A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA ORDERING CHANGES AND
MODIFICATIONS AND DIRECTING ACTIONS WITH RESPECT
THERETO

WHEREAS, on May 19, 1982~ this Council adopted Resolution No. 82-92, A
Resolution of Intention to Order the Construction of Certain Improvements known as Assessment
District No. 82-1 (6th Street Industrial Area) hereinafter referred to as the "District"; and
WHEREAS, in the proceedings under and pursuant to said Resolution, the
Engineer's Report was adopted and an assessment was confirmed and levied by Resolution No.
99-028 adopted on February 17, 1999; and
WHEREAS, in the proceedings under and pursuant to said Resolution, serial bonds
to represent the unpaid assessments were issued in the manner provided in the "Improvement
Bond Act of 1915" being Division 10 of the Streets and Highways Code of the State of California,
the "Bond Act" the last bond payment of which was made on September 2, 1998; and
WHEREAS, after the last bond payment was made there were funds remaining in
the redemption fund; and
WHEREAS, the Bond Act provides that funds remaining in the redemption fund
account may be proportionately credited upon the final installments due upon the assessment s
securing the bonds and repaid to those whose assessments have previously been paid or may be
transferred to the general fund; and
WHEREAS, the funds identified as remaining in the redemption fund were net of any
amount necessary to make the final debt service payment on the bonds; and
WHEREAS, such surplus funds were derived from the payments made by the
owners of property within the District and interest earnings on such funds and, therefore, this City
Council determines that it is appropriate that the funds benefit the properties within the District; and
WHEREAS, the legislative body has requested that any remaining funds be
transferred to the general fund and be made available for improvements to the existing district; and
WHEREAS, the legislative body desires to order the changes and modifications
hereinafter described in the Modified Engineer's Report which pertain to and/or effect said District;
and

WHEREAS, the changes and modifications hereinafter ordered will not increase the
total amount of the assessment or the amount of any individual assessment nor eliminate or add
any acquisitions or work which will substantially and adversely alter or affect the benefits to be
derived from the work and acquisitions; and
WHEREAS, the public interest, convenience and necessity require the changes and
modifications hereinafter ordered; and
WHEREAS, the Assessment Engineer has filed with the City Clerk proposed
revisions to the Engineer's Report as preliminarily approved by this Council, to wit: a revised
estimate of costs.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does
hereby resolve, determine and order as follows:
SECTION 1. That changes and modifications be made in the Estimated
Construction Cost Summary, and the Description of Work as
set forth in Exhibit "A" attached hereto and made a part of
hereof and that the costs of such changes and modifications
to the improvements be paid from the surplus funds
remaining in the redemption fund for the bonds of the District.

GENERAL INFORMATION FOR PUBLIC IMPROVEMENTS
THROUGH ASSESSMENT PROCEEDINGS
A parcel of land owned by you has been included in a proposed assessment
district for the purpose of constructing certain public Improvements under
the Municipal Improvement Act of 1913. We would, therefore, like to take
this opportunity to accquaint you with some of the main provisions of the 1913
Assessment Act proceedings under the California Streets and Highways Code
so that you may be aware o¢ each step in the procedure for this proposed im-
provement.
The general administration of this district will be handled by the City of
Rancho Cucamonga and all procedural steps taken for improvements con-
tained therein will be made by the City Council.
The City Council has retained various consulting firms for engineering,
assessment engineering, legal counsel, and other required services for
the preparation of all necessary documents for which the assessment dis-
trict will bear the entire cost.
The purpose of this district is to provide means for the property owners,
as a group, to finance the construction of required public improvements to
allow development of vacant lands within the proposed district. When work-
ing together as a group. ultimate improvements are possible; whereas indi-.
vidually, It would be impractical to accomplish the needed improveme'nts.

PRELIMINARY PROCEEDINGS
Upon completion of the Engineer's Report (plans, specifications, cost esti-
mates, diagram map and assessment roll}, It is presented to the City Coun-
cil for adoption. Prior to the adoption of the Engineer's Report, the City
Council will adopt the Resolution of Intention indicating its intention to form
a special assessment district for the construction of the proposed improve-
ments. Following the adoption of the Resolution of Intention and Engineer's
Report, each property owner is given notice, by mail, of the intention to
form the proposed district, and said notice sets forth the date on which a
public hearing will be held on the boundaries of the district and the work
proposed to be constructed. Generally, these notices are received by the
property owner approximately 30 days prior to the date of the public hear-
ing. A notice will also be published in a local newspaper and posted along
with the proposed improvements within the proposed assessment district.
A few days prior to the hearing on the proposed formation of the District,
construction bids will be received[ from qualified contractors for the con-
struction of the proposed improvements. After the bids are analyzed by
the City Engineer, a contract usually is awarded to the lowest respon-
sible bidder. In order that all property owners may know the bid results
prior to said hearing, an informal meeting is held to explain the actual
cost to each property owner.

