A RESOLUI~ON OF THE CITY OOUNCIL OF THE CITY OF RANCHO

WHEREAS, the City Council of the City of Rancho Cucamonga has
instituted proceedings for the formation of a special assessment district
under the terms and provisions of the '~unicipal Improvement Act of 1913",
being Division 12 of the Streets and Highways Code of the State of California,
for the installation of certain public works of improvement in a special
assessment district, said assessment district known and designated as
ASSES~q~t~C DISTRICT NO. 89-1 (hereinafter referred to as the "Assessment
District"); and
WHEREAS, pursuant to Section 10110 of the Streets and Highways Code
of the State of California, it is required that prior to the time that any
works of improvement are ordered pursuant to said proceedings, the legislative
body may, by contract, provide that certain works shall be performed by other
public agencies or regulated public utilities who will have the legal title to
the facilities, and further that said improvements shall thereafter constitute
a part of their system; and
WHEREAS, at this time, agreements with the Cucamonga County Water
District and Atchison-Topeka & Santa Fe Railroad Company have been sut~it~
and reviewed pursuant to the authorization of Section 10110 of said Streets
and Highways Code; and
WHEREAS, the Streets and Highways Code of the State of California,
specifically the '9~unicipal Improvement Act of 1913", expressly authorizes the
acquisition of any improvements that are authorized to be installed under said
law, and the property owner has constructed certain of the authorized eligible
facilities; and
WHEREAS, at this time there ham been s~mmitted to this City Council
for review and approval, an Ax~luisition/Financing Agreement setting forth
certain terms and conditions, as well as estimated prices and quantities of
work to be acquired and financed pursuant to said Agreement.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does
hereby resolve as follows:
SECTION 1: That the above recitals are all true and correct.
SECTION 2: That the Agreements, herewith sukm~it~, relating to the
installation of certain improvement facilities that will be under the owner-
ship, management and control of other public agencies or regulated public
utilities, are hereby approved. Said Agreements relate to facilities to be
owned by the following agencies:
A. Cucamonga County Water District
B. Atchison-Topeka & Santa Fe Railroad Company

SECTION 3: That the Acquisition/Financing Agreement, as sutmnit~
for this Assessment District, is hereby accepted and approved.
SECTION 4: The final prices to be paid for said improvements shall
be prices as determined by the City to be reasonable, to represent the actual
costs and expenses for the installed works of improvement, including all
appropriate incidental expenses.
SECTION 5: That the Mayor and City Clerk are hereby authorized to
execute each of the above Anjreements on behalf of the City.
SBCTION 6: That immediately upon execution, conformed copies of said
contracts shall be transmitted to the office of the Cucamonga County Water
District and to the Atchison-Topeka & Santa Fe Railroad Company, together with
a copy of this Resolution. In addition, a copy of said Aqreements shall be
kept on file in the City Clerk's office and remain open for public inspection.
