A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCliO
CUCAMONGA, CALIFORNIA, OF PRELIMINARY APPROVAL OF CITY
ENGINEER' S REPORT FOR ANNEXATION NO. 40 TO LANDSCAPE
MAINTENANCE DISTRICT NO. I
WHEREAS, on November 18, 1987, the City Council of the City of Rancho
Cucamonga directed the City Engineer to make and file with the City Clerk of
said City a report in writing as required by the Landscaping and Lighting Act
of 1972~ and
W~EREAS, the City Engineer has made and filed with the City Clerk of
said City a report in writing as called for pursuant to said Act, which report
has been presented to this Council for consideration; and
WHEREAS. said City Council has duly considered said report and each
and every part thereof, and finds that each and every part of said report is
sufficient. and that said report, nor any part thereof, requires or should be
modified in any respect.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
Rancho Cucamonga as follows:
SECTION 1: That the Engineer's Estimate of the itemized costs and
expenses of said work and of the incidental expenses in connection therewith.
contained in said report be, and each of them are hereby, preliminarily
approved and confirmed.
SECTION 2: That the diagram showing the Assessment District referred
to and described in said report, the boundaries of the subdivisions of land
within said Assessment District are hereby preliminarily approved and
confirmed.
SECTION 3: That the proposed assessment upon the subdivisions of land
in said Assessment District in proportion to the estimated benefit to be
received by said subdivision, respectively, from said work and of the
incidental expenses thereof, as contained in said report is hereby
preliminarily approved and confirmed.
SECTION 4: That said report shall stand as the City Engineer's Report
for the purposes of all subsequent proceedings, and pursuant to the proposed
district.

Landscape Maintenance ltstrtct No. 1
Annexation No. 40 for
Tract No. 12873
SECTION 1. Authority for Report
This report ts tn compliance wtth the requirements of Article 4, Chapter
1, Dtvtston 15 of the Streets and Ht hways Code, State of California
{Landscaping and Lighttrig Act of 197~).
SECTION 2. General Description
Thts City Counctl has elected to annex all new subdivisions into Landscape
Maintenance District No.1. The Ctty Counctl has detemtned that the areas to
be maintained wtll have an effect upon all lots within Tract No. 12873 as well
as on the lots directly abutting the landscaped areas. All landscaped areas
to be maintained in the annexed tracts are shown on the recorded Map as
roadway right-of-way or easements to be granted to the Clty of Rencho
Cucaeonga.
SECTION 3. Plans and Specifications
The plans and landscaping are as stipulated in the conditions of approval
for the developcent and as approved by the City Engineering DIvision.
Reference ts hereby made to the subject tract map or developcent plan and the
assessment diagram for the exact locatton of the landscaped areas. The plans
and specifications for landscaped Improvement on the Individual development ts
hereby made a part of this report to the saee extent as if said plans and
specifications were attached hereto.
SECTION 4. Estimated Costs
No costs will be incurred for parkway teproveeent construction. All
improvements wtll be constructed by developers. Based on historical data,
contract analysts and developed Nork standards, it is estimated that
maintenance costs for assessment purposes will equal thirty ($.30) cents per
square foot per year. These costs are estimated only, actual assesseent ~tl l
be based on ectual cost data.

including Annexation No. 40 is as follows:

Assessment shall apply to each lot as enumerated tn Sectton 6 and the
attached assessment diagram. k/here the development covered by this annexation
involves t~rontage along artertal or collector streets, ~htch are designated
1'Or Inclusion in the maintenance distrtc-t-but wtll be maintained by an active
hoeeo~ners association, these assessments shall be reduced.
SECTION 5. Assessment Dtagram

SECTION 6. Assessment
Improvements 1'or the Dtstrtct are found to be of general benet'tt to all
lots wtth~n the Dtstrtct and that assessment shall be equal ~'or each unit.
k/here there ts more than one dNelltng untt per lot or parcel of assessable
land, the assessment for each lot or parcel shall be proportional to the
number ot' be111ng unlts per lot or parcel.
The City Counct1 wtll hold a public heartng in June, to determine the
actual assessments based upon the actual costs tncurred by the Ctty durtng the
prevtous fiscal year which are to be recovered through assessments as requtred
by the Landscape and Ltghttng Act of 1972.
SECTION 7. Order of Events
1. Ctty Counctl adopts Resolution of Preliminary Approval of City Engtneer's
Report.
2. Ctty Council adopts Resolution of Intention to Annex to District and sets
pub1 tc heartng date.
3. City Council conducts publlc heartng, considers all tostteony and
detemines to Annex to the District or abandon the proceedings.
4. Every year in Nay, the City Engineer ftles a report with the City Counctl.
5. Every year tn June, the City Counctl conducts a public hearing and
approves, or eodt~'ies and approves the individual assessments.
