SIGNING OF PROGRAM SUPPI.~ NO. 5 TO I/)CAL AGI~CY -
STATE MASTER AGR~ NO. STLPP-5420 FOR THE STATE-LOCAL
BETWRFN 6TH STREET AND JERSEY ~
WHEREAS, the City Council of the City of Rancho Cucamonga (herein-
after referred to as "Local ~ency"), has for its consideration and execution
the Program Supplement No. 5 to Local Agency - State Master Agreement No.
STLPP-5420 for the State-Local Transportation P~rtr~rship Program authorizing
reimkursement of State Share Funds for the construction of the Milliken Avenue
Underpass and Street Improvements between 6th Street and Jersey Boulevard; and
WHEREAS, the State of California, Department of Transportation,
District Office 8 (hereinafter referred to as "State") processes and monitors
State funded projects; and
WH~., as a condition to reimbursement payment of State Share funds
for said projects, the Local Agency shall approve and execute said Program
Supplement No. 5.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does
hereby resolve to:
1. Authorize the Execution of program Supplement No. 5 to Local
Agency - State Master Agreement No. STLPP-5420 for the State-
Local Transportation Partnership Program for the reimborsement
of State Share Funds for the construction of the Milliken Avenue
Underpass and Street Improvements between 6th Street and Jersey
Boulevard; and
2. To authorize the Mayor to sign said Supplement and direct the
City Clerk to attach a certified copy of this Resolution, as
well as type in the Resolution Number and date in the blanks in
the third block of said Supplement and for the return of the
original copies of said Supplement to the State of California
Department of Transportation alor~ with the certified copy of
this Resolution.
BE IT FURPHER RESOLVI~ that the Local Agency shall also comply with
the "Special Covenants or Remarks" attached to said supplement including:
1. It is mutually understood between the parties that this contract
may have been written before ascertaining the availability of
legislative appropriation of funds, for the mutual benefit of
both parties, in order to avoid program and fiscal delays that
would occur if the agreement were executed after that
determination was made.

The total amount of State-Local Transportation Partnership ftunds
payable by the State shall not exceed $996,096.00 to be
encumbered~re~~ follows:
FY 90-91 $124,539.00
FY 91-92 $498,157.00
FY 92-93 $373,400.00
This agreement is valid and enforce~__ble only if sufficient funds
are made available by the California State Legislature.
Any subsequent State Partnership funding changes will be made
through a revised finance letter.
