A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCliO
CUCAMONGA, CALIFORNIA., ORDERING TIE WORK IN CONNECTIDN
WIT~ ANNEXATION'NO. 5 'TO' STREET LIGHTING MAINTENANCE
DISTRICT NO. 6 AND ACCEPTING THE FINAL ENGINEEK"S REPORT
FOR TRACT NO. FARCEL MAP 10884~
~HEREAS, the Ci=y Council of the City of RanchO. Cucamonga did on the
7th day of October, 1987, adopt its Resolution of Intention No. 87-540 to order
the therein described work in connection with Annexation No. 5 to Street
Lighting Maintenance District No. 1, which Resolution of Intention No. 87-540
was duly and legally published in the time, form and manner as required by law,
shown by the Affidavit of Publlcarion of said Resolution of Intention on file
in the office of the City Clerk; and
WHEREAS, after the adoption thereof. notice of the passage of .said
Resolution of Intention. headed "Notice of Improvementw, was duly and leSally
posted in the time, form, manner, location, and number as required by law, as
appears from the Affidavit of Posting said notices, on file in the office of
the Ci=y Clerk; and
~HEREAS. after the adoption thereof, notices of the adoption of the
Resolution of Intention were duly mailed to all persons owning real property
proposed to be assessed for the improvements described in said Resolution of
Intention No. 87-540, according to the names and addresses of such owners as

WHEREAS, said City Council having duly received considered evidence,
oral and documentary, concerg. ing ~he j_u_r~sdlctiom;-facts, in x~xia, proceeding and
concerning the necessity' for the contemplated work and the benefits-to be
derived therefrom and said City Council having now acquired jurisdiction to
order the proposed work.
SECTION 1: It is hereby resolved by the City Council of the City of
Rancho Cucamon~a that the public interest and convenience requires the
annexation to =he District and the ordering of the work, and said City Council
hereby orders that the work, as set forth and described in said Resolution of
Intention No, 87-540, be done and made; and
SECTION 2; The Report filed by the Engineer is hereby finally
approved; and
SECTION 3: The assessments and method of assessment in the Engineer~s
Report are hereby approved.

SECTION 4: The assessments shall not begin until after 60 percent of
said tracts have been occupied.

Annexation No. 5 for

SECTION 1. Authority for Report ..
This report is tn compliance with the requirements of Arttcle 4,
Chapter 1, Dlvtston 15 of the Streets and Htghways Code, State of
California (Landscaping and Lighting Act of 1972).
SECTION 2. General Description
Thls CIty Council has elected to annex all developments en~erated in
Exhibit "A" into Street Llghttng Maintenance District No. 6. The City
Councl 1 has deterrot ned that the street 1 tghts to be mat ntat ned wt 11 have
an effect upon all lots or parcels within said developments as we1] as on
the lots or parcels directly abutting the street lights.
Work to be provided for with the assessments established by the
di strict are:
The furnishing of services and materials for the ordinary and
usual maintenance, operating and servicing of street light
improvements on local streets. Improvement maintenance is
considered of general benefit to all areas in the District and
cost shall be divided on a per unit basis.
SECTION 3. Plans and Specifications
The plans and specifications for street lighting have been prepared
by the developers. The plans and street lights are as stipulated in the
conditions of approval for the development and as approved by the City
Engineering Division. Reference is hereby made to the subject tract map
or development plan and the assessment diagram for the exact location of
the street lighting areas. The plans and specifications for street
lighting improvement on the individual development is hereby made a part
of this report to the same extent as if said plans and specifics were
attached hereto.
Detailed maintenance activities on the street lighting district
include: the repair, removal or replacement of all or any part of
any improvement, providing for the ill~ination of the subject area.

SECTION 4. Estimated Costs
No costs wt 11 be incurred for street 1 lghtt ng improvement
construction. All leprovenents will be constructed by developers. Based
on available data, tt is estimated that maintenance costs for assessment
purposes wtll be as indicated below. These costs are estlmated only,
actual assessments wl]1 be based on actual cost data.

SECTION 5. Assessment Diagram
Coptes of the proposed Assessment Diagrams are attached to this
report and labeled "Street Ltghttng Natntenance Dtstrtct No. 6",
Annexation No. 5. These dtagrams are hereby incorporated wlthtn the text
of th~s report.
SECTION 6. Assessment
Improvements for the Otstrtct are found to be of general benefit to
all units w~th~n the District and that assessment shall be equal for each
unit. t~here units are based on acreage, assessment w~11 be 2 units per
net acre.

Estimated assessments are for comparison only. Actual assessments
will be set by public hearing each year in june and will be based on
actual energy and matntanance expenses and developed land use s~maries.
SECTION 7. Order of Events
1. Ctty Counct1 adopts Resolution o~ Preliminary Approval of Ctty
Engineer' s Report.
2. Ctty Counctl~ adopts Resolution of Intention to annex a Otstrlct and
sets public hearing date.
3. City Council conducts public hearing, considers all testimony and
determines to fore a District or abandon the proceedings.
4. Every year in May, the City Engineer files a report with the City
Counci 1.
5. Every year in June, the City Council conducts a public hearing and
approves, or modifies and approves the individual assessments.
