DISTRICT 'NO. 1 AND ORDERING THE WORK IN CONNECTION WITH
THE ANNEXATION OF SAID TRACTS TO LANDSCAPE MAINTENANCE
DISTRICT NO.. _7 AND A~CCEPTING ,~,E. F.I, NAL ENG!NE,ER.'.$ R. EPQR.T,
FOR TRACT NOS. 12659-I AND 12870
WHEREAS, the City Council of the City.of Rancho C.u~ca..monga, California
did on the 19th day of July, 1989, adopt its Resolution of Intention No.
89-334 to order the therein described work in. connectig,q _w]t..h the detachment
of Tract Nos. 12659-1 and 12870 from LandscaI~e Maintenance District No. 1, and
the annexation of said tracts to Landscape Maintenance District No. 7, which
Resolution of Intention No. 89-334 was duly and legally published in the time,
form and manner as required by law, shown by the Affidavit of Publication of
'said Resglu.tion~_of~Inte. ntiOn on file in the office of the City Clerk; and
WHEREAS, after the adoption thereof~ notice of the passage of said
Resolution of Intention, headed "Notice of Improvement", was duly and.,l~ga.).ly
posted in the time, form, manner, location, and number as required by law, as
appears from the Affidavit of Posting said notices, on file in the office of
the City Clerk; and
WHEREAS, after the adoption thereof, nOtices-~of ,the adop.%i.on of the
Resolution of Intention were duly mailed to all persons owning real property
proposed to be assessed for the improvements described in said Resolution of
Intention _No. 89-3_34,.accordjng.to,.the names a~nd~addr~esses of. such owners as
the same appears .on t.he. last mailing or. as known, to the Ci~cy Clerk o.f t))e..C~ity
O~ Ra'ncho' Cuca~nonga, .which s. ai.d. copies _we~e..d]uly~miled ~in the title, form, and
manner as required.by 1.aw, as_ ap~pears fro~ the .Affidavit Of Mailing on fiTe in
the office of the City Clerk; and
Wm~EREAS, said City Council having duly. rece!ve.d con~sidered evidence,
oral and documentary, concern'ing the jurisdiction facts in this p~'oceedi~g and
concerning the necessity for the contemplated work and the benefits to be
derived therefrom and said City Council having now acquired jurisdiction to
order the proposed work.
~ NOW, TH.EREFORE;'b~ the City Council of the City of Rancho Cucamonga,
Cal~ornia,'does hereby resolve as follows:
SECTION 1: It is hereby resolved by the City Council of the City of
Rancho Cuca~nga that the public interest and convenience requires the
detachment of Tract Nos. 12659-1 and 12870 from Landscape Maintenance District
No. 1, and the annexation of said tracts to Landscape Maintenance District No.
7 and the ordering of the work, and said City Council hereby orders that the
work, as set forth and described in said Resolution of Intention No. 89-334,
be done and made; and
SECTION 2: Be it further resolved that the report filed by the
Engineer 'is hereby finally approved; and

SECTION 3: Be it further resolved that the assessments and method of
assessment in the Engineer's Report are hereby approved.
SECTION 4:. Be it finally resolvgd,.that-sa.id assessments shall not
begin until after 60 percent of-said ,tracts have been occupied.

Landscape Maintenance District No~ 7
for Annexation of
Tract Nos. 12659-1 and 12870
SECTION 1. Authority, for Report
This report is in compliance with the requiremen_ts, of Articl.e 4j Chapter
1, Division 15 of the Streets and Highways Code, State of California
(Landscaping and Lighting Act of 1972).
SECTION 2. General Description
This City Council has elected to annex all new subdivisions into Landscape
Maintenance District No. 7. The City Council has determined that the areas to
be maintained will have an effect upon all lots Within .,Tract Nos._12659-1 and
12870 as well as on the lots directly abutting'the-l'andscaped areas. All
landscaped areas to be maintained in the annexed tracts are shown on the
recorded Map as roadway right-of-way or easements to be granted to the City of
Rancho Cu'camonga.,

The plJns and landscaping are as stipulated in the. condit.ions of, approval
for the development and as approved by the City Engineering Division.
Reference is hereby made to the subject tract map, or, development, plan and, the
assessment diagram for the exact location of the landscaped areas. The plans
and ~specifications for~landscaped i,mprovem~nt on the ,individual develoPment is
hereby made ~a part ,of this, report-to the~same ex.~ent a~,if.said-plans and
specifications were attached hereto. .. .....
SECTION 4. Estimated Costs _~. ._. ,-
,, No ,costs will be. incurred, for parkway improvement construction.,- All
,improvements-will be constructed by developers. Ba'sed on historical data;
contract analysis .and -.developed work. standards,, it is, estimated that
ma.intenance costs for assessment purposes-will equal thirty ($.35) cents per
square foot per year. These costs.are estimated only,~ac'tual assessment will
be based on actual cost data.

Assessment shall apply' to each lot as e~umerated in Section 6 and the
attached assessment diagram. Where the development covered by this annexation
involves frontage along arterial or collector s.tr.eets, which are designated
for inclusion in the maintenance district-ldut Will be maintained- by an active
homeowner.s association, these assessments Shall be reduced.
SECTION 5. Assessment Diagram ': . .

labeled "Exhibit A" and "Exhibit B", by this reference the d!agram is hereby
incorporated within the text of this repor~
SECTION 6. Assessment
Improvements for the Distr. ict are found to be of general.benefit to all
10ts within the District an~ that assessment sha]l be equal for each unit.
Where there is more than one dwelling unit per lot or parcel of assessa61e
land, the assessment for each lot or parcql shall, be proportional to .the
number of dwelling units per lot or. parce).],
The City Council will hold a public hearin~ in 'June, tO Jetermine the
actual assessments based upon the actual co, sts inc.urr~d by the City .du~ing the
previous fiscal year which are to be r~covere~ through ~ssessments'as. required
by the Landscape and Lighting Act of 1972.

SECTION 7~ Order of Events
1. City Council adopts Resolution of Preliminary Approval of City Engineer's
Report.
2. City Council adopts Resolution of Intention to Annex to District and sets
public hearing date.
3. City Council conducts public hearing, considers all testimony and
determines to Annex to the District or abandon the proceedings.
4. Every year in May, the City Engineer files a report with the City Council.
5. Every year in June, the City Council conducts a public hearing and
approves, or modifies and approves the individual assessments.
