STATE AG~~ NO. 08-5420 FOR CRDSSING ~ON
MODIFICATIONS AT THE ~ AV~qUE AT ~SON, TOPEKA
AND SANTA FE RAII~0AD C~OSS~ NO. 2-95.0
WHEREAS, the City Council of the City of Rancho Cucamonga (herein-
after referred to as "Local Agency"), has for its consideration and execution,
the Program Supplement No. 14 to Local Agency-State Agreement No. 08-5420 for
the modification of existing Railroad Crossing protection devices at the
Rochester Avenue at Atchison, Topeka and Santa Fe Crossing No. 2-95.0; and
WHEREAS, the State of California, Department of Transportation,
District Office 8 (hereinafter referred to as "State") processes and monitors
Federally funded projects; and
WH~AFAS, as a condition to payment of Federal funds for said
projects, the Local Agency shall approve and execute said Program Supplement
No. 14.
NOW, THEREFORE, tb~ City Council of the City of Rancho Cucamonga dees
hereby resolve to:
1. Authorize the Execution of Supplement No. 14 to Local Agency -
State Agreement No. 08-5420 for the Installing of 2 ~9A canti-
lever flashers with stub gates and 2 ~9 gates with flashy_rs to
be controlled by motion sensing devices with necessary actuating
and operating circuits and ir~trun~_r~ housing, to replace 2 ~9's
at Grade Crossing PUC No. 2-95.0 Rochester Aver~_e in the City of
2. To authorize the Mayor to sign said Supplement and direct the
City Clerk to attach a certified copy of this Resolution, as
well as type in the Resolution number and date in the blank of
the third block of said supplement and for the return of the
original copies of said supplement to the State of California
~ of Transportation alor~ with the certified copy of
this Resolution.
BE IT FU~PHER RESOLVED that the Local Agency shall also comply with
the "Special Covenants or Re~arks" attached to said supplement including:
1. Payment of Local Agency portion of said agreement estimated at
$13,300.00 and such increases as required to complete such
2. To Reaffirm the "Nondiscrimination Asst~-~r~es,, contained in the
Local Agency Agreement No. 08-5420 for Federal Aid Program.

3. To agree that the payment of Federal funds for such project will
be limited to the amounts approved by the Federal Highway
Administration in the Federal-aid Project Agre~_nt (PR-2)/
Detail Estimate, or its modification (PR-2A) or the FNM-76, and
to accept any increases in Local Agency Funds as shown on the
Finance or Bid Letter or its modification as prepared by the
Division of Local Streets and Roads.
4. All re~Hred pavement markings and advance warning signs shall
conform to the requirements of MUTCD, 1978 and shall be placed
in their proper location by the Local Agency at the time of
completion of the Railroad's work.
5. The cost of mintenance of the crossing shall be as allocated by
the Public Utilities C~.,,~ssion.
