HomeMy WebLinkAbout98-105 - ResolutionsRESOLUTION NO. 98-105 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, SUMMARILY ORDERING THE VACATION OF A PORTION OF CENTER AVENUE BETWEEN 2$TH STREET AND 26TH STREET, PORTIONS OF 25TH STREET BETWEEN HERMOSA AVENUE AND CENTER AVENUE, AND PORTIONS OF 24TH STREET BETWEEN HERMOSA AVENUE AND MARINE AVENUE (APN: 209-t02-8, t 5, 38, AND 39; 209-103-24, 25, 26, AND 29; 209-104-24; 209-122-15; 209-123-9) WHEREAS, by Chapter 4, Article 1, Section 8334, of the Streets and Highway Code, the City Council of the City of Rancho Cucamonga is authorized to summarily vacate those portions of the City Streets hereinafter more particularly described; and WHEREAS, the City of Rancho Cucamonga Planning Commission has adopted its Resolution No. 98-02, which Resolution finds and determines that the summary vacation of the subject street rights-of-way herein contemplated conform to the City's General Plan; and WHEREAS, the City Council found all the evidence submitted that portions of Center Avenue between 25th Street and 26th Street; 25th Street between Hermosa Avenue and Center Avenue; 24th Street between Hermosa Avenue and Marine Avenue are unnecessary for present or prospective public street purposes because they are excess rights-of-way of streets or highways not required for street or highway purposes. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rancho Cucamonga as follows: SECTION 1: That the City Council of the City of Rancho Cucamonga hereby makes its order vacating those portions of streets on Map V-156, on file in the office of the City Clerk of the City of Rancho Cucamonga, which have been further described in the legal descriptions which are attached hereto, marked Exhibits "A", "B", "C", "D", "E", "F", "G", "H", "1", "J" and "K" and by reference are made a part thereof. SECTION 2: That from and after the date the resolution is recorded, said portions of Center Avenue between 25th Street and 26th Street; 25th Street between Hermosa Avenue and Center Avenue; 24th Street between Hermosa Avenue and Marine Avenue no longer constitute a street or public utility easement. SECTION 3: That the City Clerk shall cause a certified copy of this resolution to be recorded in the office of the County Recorder of San Bernardino County, California.