I1 CONSTRUCTION
Construction usually begins within a short time after award of t. he con-
tract. The Contractor's work will be inspected regularly and it must
conform to the specifications of his contract. Included in the specific. a-
lions are numerous clauses which protect you, the property owner, from
damage to your property and recluire the Contractor to clean up follow-
ing his operations. Should there be any ~luestions regarding the instal-
lations, the City Inspector in the field will gladly discuss them with you,
or you may contact the Office of the City Engineer for desired information.
III ASSESSMENT FOR PAYING PROJECT COSTS
Payment for the construction of said improvement under the Municipal Im-
provement Act of 1913 is accomplished through the issuance of assessment
bonds called 1915 Act bonds. Billings will be on the County Tax bill
and is referred to as a Special Assessment.
The first undertaking of the Assessment Engineer working closely with the
City of Rancho Cucamonga, is to establish the district boundaries. These
boundaries are generally determined upon the need and benefit from the
improvements serving the properties. The Assessment Engineer then pro-
ceeds to establish a formula which will spread the final project cost to'
each individual parcel which benefits from the proposed improvements.
The total cost for this improvement is then spread proportionally over

every parcel of land within the district that will benefit by the improve-
ments. The exact method of making the assessment spread must be in
accordance with the benefits received. Normally this is done on a unit
basis, an area basis, or on a front foot basis, depending upon the type
of benefit received.
Following the hearing on the assessment and formation of the District,
assuming the District was formed and the assessments are confirmed, a
final assessment notice is mailed to each property owner reflecting the
final construction and financing costs for which bids were received.
Property owners then have thirty days during which to pay all or any
portion of this assessment without interest or penalty. If the property
owner elects not to pay the assessment, assessment bonds are sold to
cover the remaining project costs. The assessment will be paid over a
period of fifteen (15) years for' this project. The life of the bond is
normally determined by the bond broker.
We hope this information will answer any questions which may arise con-
cerning the assessment district. We would urge that you keep this infor-
mation for future reference during the course of the project. Additional
information regarding your property may be obtained by contacting the
Office of' the City Engineer.

RESOLUTION OF THE CITY COUNCIL DECLARING INTENTION
TO ORDER THE CONSTRUCTION OF CERTAIN IMPROVEMENTS
TOGETHER WITH APPURTENANCES IN A PROPOSED ASSESSMENT
DISTRICT PURSUANT TO THE PROVISIONS OF THE "MUNICIPAL
IMPROVEMENT ACT OF 1913"; DECLARING THE WORK TO BE OF
MORE THAN LOCAL OR ORDINARY BENEFIT; DESCRIBING THE
DISTRICT TO BE ASSESSED TO PAY THE COSTS AND EXPENSES
THEREOF; AND PROVIDING FOR THE ISSUANCE OF BONDS.
THE CITY COUNCIL OF THE CITY OF RANCHO CU~AMONGA, CALIFORNIA (hereinafter
referred to as "Agency") DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1.
The public interest and convenience require, and it is the
intention of this body, pursuant to the provisions of Division 12
of the Streets and Highways Code of the State of California (the
"Municipal Improvement Act of 19t3"), to order the construction of
certain public improvements, together with appurtenances and
appurtenant work, in a special assessment district known and
designated as
ASSESSMENT DISTRICT NO. 82-1
(hereinafter referred to as the "Assessment District").
DESCRIPTION OF IMPROVEMENTS
The construction of certain improvements, together with
appurtenances and appurtenant work and acquisition, if
necessary, in certain public streets and rights-of-way in the
Assessment District, as set forth in Exhibit "A" attached
hereto, incorporated and so referenced. For further
particulars, reference is hereby made to a map of said
Assessment District previously adopted.
B. Said streets, rights-of-way and easements shall be shown upon
the plans herein referred to and to be filed with these
proceedings.
C. All of said work and improvements are to be constructed at the
places and in the particular locations, of the forms, sizes,
dimensions and materials, and at the lines, grades and
elevations as shown and delineated upon the plans, profiles
and specifications to be made therefor, as hereinafter
provided.
D. The description of the improvements and the termini of the work
contained in this Resolution are general in nature. All items
of work do not necessarily extend for the full length of the
description thereof. The plans and profiles of the work as
contained in the IEngineer's "Report" shall be controlling as to
the correct and detailed description thereof.

