Home My WebLink About87-652 - Resolutions RESOLUTION NO. 87-652 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, OF PRELIMINARY APPROVAL OF CITY ENGINEER' S REPORT FOR ANNEXATION NO. 34 TO STREET LIGHTING MAINTENANCE DISTRICT NO. 1 WHEREAS, on December 2. 1987, the City Council of the City of Rancho Cucemonga directed the City Engineer to make and file with the City Clerk of said City a report in writing as required by the Landscaping and Lighting Act of 1972; and WHEREAS, the City Engineer has made and filed with the City Clerk of said City a report in writing as called for pursuant to said Act, which report has been presented to this Council for consideration; and WHEREAS, said City Council has duly considered said report and each and every part thereof, and finds that each and every part of said report is sufficient, and that said report, nor any part thereof, requires or should be modified in any respect. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rancho Cucamonga as follows: SECTION 1: That the Engineer's Estimate of the itemized costs and expenses of said work and of the incidental expenses in connection therewith, contained in said report be, and each of them are hereby, preliminarily approved and confirmed. SECTION 2: That the diagram showing the Assessment District referred to and described in said report, the boundaries of the subdivisions of land within said Assessment District are hereby preliminarily approved and confirmed. SECTION 3: That the proposed assessment upon the subdivisions of land in said ~sesement District in proportion to the estimated benefit to be received by said subdivision, respectively, from said work and of the incidental expenses thereof, as contained in said report is hereby preliminarily approved and confirmed. SECTION 4: That said report shall stand as the City Engineer's Report for the purposes of all subsequent proceedings, and pursuant to the proposed district. SECTION 2. General DescrIption Thts Ctty Counctl has electad to annex a11 new develol~ents Into Street Lighttrig Natntenance Dtstrtct No. 1. The Ctty Counctl has determined that the street lights to be maintained w]l] have an effect upon all lots wtthtn said develol~nents as well as on the lots dlrectly abutttng the street ]fghts. Work to be provtded for wtth the assessments established by the district are: The furnishing of servtces and materials for the ordtnary and usual maintenance, operating and servicing of street light Improvements on major streets (arterial and certain collector streets) as shown on the Lighttrig Dtstrfct Altas Nap whtch ts on flle wtth the CIty Engineer. Zmprovement maintenance ts considered of general benefit to all areas tn the Dtstrfct and cost shall be assessed on a per untt basts. SECTION 3. Plans and Specifications The plans and specifications for street 11ghttng have been prepared by the developers. The plans and street lights are as stipulated fn the conditions of approval for the development and as approved by the Ctty Engineering DIvision. Reference ts hereby made to the subject tract map or development plan and the assessment diagram for the exact location of the street lfghttng areas. The plans and specifications for street lighting Improvement on the Individual development Is hereby made a part of this report to the same extent as tf satd plans and specifics were attached hereto. Detailed maintenance activities on the street lighting dtstrlct Include: the repair, removal or replacement of a11 or any part of any Improvement, providing for the t11um]natlon of the subject area. Based on available data, ~t ~s estimated that maintenance costs for assessment purposes w~11 be as tnd(cated below. These costs are est(mated only, actual assessments w~11 be based on actual cost data. Street L~ghtfng Iqalntenance Dtstrtct No. 1 has been demarcated tnto two zones. Zone 1 ~s comprised of street l~ght ~provements on major streets for residential fmprovements (s~ngle famtly, multi-family, condomtnlums and apartments) throughout the CIty. Each dwelling unit tn thfs zone w~11 be assessed as one assessment unit for the operation of the Dfstr~ct. Zone 2 fs comprfsed of all fndustr~al, co~nerc~al and ~nst~tut~onal projects throughout the C~ty. Zt has been determined that one acre of land In fndustrtal, commercial and fnstttut~onal areas derives the same benefit as two assessment units in Zone 1. When unfts are based on acreage, assessment Ntll be 2 untts per net acre. SECTION 7. Order of Events 1. CIty Councfl adopts Resolution of Preltmfnary Approval of Cfty Engfneer's Report. 2. Ctty Counct1 adopts Resolutfon of Intention to annex a Dtstrfct and sets publtc heartng date. 3. Cfty Council conducts publlc heartng, consfders a11 testfmeny and determines to fore a Dfstrtct or abandon the proceedfngs. 4. Every year fn Hay, the Ctty Engineer ffles a report ~tth the Ctty Counctl. 5. Every year tn June, the Ctty Counctl conducts a publtc heartrig and approves, or modtftes and approves the Individual assesseents.
