A. Recitals.
(i) Foothill Marketplace Partners bas filed an application for the
issuance of Conditional Use Permit 90-37 as described in the title of this
Resolution. Hereinafter in this Resolution, the subject Conditional Use
Permit is referred to as "the application."
(ii) On the 26th day of June 1991, the Planning O~uLdssion of the
City of Rancho Cucamonga co~d_ a duly noticed public hearing on the
application After considering all public testimor~, Planning C~mdssion.
adopted its Resolution No. 91-86 approving the application.
(iii) The decision represented by said Planning
Resolution was timely appealed to this Council.
(iv) On August 21, 1991, the City Council of the city of Rancho
Cucamonga conducted a duly noticed public hearing on the application and
concluded said hearing on that date.
(v) All legal prerequisites prior to the adoption of this Resolution

NC~, THEREFORE, the City Oouncil of the City of Rancho C~c~mnnga-.does
hereby find, determine and resolve as follows:
1. This Council hereby specifically finds that all of the facts se~
fc~ch in the R~citals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidenoe presented to this Council during
the above-referenoed public hearing on August 21, 1991, including written and
oral staff reports, together with public testimony, this Council~ hereby
specifically finds as follows:
(a) ~he application applies to a _+60 acre paroel of land
located on the south side of Foothill Boulevard between Interstate 15 and
Etiwar~a Avenue, with a street frontage of +2,175 feet along Foothill
Boulevard and _+600 feet along Etiwanda Avenue. The site is presently

designated for I%e~ional Related C~L~tercial and Light Industrial uses and is
developed with single-family residences, a winery oc~plex, and a ~ gas
station; and
(b) The property to the north is designated for C~t,~rcial uses
and is improved with a mix of uses includir~ a church, single-family
residences, retail strifes, and a converted winery. The property to the south
business, is being developed with a water transmission facility, and is
uses and is vacant and developed with single-family residences. The prcp~
to the w~st, oppceite the Interstate 15 Freeway, is designated for C~m~rcial
(c) The project will cc~ply with all minimum standards of the
City of Rancho Cucamonga; and
(d) In conjunction with this application, the applicant has
suhni~ a request to amend the land use designation within the Foothill
Boulevard Specific Plan frc~ Light Industrial to Regional Related C~m~_rcial.
Plan to allow for such a change thr~ review and approval of a Master Plan;
(e) The development of a +550,000 s~e foot retail/o~,..ercial
center is consistant with the Regional Related O-..~_rcial designation of the
Foothill Boulevard Specific Plan and the ~m~rcial designation of the General
Plan.
(f) The prope~ is developed with single-family residenoes, a
winery complex, and a oonverted gas station which stand as reminders of the
h~s are oomstructed in the Craftmmm style as it was ~ in the area
during the 1920's, and such exan~les are increasingly rare. ~he historic
significance of tb~se structures, and their former use, is further
in this Council's Resolution No. 91-O59.
(g) The legacy of the Italian fmm~lies who settled and began to
~-cduoe ~ durir~ the 1910's and 1920'$ in this easter~ O__w~m~ga/souther~
Etiwam~ rs~ion represent an important segment of the wide range of wine
making activities which d~racterized the City's past econm~ic and cultural
life. The Chaffey/Garcia house and the recc~s~m~tion of the barn will serve
as a local hi~ site and ~seum to exhibit and inte~ artifacts frc~ the

(a) That the proposed use is in accord with the General Plan,
the objectives of the Develo~ COde, and the purpoees of the d~crict in

4. This fX~lncil hereby finds and certifies that the project has been
reviewed and considered in oc~pli~ with the California ~T~irc~m~tal
Quality Act of 1970 and, further, this Council hereby issues a mitigated
Negative Declaration.
5. Based upon the findings and conclusions set forth in paragra~
1, 2, 3, and 4 above, this Council hereby approves the application subject to
each and every condition set forth below:
(a) Approval of Conditional Use Permit 90-37 is granted subject
to all oonditions as conta~ in Plann/ng O~.,d~sion Resolution No. 91-86,
except where modified herein.
(b) Condition No. 7 shall be added under Historic Preservation
to read as follows:
7. The project applicant shall cc~cribute up to
$100,000.00 to es~mhlish a ft~d for the recon-
struction of a 2,000 s~mre foot barn at the
site of the City-~med Chaffey/Garcia house
wherein local wine industry artifacts will be
documents and displayed. Said funds shall be
donated prior to the issuance of demolition
The design of the structure shall follow the
design of the original Omaffey/Garcia barn and
its execution shall be subject to review and
approval of the Historic Preservation
C~m,,~ssion in the form of a Landmark Alteration
Permit.
6. ~ Council hereby provides notice to Foothill Marketplace that
the time within which judicial review of tb~ decision re~ by this
Resolution must be sought is governed by the provisions of California Code of
Civil Procedure Section 1094.6.

7. The City Clerk of the City of P~ncho Cucamonga is hereby d~rected
to: (a) certify to the adoption of this Resolution, and (b) forthwith
transmit a certified copy of this Resolution, by certified mail, return-
receipt requested to Foothill Markeplace at the address identified in City
records.