Whenever any public way is herein referred to as running
between two public ways, or from or to any public way, the
intersections of the public ways referred to are included to
the extent that work shall be shown on the plans to be done
therein.
F. Notice is hereby given of the fact that in many cases said work
and improvement will bring the finished work to a grade
different from that formerly existing, and that to said extent,
said grades are hereby changed and said work will be done to
said changed grades.
SECTION 2.
DESCRIPTION OF ASSESSMENT DISTRICT
That said improvements and work are of direct benefit to the
properties and land within the Assessment District, and Agency
hereby makes the expenses of said work and improvement chargeable
upon a district, which said Assessment District is hereby declared
to be the Assessment District benefited by said work and
improvements and to be. assessed to pay the costs and expenses
thereof, including incidental expenses and costs and which is
described as follows:
All that certain territory in the District included within the
exterior boundary lines shown on the plat exhibiting the property
affected or benefited by or to be assessed to pay the costs and
expenses of said work and improvements in the Assessment District,
said map titled and identified as
"PROPOSED BOUNDARIES OF
ASSESSMENT DISTRICT NO. 82-1"
and which said map was heretofore approved and which said map or
diagram is on file w')th the transcript of these proceedings,
EXCEPTING from the area shown within and delineated upon said map
or plat hereinabove referred to, the area of all public streets,
public avenues, public lanes, public roads, public drives, public
courts, public alleys, and all easements and rights-of-way therein
contained belonging to the public. For all particulars as to the
boundaries of the Assessment District, reference is hereby made to
said boundary map heretofore previously approved, and for a
complete description of said Assessment District, the said plat and
proposed boundary on file shall govern.
REPORT OF ENGINEER
SECTION 3. That this proposed improvement is hereby referred to the appJ~nted
SUPERINTENDENT OF STREETS, who is hereby directed to make and file
the report in writing containing the following:
A. Plans and specifications of the proposed improvements;

B. An estimate of the cost of the proposed works of improvement,
including the cost of the incidental expenses in connection
therewith.
A diagram showing the Assessment District above referred to,
which shall also show the boundaries and dimensions of the
respective subdivisions of land within said Assessment
District, as the same existed at the time of the passage of the
Resolution of Intention, each of which subdivisions shall be
given a separate nu~er upon said Diagram;

A proposed assessment of the total amount of the assessable
costs and expenses of the proposed improvement upon the several
divisions of land in proportion to the estimated benefits to be
received by such subdivisions, respectively, from said
improvement. Said assessment shall refer to such subdivisions
upon said diagram by the respective nu~ers thereof;
E. The description of the w~rks of improvement to be constructed
under these proceedings, and acquisition, where necessary.
When any portion or percentage of the cost and expenses of the
improvements is to be paid from sources other than assessments, the
amount of such portion or percentage shall first be deducted from
the total estimated costs and expenses of said work and
improvements, and said assessment shall include only the remainder
of the estimated costs and expenses,, Said assessment shall refer
to said subdivisions b.y their respective numbers as assigned
pursuant to Subsection D. of this Section.
SECTION 4.
BONDS
Notice is hereby given that serial bonds to represent the unpaid
assessments, and bear interest at the rate of not to exceed the
current legal maximum rate of 12% per annum, ~ll be issued
hereunder in the manner provided in the "Improvement Bond Act of
1915", being Division 10 of the Streets and Highways Code of the
State of California, the last installment of which bonds shall
mature a maximum of and not. to exceed FOURTEEN (14) YEARS from the
second day of July next succeeding ten (10) months from ~their
date. The provisions of' Part ll.1 of said Act, providing an
alternative procedure for the advance payment of assess~x~nts and
the cal)ing of bonds shall apply.
The principal amount of' the bonds maturing each year shall be
other than an amount eclual to an even annual proportion of the
aggregate principal of the bonds, and the amount of principal
maturing in each year, plus the amount of interest payable in that
year, will be generally an aggregate amount that is equal each
year, except for the first year's adjustment.

