer's Report. 2. City Council adopts Resolution of Intention to annex a District and sets public hearing date. 3. City Council conducts public hearing, considers all testimony and determines to form a District or abandon the proceedings. 4. Every year in May, the City Engineer files a report with the City Council. 5. Every year in June, the City Council conducts a public hearing and approves, or modifies and approves the individual assessments.
