SUMMARILY ORDERING THE VACATION OF EXCESS STREET EASEMENT RIGHT
OF WAY LOCATED ON THE SOUTH HALF OF 7T" STREET, EAST OF THE CUL-DE-
SAC TERMINUS OF 7T" STREET AND EAST OF ARCHIBALD AVENUE

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, SUMMARILY
ORDERING THE VACATION OF EXCESS STREET EASEMENT
RIGHT OF WAY LOCATED ON THE SOUTH HALF OF 7T"
STREET, EAST OF THE CUL-DE-SAC TERMINUS OF 7T"
STREET AND EAST OF ARCHIBALD AVENUE
WHEREAS, by Chapter 4, Article 1, Section 8330, of the Streets and Highway
Code, the City Council of the City of Rancho Cucamonga is authorized to summarily vacate the
excess right-of-way located on the south half of 7'h Street, east of the cul-de-sac terminus, east
of Archibald Avenue; and
WHEREAS, on January 23, 2002, the Planning Commission determined that the
vacation of 7th Street between its cul-de-sac terminus east of Archibald Avenue and extending
east to the intersection with Hermosa Avenue is in conformance with the General Plan and
recommended that said vacation occur.
WHEREAS, the City Council found by all the evidence submitted that the excess
right-of-way is unnecessary for present or prospective public street purposes, it has not been
used for more than five (5) consecutive years and no public money was expended for
maintenance of same.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Rancho Cucamonga as follows:
SECTION 1: That the City Council of the City of Rancho Cucamonga hereby
makes its order vacating excess street easement right-of-way
located on the south half of 7`h Street, east of the cul-de-sac
terminus, east of Archibald Avenue, as described in Exhibit "A"
and shown on Exhibit "B."
SECTION 2: That the subject vacation shall be subject to the reservation and
exception, if any, for existing utilities on record.
SECTION 3: That from and after the date the Resolution is recorded, said
excess street easement no longer constitutes a public easement.
SECTION 4: That the City Clerk shall cause a certified copy of this resolution to
be recorded in the office of the County Recorder of San
Bernardino County, California.
SECTION 5: That the City Clerk shall certify to the passage and adoption of this
resolution, and it shall thereupon take effect and be in force.