That except as herein otherwise provided for the issuance of
bonds, all of said improvements shall be made and ordered pursuant
to the provisions of the "Municipal Improvement Act of 1913",
being Division 12 of the Streets and Highways Code of the State of
California.

l~at if any excess shall be. realized from the assessment, it shall
be used, in such amounts as- the Agency may determine, in
accordance with the provisions of law for one or more of the
following purposes:
A. Transfer to the general fund of the Agency; provided that the
amount of any such transfer shall not exceed the lesser of One
Thousand Dollars ($1,000.00) or five percent (5%) of the total
from the Improvement Fund:
B. As a credit upon the assessment and any supplemental
assessment; or
C. For the maintenance of the improvement.
SPECIAL FUND
'That the legislative body of Agency hereby establishes a special

into w~ich funds may be transferred at any time to expedite the
making of the improvement herein authorized, and said funds are a
loan and shall be repaid out of the proceeds of the sale of
assessments as authorized by law.

PRIVATE CONTRACT
Notice is hereby given that the public interest will not be served
by allowing the property owners to take the contract for the
construction of the improvements, and that, pursuant to Section
10502.4 of the Streets and Highways Code of the State of
California, no notice of award of contract shall be published.
GRADES
l~at notice is hereby given that the grade to which the work shall
be done is to be shown on the plans and profiles therefor, which
grade may vary from the existing grades. The work herein
contemplated shall be done to the grades as indicated on the plans
and specifications, to which reference is made for a description

of the grade at which the work is to be done. Any objections or
protests to the proposed grade shall be made at the public hearing
to be conducted under these proceedings.

function shall be omitted from assessment in these proceedings
unless expressly provided and listed herein.

provisions of the "Special Assessment Investigation, Limitation
and Majority Protest Act of 1931", being Division 4 of the

Pursuant to the provisions of the Municipal improvement Act of 1913, being Division 12 of the
Streets and Highways Code of the State of California, and in accordance with the Resolution of
Intention, being Resolution No. 82-92, and in accordance with the Resolution Ordering
Changes and Modifications, being Resolution No. __, adopted by the City Council of the

(hereinafter referred to as the "Assessment District"), I, Richard Kopecky, submit herewith the
modified Report for the Assessment District, consisting of five (5) parts as follows:
PART I
Plans and specifications for the proposed modified improvements are filed herewith and made
a part hereof. Said plans and specificabons are on file on the Office of the City Engineer
PART II
An estimate of the cost of the proposed modified improvements, including incidental costs and
expenses in connection therewith, is set forth in a separate document entitled "Construction
Costs".
PART III
A proposed assessment of the total amount of the costs and expenses of the proposed
improvements upon the several subdivisions of land within the assessment district, in proportion
to the estimated benefits to be received by such subdivisions, from said improvements, is set
forth upon the assessment roll filed herewith and made a part hereof.

WHEREAS, ON 19 May 198.2_, the City Council did, pursuant to the provisions of the
Municipal Improvement Act of 1913, being Division 12 of the Streets and Highways Code of the
State of California. adopt its Resolution of Intention No. 82-92, and Resolution Ordinance
Changes and Modifications No. , for the construction of certain public improvement,
together with appurtenances and appurtenant work in connection therewith in a special
assessment district known and designated as

(hereinafter referred to as the "Assessment District"): and
WHEREAS.. said Resolution of Intention, and Resolution Ordering Changes and
Modifications, as required by law, did ,:direct the appointed Superintendent of Streets to make
and file a modified report consisting of the following:

NOW, THEREFORE, I, Richard L, Kopecky, as appointed Superintendent of Streets, and
pursuant to the Municipal Improvement Act of 1913, do herein submit the following:

I, pursuant to the provisions of law. the Resolution of Intention. and Resolution
Ordering Changes and Modifications, have assessed the costs and expenses of the
works of improvement to be ped:ormed in the assessment district upon the

parcels of land in the assessment district benefitted thereby in direct proportion and
relation to the estimated benefits to be received by each of said parcels. For particulars
as to the identification of said parcels, reference is made to the modified Assessment
Diagram (reduced), a copy of which is included herein.

As required by law, an modified diagram (reduced) is herein included, showing the
assessment district as well as the boundaries and dimensions of the respective parcels
and subdivisions of land within ...,aid district as the same existed at the time of the
passage of said Resolution of Intention, each of which subdivisions of land or parcels or
lots respectively have been given a separate number upon said diagram and in said
Assessment Roll.

