A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCliO
~JCAMONGA, CALIFORNIA, OF PRELIMINARY APFROVAL OF CITY
ENGINEER' S REPORT FOR ANNEXATION NO. 10 TO LANDSCAPE
MAINTENANCE DISTRICT NO. 3
WHEREAS. on November 18, 1987, the City Council of the City of Rancho
Cucamonga directed the City Engineer to make and file with the City Clerk of
said City a report in writing as required by the Landscaping and Lighting Act
of 197 2: and
WHEREAS, the City Engineer has made and filed with the City Clerk of
said City a report in writing as called for pursuant to said Act, which report
has been presented to this Council for considerationZ and
W}~REAS, said City Council has duly considered said report and each
and every part thereof, and finds that each and every part of said report is
sufficient, and that said report, nor any part thereof, requires or should be
modified in any respect.
NO~, THEREFORE BE IT RESOLVED by the City Council of the City of
Rancho Cucamonga as follows:
SECTION 1: That the Engineer's Estimate of the itemized costs and
expenses of said work and of the incidental expenses in connection therewith,
contained in said report be, and each of them are hereby. preliminarily
approved and confirmed.
SECTION 2: That the diagram showing the Assessment District referred
to and described in said report, the boundaries of the subdivisions of land
within said Assessment District are hereby preliminarily approved and
confirmed.
SECTION 3: That the proposed assessment upon the subdivisions of land
in said Assessment District in proportion to the estimated benefit to be
received by said subdivision, respectively, from said work and of the
incidental expenses thereof, as contained in said report is hereby
preliminarily approved and confirmed.
SECTION 4: That said report shall stand as the City Engineer's Report
for the purposes of all subsequent proceedings. and pursuant to the proposed
district.

SECTION 1. Authortt~ for Report
This report is in compliance with the requirements of Arttcle 4, Chapter
1, Division 15 of the Streets and Highways Code, State of California
(Landscaping and Lighting Act of 1972).
SECTION 2. General Description
This City Council has elected to annex all new developments into Landscape
Natntenance District No. 3. The City Council has determined the areas to be
maintained will have an effect upon all the developments as mentioned above.
All landscaped areas to be maintained tn the annexed developments are shown on
the recorded Nap as roadway right-of-way or easements to be granted to the
City of Rancho Cucamonga.
SECTION 3. Plans and Specifications
The plans and landscaping are as stipulated in the conditions of approval
for the development and as approved by the City Engineering Division.
Reference is hereby made to the subject development plan and the assessment
diagram for the exact location of the landscaped areas. The plans and
specifications for landscaped improvement on the individual development ts
hereby made a part of this report to the same extent as tf said plans and
specifications vere attached hereto.
SECTION 4. Estimated Costs
No costs wt11 be incurred by the District for parkway and medtan
improvement construction. All teproveeents wtll be constructed by developers
and or/by the City. Based on historical data, contract analysts and developed
~ork standards, it ts estteated that maintenance costs for assesseent purposes
wtll equal thirty ($.30) cents per square foot per year. These costs are
estimated only, actual assesseent wtll be based on actual cost data.
Landscape Natntenance District No. 3 has been demarcated into tvo zones. Zone
its coeprised of Parcel Nap 7349, coeprtsed of 8 parcels, totaltng 6,057
square feet. The district was formed in October 5, 1983, for the maintenance
of landscaping a detention basin and stom drain within the project. This
zone wtll be assessed on per lot basis for the maintenance costs within the
project boundary only as stipulated in the Engtneer's Report for the foreatton
of the DIstrict.

Zone 2 ts comprised of all other pro3ects that are beth9 annexed or wt]l be
annexed to this District. A]~ ~ots or parcels w~thtn Zone 2 wtl~ be assessed
on net acre basis for the maintenance of landscaped median ~slands on Haven
Avenue from 4th Street to Deer Creek ~annel, Foothtll Boulevard and 4th
Street from west to east City 11mtt, Iqtlllken Avenue and Rochester Avenue,
from 4th Street to Foothill Boulevard, 6th Street from Haven Avenue to
Rochester Avenue and median tslands on other ca;lot dtvtded htghways and some
parkways wtthtn the Xndustrtal Specific Plan Area and Foothtll Boulevard
over1 ay area.
The estimated cost for Landscape Iqatntenance Dtstrtct No. 3 including
Annexation No. 10 is as follows.

wtthin the text of this report.

SECTION 6. Assessment
Improvements for the Dtstrtct are found to be of general benefit to all
lots wtthtn the Dfstrfct and that asseSSment sha}l be equal for each parcel
for Zone 1 and shall be equal to the next acreage for each lot or parcel ~n
Zone 2.
The Ctty Counctl w~ll hold a public heartrig tn June, to determine the
actual assessments based upon the actual costs tncurred by the City duffrig the
prevfous ffscal year whlch are to be recovered through assessments as requtred
by the Landscape and Lfght~ng Act of 1972.
SECTION 7. Order of Events
1. Ctty Counctl adopts Resolution of Prelfmfnary Approval of C~ty Eng~neer's
Report.
2. CJty Counctl adopts Resolution of Intention to Annex to Dtstrtct and sets
publtc heartng date.
3. Ctty Counctl conducts pub] tc heartng, considers al 1 testimony and
determines to Annex to the DtstrJct or abandon the proceedings.
4. Every year tn Flay, the Ctty Engtneer ftles a report wtth the Ctty Counctl.
5. Every year tn June, the Ctty Counctl conducts a publlc healing and
approves, or modtfles and approves the tndtvldual assessments.
