HomeMy WebLinkAbout91-288 - Resolutions RESOLUTION NO. 91-288 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANC~{O CUCAMONGA, COUNTY OF SAN BERNARDINO, STATE OF CALIFORNIA, DECIARING ITS INTE~ITON TO VACATE A SIDE~AI/~ EASE]~T ~ ~ 9415 AND 9425 PAID ALTO STREET, AT THE TERMIUS OF LAYTON STREET WHEREAS, by Resolution No. 91-259 passed on September 4, 1991, the Council of the city of Rancho Cucamong~ declared its intention to vacate a sidewalk easement hereinafter more particularly described, and set the hour of 7:00 p.m. on October 2, 1991, in the City Council Cbxm~_rs, located at 10500 Civic Center Drive, Rancho Cucamonga, as the time and place for hearing all persons objecting to the proposed vacation; a~ WHEREAS, such public hearing ba~ been held at said time and place, and there were no protests, oral or written, to such vacation. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby resolve as follows: SECTION 1: The Council hereby finds all the evidence su~tted that a sidewalk easement is unnecessary for present or prospective public easement purposes, and the City Council hereby makes its order vacating that portion of said City easement as shown on Map No. V-l18 on file in the office of the Clerk of the City of Rancho Cucamonga, which h~A been further described in a legal description which is attached hereto, marked Exhibit "A", and by reference made a part thereof. SECTION 2: The subject vacation shall be subject to the reservations and exceptions, if any, for existing utilities on record. SECTION 3: The concrete sidewalk within the easement area shall be removed and the walkway closed off prior to recordation of the vacation. SECTION 4: The Clerk shall cause a certified copy of this resolution to be recorded in the office of the County Recorder of San Bernardino County, California. SECTION 5: The Clerk shall certify to the passage and adoption of this resolution, and it shall thereupon take effect and be in force. PASS,I), APPrOVeD, and ADOPI~D this 2nd day of October, 1991. City Clerk Resolution No. 91-288 Page 3 Legal Description Vacation of Palo Alto Street/Cucamonqa Junior High School Sidewalk Easement Being a portion of Tract 6939 per plat recorded in Book 91 of Maps, Pages 49 through 5.2 inclusive, records of the County Recorder of the County of San Bernardino, State of California, more particularly described as that certain strip of land 8 feet wide and 114 feet long lying easterly of Lot 18 and westerly of Lot 19 denoted ss an 8 foot easement to San Bernardino County for sidewalk purposes on said lap.