The subdivisions and parcels of land and the numbers therein as shown on the
respective modified Assessment Diagram as included herein correspond with the
numbers as appearing on the modified Assessment Roll as contained herein.
4)
NOTICE IS HEREBY GIVEN that serial bonds to represent the unpaid assessments,
and bear interest at the rate of not.-to-exceed twelve percent (12%) per annum, will be
issued hereunder in the manner provided in the Improvement Bond Act of 1915, Division
10 of the Streets and Highways Code. the last installment of which bonds shall mature a
maximum of and not-to-exceed 'fourteen (14) years from the second day of July next
succeeding ten (10) months from their date.
The provision of Part 11.1 of said Act, providing an alternate procedure for the advance
payment of assessments and the calling of bonds shall apply to these proceedings.
5)
By virtue of the authority contained in said Municipal Improvement Act of 1913, and by
further direction and order of the, City Council, I hereby make the following assessment

6TH STREET INDUSTRIAL AREA
CITY OF RANCHO CUCAMONGA
METHOD OF' ASSESSMENT
The Municipal Improvement Act of' 1913 provides that the costs and inciden-
tal expenses of a project be assessed in proportion to the estimated "benefit"
received by each of the lots or parcels of land within the assessment district.
The code does not provide a specific benefit formula, hence that determina-
tion is made by the Assessment Engineer for consideration by the legislative
body. The formula used should be one that reflects benefit received by
each parcel and result in the most equitable proration of the costs to each
of the lots or parcels within the assessment district.
Storm Drain
The boundaries of this district have been established from the consideration
of drainage. The natural north-south drainage is confined or cut off by
Deer Creek on the west and Interstate 15 on the east. Between these two
points there is very little definition of the sheet flows that occur and this
is emphasized by the fact that the Federal Flood Insurance Administration
has indicated the entire area is subject to flooding under a 100-year fre-
quency ..;pan.
Benefit to the properties involved is two-fold. When the system is com-
pleted, all properties will receive flooding relief and possibly flood insur-
ance designation reductions where these charges are applicable. There is

also imposed upon the area drainage fees pursuant to Section 66483 of the
Subdivision Map Act. When assessments are confirmed upon the property
or otherwise paid, the development drainage fee will be reduced by the
amount of the assessment, Where these fees have previously been paid
the properties will be credited the amount so paid and that amount entered
as a cash contribution to the assessment district.
There is one segment of the Master Plan of Storm Drains which will not
be constructed at this time. The segment is located on 6th Street between
Cleveland Avenue and Milliken Avenue and is presently being eliminated
due to the fact that it only serves the property to the north and there are
no immediate plans for the property to develop.
Based on the summation of the above factors, it is concluded that there is
no permanent physical differentiation between the properties in this assess-
ment district from a drainage standpoint. It is also noted that the system
as proposed could be constructed by many other configurations and still
accomplish the same purpose.
For thE: above reasons, it is concluded that the properties within the assess-
ment district will uniformly benefit in proportion to their area and the drain-
age assessment is distributed accordingly,
Street Improvements
The street work included in the assessment district has as Its purpose the
opening of the area for developrnent. As such, the street work generally

consists of two traffic lanes which constitute only a portion of the ultimate
width of the arterial street. The two lane construction, however, being for
the purpose of opening the area for development, relate in benefit to the
area rather than directly to the adjacent frontage. With the benefit thus
related to the area, the method of assessment is on an area basis.
Where parcels border existing improved roads, but will also benefit from
these land opening roads on the other sides of their boundaries, the area
for assessment purposes has beer~ reduced to one-half.
Street improvements beyond the two lane improvements become the respon-
sibility of the adjacent property upon development. Requests have been
received by the City from certain property owners to include these Improve-
ments within the bond issu~. These properties will be assessed on a front
footage basis depending upon the width of the roadbed being ultimately im-
proved.

