HomeMy WebLinkAbout79-47 - Resolutions RESOLUTION NO. 79-47 A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION APPROVING DIRECTOR REVIEW NO. 79-41 LOCATED ON THE SOUTH SIDE OF 8TH STREET, EAST OF HELLMAN AVENUE IN THE M-R ZONE WHEREAS, on the 21st day of May, 1979, a complete application was filed for review of the above described project; and WHEREAS, on the 27th day of June, 1979, the Rancho Cuca~nonga Planning Co~ission held a meeting to consider the above described project. NOW, THEREFORE THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVED AS FOLLOWS: SECTION 1: That the following findings have been made: 1. That the sits indicated by the development plan is adequate in size and shape to acconmaodate the proposed use, and all yards, spaces, walls, fences, parking, landscaping, loading and other features required by this section. 2. That the improvements as indicated on the develop- ment plan are located in such a manner as to be properly related to existing and proposed streets and highways. 3. That the improvements as shown on the development plan are consistent with all adopted standards and policies as set forth in this section. SECTION 2: That this project will not create adverse impacts on the environment and that a Negative Declaration is issued on June 27 , 1979. SECTION 3: That Director Review No. 79-41 is approved subject to the following conditions: Applicant~shall contact the Planning Division for com- pliance with the following conditions: 1. Parking lot lights shall be a maximum height of 12' and directed away from all property lines, adjacent streets and residences. 2. Double stripped lines are required for all parking stalls. 3. Parking lot trees shall be a minimum 15 gallon size. 4. A uniform sign program for this development shall be submitted to the Planning Division for their review and approval prior to occupancy of any buildings. 5. A detailed landscape and irrigation plan shall be · submitted to and approved by the Planning Division prior to the issuance of building permits. 6. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash and debris. 7. Existing eucalyptus trees shall be retained where ever possible and shall be trimmed and topped at 30'. Dead, decaying or potential dangerous trees shall be r~noved at the discretion of the Planning Division and replaced on a tree-for-tree basis to the satis- faction of the Planning Division. 8. Street trees, a minimum of 15 gallon size or larger, shall be installed in accordance with the Master Plan of street trees for the City of Rancho Cucamonga. 9. Site shall be developed in accordance with the approved site plan on file in the Planning Division and the conditions contained herein. 10. If dwellings are to be constructed in an area designated by the Fire Chief as "hazardous", the roof materials must be approved by the Fire Chief and Planning Division prior to issuance of a building permit. 11. Trash receptacle areas shall be enclosed by a 6 foot high masonry wall with gates pursuant to City standards. Location to the satisfaction of the Planning Division. 12. Ail roof appurtenances, including air conditioners, shall be architecturally integrated and shielded from view and the sound buffered from adjacent properties and streets to the satisfaction of the Planning Division and Building Official. 13. Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at time of Building Permit issuance. 14. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, and all other applicable codes and ordinances in effect at the time of approval of this project. 15. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. 16. Grading of the subject property shall be in accordance with the Grading Ordinance and to the satisfaction of the Building Official. 17. A 6' planter with 4" curbs shall be placed in the parking area of building 25 to separate the parking stalls. Said planter shall be built in accordance with the approved development plans on file in the Planning Division office. 18. The driveway behind buildings 2 and 3 and buildings 23 and 24 shall be kept open and clear at all times. 19. Proof of reciprocal access agreement between buildings 1 and 2, 3 and 4, and 24 and 25 shall be submitted to and approved by the City Engineer prior to the issuance of building permits. 20. Landscape plans shall include planting of all slopes greater than 5:1 using plant materials conducive to slope stabilization. Applicant shall contact the Engineering Division for com- pliance with the following conditions: 21. Dedication of final map of all interior street rights- of-way and all necessary easements as shown on the tentative map. 22. Dedication of the following missing rights-of-way on the following streets: 11 additional feet on Hellman 30 additional feet on 8th 23. Corner P/L radius will be required per City standards. 24. Ail rights of vehicular ingress to and egress from shall be dedicated as follows: That all rights shall be dedicated along Hellman Avenue frontage; and that all rights shall be dedicated along 8th Street frontage except at the driveway indicated on the site plan for Parcel 1, and driveway indicated at the lot line between Parcels 24 and 25. 25. Reciprocal easements shall be provided ensuring access to all parcels over private roads, drives, or parking areas. 26. Prior to any work being performed in the p~blic right- of-way, an encroachment permit shall be obtained from the City Engineer's Office, in addition to any other permits required. 27. Approved street improvement plans prepared by a Registered Civil Engineer shall be required, for all street improvements, prior to issuance of encroachment permit. 28. All street improvements shall be instRlled to the satisfaction of the City Engineer, prior to occupancy. 29. Surety shall be posted and an agreement executed to the satisfaction of the City Engineer and the City A~td~ney, guaranteeing completion of the public improvements, prior to recording of the map and/or issuance of building permits. 30. Construct full street improvements including but not limited to curb and gutter, A.C. pavement, drive approaches, parkway trees and street lights on all interior streets. 31. Construct the following missing improvements on the following streets: Hellman: Curb and gutter, A.C. pavement, Sidewalk, Street trees, Street lights, A.C. overlay 8th Street: Curb and gutter, A.C. pavement, Street trees, Street lights, A.C. overlay 32. Pavement striping, marking, traffic and street nmme signing plan shall be required. 33. An approved grading plan and soils report in accordance with the City grading standards will be required. 34. The applicant will be responsible for construction of all on-site drainage facilities required by the City Engineer. 35. The proposed project falls within areas indicated as subject to flooding under the National Flood Insurance Progr~n and is subject to the provisions of that program and City Ordinance No. 24. 36. The following north-south streets shall be designed as major water carrying streets requiring a combination of special curb heights, commercial type drive approaches, rolled street connections, flood protection walls, and/or landscaped earth berms and rolled drivewmys at property line: Hellman Avenue 37. Ail proposed utilities within the project shall be installed underground. 38. Utility easements shall be provided to the specifica- tion of the appropriate utility companies and the City Engineer. -_. 39. Developer shall be responsible for the relocation of existing public utilities, as required. 40. Developer shall be responsible for the installation of street lighting in accordance with Southern California Edison Company and City standards. 41. Water and sewer system plans shall be designed and constructed to meet requirements of the Cucamonga County Water District (CCWD), Foothill Fire District and the Environmental Health Department of the County of San Bernardino. A letter of compliance from CCWD will be required prior to recordation. 42. Approvals have not been secured from ail utilities and other interested agencies involved. Approval of the final map will be subject to any requirements that may be received from them. 43. Permits from other agencies will be required as follows: Metropolitan Water District. 44. Final parcel and tract maps shall conform to City stan- dards and procedures. APPROVED AND ADOPTED THIS 27TH DAY OF JUNE, 1979.
