HomeMy WebLinkAbout87-598 - Resolutions RESOLUTION NO. 87-598 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA~ OF PRELIMINARY APPROVAL OF CITY ENGINEER'S REPORT FOR ANNEXATION NO. 9 TO LANDSCAP~ MAINTENANCE DISTRICT NO. 3 ~[EREAS, on November 4, 1987, the City Council of the City of Rancho Cuc~monga directed the City Engineer to make and file with the City Clerk of said City a report in writing as required by the Landscaping and Lighting Act of 1972; and ~{EREAS. the City Engineer has made and filed with the City Clerk of said City a report in writing as called for pursuant to said Act. which report has been presented to this Council for consideration; and WHEREAS, said~City Council has duly considered said report and each and every part thereof. and finds that each and every part of said report is sufficient. and that said report, nor any part thereof, requires or should be modified in any respect. N~, THEREFORE BE IT RESOLVED by the City Councll of the City of Rancho Cucemonga as follows= SECTION 1: That the Engineer's Estimate of the itemized costs and expenses of said work and of the incidental expenses in connection therewith. contained in said report be, and each of them are hereby, preliminarily approved and confirmed. SECTION 2: That the diagram showing the Assessment District referred to and described in said report, the boundaries of the subdivisions of land within said Assessment District are hereby preliminarily approved and confirmed. SECTION 3: That the proposed assessment upon the subdivisions of land in said Assessment District in proportion to the estimated benefit to be received by said subdivision, respectively, from said work and of the incidental ezpenses thereof, as contained in said report is hereby preliminarily approved and confirmed. SECTION 4: That said report shall stand as the City Engineer~s Report for the purposes of all subsequent proceedings, and pursuant to the proposed district. Beverly A/Authelet, City Clerk Resolution No. 87-598 Page 3 CITY OF RANCHO CUCANONGA Engtneer's Report for Landscape Maintenance District No. 3 ANNEXATION NO. 9 for DR 86-42 SECTION 1. Authorit~ for Report This report is in compliance with the requirements of Article 4, Chapter 1, Division 15 of the Streets and Highways Code, State of California (Landscaping and Lighting Act of 1972). SECTION 2. General Description This City Council has elected to annex all new subdivisions into Landscape Haintenance District No.3. The City Council has determined that the areas to be maintained will have an effect upon all the developments as mentioned above. All landscaped areas to be maintained in the annexed developments are shown on the recorded Map as roadway right-of-way or easements to be granted to the City of Rancho Cucamonga. SECTION 3. Plans and Specifications The plans and landscaping are as stipulated in the conditions of approval for the development and as approved by the City Engineering DiviSion. Reference is hereby made to the subject tract map or development plan and the i for landscaped improvement on the individual development is hereby made a part of this report to the same extent as if said plans and specifications ere attached hereto. SECTION 4. Estimated Costs No costs will be incurred for parkway improvement construction. All improvements will be constructed by developers. Based on historical data, contract analysts and developed work standards, ft is estimated that maintenance costs for assessment purposes wtll equal thirty ($.30) cents per square foot per year. These costs are estimated only, actual assessment w111 be based on actual cost data. Landscape Maintenance District No. 3 has been demarcated into two zones. Zone 1 is comprised of Parcel Map 7349, comprised of 8 parcels, totallng 6,057 square feet. The district was formed tn October 5, 1983, for the maintenance of landscaping a detention bastn and storm drain within the project. This zone will be assessed on per lot basts for the maintenance costs wtthtn the project. This zone will be assessed on per lot basis for the maintenance costs within the project boundary only as stipulated in the Engtneer's Report for the Formation of the District. Resolution No. 87-598 PaSe 4 Zone 2 is comprised of all other projects that are being annexed or will be annexed to this DIstrict. All lots or parcels withtn Zone 2 will be assessed on net acre basts for the maintenance of landscaped median tslands on Haven Avenue from 4th Street to Oeer Creek Channel, Foothill Boulevard and 4th Street from west to east City limit, Nilliken Avenue and Rochester Avenue, from 4th Street to Footht11 Boulevard, 6th Street from Haven Avenue to Rochester Avenue and median islands on other major dtvtded htghways and some parkways within the Industrial Specific Plan Area and Footht11 Boulevard overlay area. SECTZON 5. Assessment Improvements for the District are found to be of general benefit to all lots within the District and that assessment shall be equal for each parcel for Zone 1 and shall be equal to the next acreage for each lot or parcel in Zone 2. The City Council will hold a public hearing in dune, to determine the actuaT assessments based upon the actual costs incurred by the City during the previous fiscal year which are to be recovered through assessments as required by the Landscape and Lighting Act of 1972. SECTION 7. Order of Events 1. City Council adopts Resolution of Preliminary Approval of City Engtneer's Report. 2. City Council adopts Resolution of Intention to Annex to District and sets public hearing date. 3. City Council conducts public hearing, considers all testimony and determines to Annex to the District or abandon the proceedings. 4. Every year in Nay, the City Engineer files a report with the City Council. 5. Every year in dune, the City Council conducts a public hearing' and approves, or modifies and approves the individual assessments.
