SIGNING OF PROGRAM SUPPL~M~ NO. 15 TO LOCAL AG~I~CY -
STATE AGR~ NO. 08-5420 FOR THE PREPARATI(IN OF DESIGN
PLANS, CONTRACT SPECIFI~~ AND ENGINFFR'S ESTIMATE
WHEREAS, the City Council of the City of Rancho Cucamonga (herein-
after referred to as "Local Az/ency"), has for its consideration and execution,
the Program Supplement No. 15 to Local A&/ea-~y - State A~3reem~nt No. 08-5420
for the preparation of design plans, contract specifications and engip~r's
estimate for the Haven Avenue rehabilitation and widening frc~ 4th Street to
Foothill Boulevard; and
WHEREAS, the State of California, Department of Transportation,
District Office 8 (hereinafter referred to as "State,,) processes and monitors
Federally funded projects; and
WHERFAS, as a condition to payment of Federal funds for said
projects, the Local Agency shall approve and execute said Program Supplement
No. 15.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCID O3C3%SDNGA DOES
Ht~REBY RESOLVE AS FOLLOWS:
1. Authorize the Execution of Supplement No. 15 to Local Agency -
State Agre~nent No. 08-5420 for the preparation of design plans,
contract specifications and engineer,s estimate for the Haven
Avenue rehabilitation and widening from 4th Street to Foothill
Boulevard in the City of Rancho Cucamonga, San Bernardino
2. To authorize the Mayor to sign said Supplement and direct the
City Clerk to attach a certified copy of this Resolution, as
well as type in the Resolution number and date in the blank of
the third block of said supplement and for the return of the
original copies of said supplement to the State of California
Department of Trar~qmDrTation along with the certified copy of
this Resolution.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Local Agency shall
also comply with the "Special Covenants or Remarks,, attached to said
supplement including:
1. All mintenanoe, involving the physical condition and the
operation of the improveme~t~, referred to in Article VI
MAINT~qANCE of the Local Agency and/or the respective agencies
as de~ by agreement at re~jular intervals or as required
for efficient operation of the completed improvements.

2. The Local Agency will advertise, award, and administer this
project and will obtain the State's co~ prior to either
award or rejection of the oc~cract.
3. The Local Age_nc~ agrees the payment of Federal funds will be
limited to the amounts appzDved by the Federal Highway
Administration in the Federal-Aid Project A~ (PR-
2)/Detail Estimate, or its modification (PR-2A) or the FNM-76,
and accepts any increases in Local Agency Funds as shown on the
F~ or Bid Letter or its modification as prepared by the
Division of Local Streets and Roads.
4. Construction will be pr0grau~ed as a separate program under
(knb~ Road Plan procedures.
5. In executing this Program Supplemental A=3reement, Local Agency
hereby reaffirms the '~ondiscrimination Ass%=-4nces,, conta/ned in
the aforementioned Master Agre~uent for Federal-Aid Prog~=am.
6. Whenever the Local Agency uses a ccnsul~ on a cost plus
basis, the Local Agency is requ{red to suhnit a post audit
report covering the eligibility of cost payments for each
individual consultant or suboontra~ incurring over $25,000 on
the project. Tb~ audit report ~ust state the applicable cost
principles utilized by the auditor in determining allowable
costs as referenced in CFR 49, Part 18, Subpart C-22, allowable
costs.