DESCRIPTION OF WORK
The general description of work consists of the construction of certain
grading, clearing and grubbing, asphalt concrete paving, concrete curb
and gutter, and storm drains including all appurtenances and appurten-
ant work, including acquisition of all rights-of-way and easements neces-
sary to accomplish the above Improvements to the specified widths and
dimensions and all said work and acquisition is located in all or a por-
tion of the following listed streets or easements and as shown on the
diagram map (reduced) included herein:
Streets -- 2-Lane Divided
Two 12-foot AC/AB travel lanes, separated by a 18-foot unimproved me-
dian and appurtenances thereto:
6Lh Street: From Haven Avenue to Rochester Avenue intersecting with
7th Street, approximately 9900 feet in length.
Milliken Avenue: From 4th Street to 6th Street, a distance of approxi-
mately 2650 feet.
Streets - 2 or 1 I_~ne Undivided
Two 12-foot AC/AB travel lane:; constructed on centerline and appurten-
ances thereto:
Cleveland Avenue: Easterly 1 lane approximately 600 feet north of qth

At Rochester Avenue and 8th Street, Line 19D branches westerly in 8th Street and extends
a distance of approximately 2,800 feet to its terminus,
Line 19F: Consists of 69 and 66 inch RCP commencing in Rochester Avenue approximately
1,350 feet south of 7th Street, thence westerly to Buffalo Avenue, thence continuing
northwesterly in Buffalo Avenue to 6th Street and its terminus for a total distance of
approximately 1,550 feet.
Trademark Street Drain: Consistsof'a42-inch RCP commencing at Deer Creek Channel
approximately 1,200 feet north of 4th Street, thence east approximately 350 feet to its
terminus.
4th Street Channel: Consists of an earthen channel commencing at 4th Street and Cleveland
Avenue thence westerly to Haven Avenue where the channel enters a proposed ultimate
15' x 7' RCB, thence continuing the earthen channet westerly to Turner Avenue and three
existing 60 inch RCPs.
The amended general description of work consists of pavement reconstruction of 4r* Street from
Utica to Pittsburgh, consisting of removal and replacement of AC pavement, cold planning, curb
ramp on the northwest corner of Milh'ken, adjust valve covers, adjust manhole covers, striping,
and traffic control.

METHOD OF ASSESSMENT
The Municipal Improvement Act of 1913 provides that the costs and inciden-
tal expenses of a project be assessed in proportion to the estimated "benefit"
received by each of the lots or parcels of land within the assessment district.
The code does not provide a specific benefit formula, hence that determina-
tion is made by the Assessment Engineer for consideration by the legislative
body. The formula used should be one that reflects benefit received by
each parcel and result in the most: equitable proration of the costs to each
of the lots or parcels within the assessment district.
Storm Drain
The boundaries of this district have been established from the consideration
of drainage. The natural north-south drainage is confined or cut off by
Deer Creek on the west and Interstate 15 on the east. Between these two
points therE: is very little definition of the sheet flows that occur and this
Is emphasized by the fact that the Federal Flood Insurance Administration
has indicated the entire area is subject to flooding under a 100-year fre-
quency span.
Benefit to the properties involved is two-fold. When the system is com-
pleted, all properties will receive flooding relief and possibly flood insur-
ance designation reductions where these charges are applicable. There is

also imposed upon the area drainage fees pursuant to Section 66483 of the
Subdivision Map Act. When assessments are confirmed upon the property
or otherwise paid, the development drainage fee will be reduced by the
amount of the assessment. Where these fees have previously been paid
the properties will be credited the amount so paid and that amount entered
as a cash contribution to the assessment district.
There is one segment of the Master Plan of Storm Drains which will not
be constructed at this time, The segment is located on 6th Street between
Cleveland Avenue and Milliken Avenue and is presently being eliminated
due to the fact that it only serves the property to the north and there are
no immediate plans for the property to develop.
Based on the summation of the above factors, it is concluded that there is
no permanent physical differentiation between the properties in this assess-
ment district from a drainage standpoint~ It is also noted that the system
as proposed could be constructed by many other configurations and still
accomplish the same purpose.
For the above reasons, it is concluded that the properties within the assess-
ment district will uniformly benefit in proportion to their area and the drain-
age assessment is distributed accordingly.
Street Improvements
The street work included in the assessment district has as Its purpose the
opening of the area for development. As such, the street work generally

consists of two traffic lanes which constitute only a portion of the ultimate
width of the arterial street. The two lane construction, however, being for
the purpose of opening the area for development, relate in benefit to the
area rather than directly to the adjacent frontage. With the benefit thus
related to the area, the method of assessment is on an area basls.
Where parcels border existing improved roads, but will also benefit from
these land opening roads on the other sides of their boundaries, the area
for assessment purposes has been redLlced to one-half.
Street improvements beyond the two lane improvements become the respon-
sibility of the adjacent property upon development. Requests have been
received by the City from certair~ property owners to include these Improve-
ments within the bond issue. These properties will be assessed on a front
footage basis depending upon the width of the roadbed being ultimately im-
proved.
